His journey, marked by dedication, scholarly pursuits, and a commitment to public service, has earned him accolades and respect in the legal fraternity.<\/p>\n<p style=\"text-align: center; font-weight: bold; font-size: 18.0pt; color: #c00000;\">Early Life and Education<\/p>\n<p style=\"margin-bottom: 3%;\">Justice Prasanna B. Varale pursued his schooling and degree level studies at various places in Maharashtra, such as Shahada, Shirpur, Nashik, Sangli, Buldhana, Latur and Nanded. His higher academic journey commenced at Dr. Babasaheb Ambedkar Marathwada University, where he pursued a degree in Arts and Law.<a id=\"fnref1\" title=\"1. He started practicing in the High Court of Bombay, Aurangabad Bench. He joined the chamber of esteemed Advocate S.N. Loya, where he honed his skills and expertise on both the Civil and Criminal sides of the legal spectrum.<a id=\"fnref2\" title=\"2. Varale reached a significant milestone on 18 July 2008, when he was elevated to the bench of the High Court of Bombay.<a id=\"fnref5\" title=\"5. Former Justices, High Court of Bombay.\" href=\"#fn5\"><sup>5<\/sup><\/a> His years of dedicated service and legal acumen were duly recognized as he assumed the responsibilities of a High Court Judge.<\/p>\n<p style=\"margin-bottom: 3%;\">Justice Varale\u2019s career reached another landmark on 15 October 2022, when he took oath as the Chief Justice of the High Court of Karnataka.<a id=\"fnref6\" title=\"6. Varale, JJ., in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Amlesh Kumar<\/span> v. <span style=\"font-style: italic;\">State of Bihar<\/span><\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/dR72590n\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\">2025 SCC OnLine SC 1326<\/span>,<\/a> held that <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/06\/10\/sc-sets-aside-patna-high-court-order-permitting-forced-narco-analysis-test\/\" target=\"_blank\" rel=\"noopener\">compelling an accused to undergo narco-analysis<\/a> test without free consent, violates their fundamental rights under Articles <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574938\" target=\"_blank\" rel=\"noopener\">20(3)<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\" rel=\"noopener\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>. Reaffirming its decision in <span style=\"font-style: italic;\">Selvi<\/span> v. <span style=\"font-style: italic;\">State of Karnataka<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/D0ays3p7\" target=\"_blank\" rel=\"noopener\">(2010) 7 SCC 263<\/a>, the Court reiterated that involuntary administration of narco-analysis tests is unconstitutional, and any information obtained therefrom cannot be used as evidence.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Anil Bhavarlal Jain<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span><\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/D22nYaqY\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\">2024 SCC OnLine SC 3823<\/span>,<\/a> a set of two criminal appeals were filed against Bombay High Court\u2019s decisions, wherein the accused persons\u2019 petitions under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> (CrPC) seeking quashing of the FIR for offences punishable under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561745\" target=\"_blank\" rel=\"noopener\">409<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561758\" target=\"_blank\" rel=\"noopener\">420<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561375\" target=\"_blank\" rel=\"noopener\">120-B<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> along with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001564434\" target=\"_blank\" rel=\"noopener\">13(2) r\/w 13(1)(d)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825997\" target=\"_blank\" rel=\"noopener\">Prevention of Corruption Act, 1988<\/a> (PC Act) were dismissed; the Division Bench Vikram Nath and <span style=\"font-weight: bold;\">Prasanna B. Varale<\/span>, JJ. upheld the High Court\u2019s decision holding that it was justified in not exercising its jurisdiction under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>. Considering that a special statute i.e. PC Act was invoked, the Court opined that <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/12\/25\/sc-upholds-decision-refusing-to-quash-fir-under-pc-act-involving-sbi-employees\/\" target=\"_blank\" rel=\"noopener\">quashing of offences under the PC Act would have a grave and substantial impact<\/a> not just on the parties involved, but also on the society at large.<\/p>\n<p style=\"margin-bottom: 3%;\">The Division Bench of Bela M. Trivedi and Prasanna B. Varale, JJ., in <span style=\"font-weight: bold; font-style: italic;\">Alarming Rise in the Number of Reported Child Rape Incidents, In re<\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/h81l57wj\" target=\"_blank\" rel=\"noopener\">2025 SCC OnLine SC 1130<\/a><\/span>, urged both the Central Government and the State Governments to <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/05\/17\/supreme-court-sensitization-pocso-courts-combat-delays\/\" target=\"_blank\" rel=\"noopener\">take appropriate steps to sensitize officials involved in the investigation of POCSO cases<\/a>. The Bench also emphasised the need to prioritize the creation of additional courts dedicated to hearing cases under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\" rel=\"noopener\">Protection of Children from Sexual Offences Act, 2012<\/a> (POCSO Act) and to ensure that chargesheets were filed within the mandatory period stipulated in the POCSO Act. Furthermore, the Court directed that the trials be completed within the time frame envisaged by the POCSO Act.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Ramayana Ispat (P) Ltd.<\/span> v. <span style=\"font-style: italic;\">State of Rajasthan<\/span><\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/BLi3D5s8\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\">(2025) 8 SCC 747<\/span><\/a>, while considering the appeals concerning the imposition of restrictions and conditions on the exercise of open access for captive power plants and other large consumers of electricity via Rajasthan Electricity Regulatory Commission (Terms and Conditions for Open Access) Regulations, 2016 framed by the Rajasthan Electricity Regulatory Commission in the exercise of its powers under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001553521\" target=\"_blank\" rel=\"noopener\">42<\/a> read with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001553490\" target=\"_blank\" rel=\"noopener\">181<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002782344\" target=\"_blank\" rel=\"noopener\">Electricity Act, 2003<\/a>; the Division Bench of Vikram Nath and Prasanna B. Trivedi and Prasanna B. Varale, JJ. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/01\/17\/sc-grants-anticipatory-bail-to-wife-accused-of-abetting-husband-suicide-legal-news\/\" target=\"_blank\" rel=\"noopener\">allowed the plea for anticipatory bail noting that the accused-wife had joined the investigation<\/a> and that she was not required for further investigation.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Naresh Kumari<\/span> v. <span style=\"font-style: italic;\">Chameli<\/span><\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/V0USJ6lX\" target=\"_blank\" rel=\"noopener\">(2024) 20 SCC 1<\/a>,<\/span> which was an appeal against Punjab and Haryana High Court\u2019s decision whereby the second appeal of the respondents \/ defendants \/ donees against the decision of the trial court wherein, the suit property was directed to be reverted to the plaintiffs\/ donor\u2019s heir, was allowed and the concurrent decisions of the Courts below, which had decreed the suit, were set aside, the Division Bench of Sudhanshu Dhulia and Prasanna B. Varale, JJ. upheld the High Court\u2019s decision viewing that the plaintiffs had no case. Ashok<\/span> v. <span style=\"font-style: italic;\">H.N. Gopal<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/lBn28V5Q\" target=\"_blank\" rel=\"noopener\">2023 SCC OnLine Kar 98<\/a><\/span>, the Division Bench of <span style=\"font-weight: bold;\">Prasanna B. Varale, CJ.*<\/span>, and Krisha S. Dixit, J., refused to interfere in the matter on certain grounds, where one of the grounds being that Single Judge after examining the matter had recorded a finding that the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/11\/30\/directions-issued-state-election-commission-local-body-elections-process-karnataka-hc-legal-news\/\" target=\"_blank\" rel=\"noopener\">appellant had criminal antecedents and the same were not disclosed in the affidavit accompanying the nomination papers.<\/a> In the process of ensuring purity of elections, the Supreme Court in plethora of decisions had declared that the disclosure of such antecedents is a matter of right of the electors who can form an informed decision about the candidates in the electoral fray and that non-disclosure therefore is a ground for setting aside the election of Returned Candidates. The Single Judge has rightly framed the impugned order keeping in view the existing Supreme Court decisions.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cIt is pertinent to note that the law relating to disclosure of criminal antecedents of the candidates in the Electoral fray has further marched from April to May and now to the June of life.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">While deciding the instant petition seeking a Writ of Quo Warranto against the private respondents who have been appointed by the State Government as Political Secretaries, Chief Advisor and Media Advisor to the current Chief Minister of Karnataka in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Umapathi S.<\/span> v. <span style=\"font-style: italic;\">State of Karnataka<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/OPQ18664\" target=\"_blank\" rel=\"noopener\">2023 SCC OnLine Kar 59<\/a><\/span>, the Division Bench of <span style=\"font-weight: bold;\">Prasanna B. Dixit, J., in the context of the instant matter reiterated that, <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/09\/13\/disputes-oral-documentary-evidence-ordinarily-writ-jurisdiction-karnataka-hc-legal-news\/\" target=\"_blank\" rel=\"noopener\">disputes of the kind which require both oral and documentary evidence are not ordinarily taken up for examination in writ jurisdiction<\/a>; it is more so when the remedy provided under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002054607\" target=\"_blank\" rel=\"noopener\">70<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002055660\" target=\"_blank\" rel=\"noopener\">Karnataka Cooperative Societies Act, 1959<\/a> happens to be alternate and more efficacious one.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Pallavi G.M.<\/span> v. <span style=\"font-style: italic;\">Karnataka Power Transmission Co. Ltd.<\/span><\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/1W3ZHn5J\" target=\"_blank\" rel=\"noopener\">2023 SCC OnLine Kar 61<\/a><\/span>, an appeal filed by the appellant challenging the dismissal of her claim to her deceased brother\u2019s job on compassionate grounds, a division bench comprising of <span style=\"font-weight: bold;\">Prasanna B Varale,* CJ.<\/span>, and Krishna S Dixit, J., dismissed the appeal on the ground that sister does not fall in the definition of Rule 2(1)(b), 1996 Rules.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cCourts through the process of interpretation cannot expand the contours of a statutory definition. Ltd.<\/span> v. <span style=\"font-style: italic;\">S Kiran<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/wyE8L0i6\" target=\"_blank\" rel=\"noopener\">2023 SCC OnLine Kar 99<\/a><\/span>, a division bench comprising of <span style=\"font-weight: bold;\">Prasanna B Varale,* CJ.<\/span>, and Krishna S Dixit, J., upheld an order of a Single Judge which directed the Karnataka Power Transmission Corporation Limited to reinstate an employee who was dismissed from service due to unauthorised absence of 632 days (about 1 year 9 months) on account of suffering from mental depression.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cDistress and depressions are the byproducts of modern life, whichever be the calling. Stress is the product of the psychological or emotional pressure that we experience both in our personal and occupational lives. Often it is difficult to insulate the stress, and to determine its impact on day to day activities. There may come a point that the \u2018stressors\u2019 encountered in the work place lead to the inability to function in a work environment. A decision to lay an employee off work, with or without just cause, may well escalate the level of depression.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">High Court of Karnataka<\/span> v. <span style=\"font-style: italic;\">State of Karnataka<\/span>,<a id=\"fnref11\" title=\"11. order dated 12.12.2023.\" href=\"#fn11\"><sup>11<\/sup><\/a><\/span> where the Court took suo-motu cognizance of the news articles published in Daily News Papers namely, \u2018Deccan Herald\u2019, Bengaluru edition, dated 12-12-2023 under the caption \u2018Woman beaten up, paraded naked after son elopes with girl\u2019, a Division Bench comprising Prasanna B. Varale, CJ., and M.G.S Kamal, J., directed to not telecast the video of interviews of the victim who was paraded naked.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cThough the print media has at least displayed some sensibility and sensitivity while publishing the photograph by blurring the image of the victim and her associates but the disturbing factor is the said photograph reveals that some persons apparently from the electronic media or its representatives are photographing and vediographing the victim&#8217;s reaction and narration. Thus, on one hand, where there is a reflection of sensibility, on the other hand there is stark contrast wherein the media persons are seem to be acting most irresponsible and insensitive manner.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Mahalakshmamma<\/span> v. <span style=\"font-style: italic;\">Department of Rural Development and Panchayathraj<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/d9jV9kZZ\" target=\"_blank\" rel=\"noopener\">2023 SCC OnLine Kar 100<\/a><\/span>, an appeal by second wife pertaining to family pension, a division bench comprising of <span style=\"font-weight: bold;\">Prasanna B. Patel (Administrator, Dadra and Nagar Haveli) and others by Mohan Delkar&#8217;s son Abhinav Delkar.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Nauman Suleman Khan<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/h0cow87f\" target=\"_blank\" rel=\"noopener\">2022 SCC OnLine Bom 1148<\/a><\/span>, where the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/06\/03\/if-a-boy-accused-under-s-376-ipc-in-consensus-with-the-victim-girl-decides-to-get-married-bombay-high-court-law-legal-legal-news\/\" target=\"_blank\" rel=\"noopener\">applicant was accused of an offence registered under Section 376 of the Penal Code, 1860<\/a> and under Section 4, POCSO Act, a Division Bench of Prasanna B. Varale and S.M. Modak, JJ., quashed the FIR filed for an offence on noting that the dispute was settled and that the applicant and the victim were in love with each other and decided to get married after settling in life in their respective careers.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Amol Kashinath Vyavhare<\/span> v. <span style=\"font-style: italic;\">Purnima Chaugule Shrirangi<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/080RZO9S\" target=\"_blank\" rel=\"noopener\">2022 SCC OnLine Bom 1000<\/a><\/span>, wherein a journalist sought to quash proceedings against him for <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/05\/09\/article-on-a-rift-between-police-officers-published-in-newspaper-bombay-high-court-defamation\/\" target=\"_blank\" rel=\"noopener\">publishing news items regarding the rift between the officers of the police departments<\/a>, the Division Bench of Prasanna B. Varale and S.M. Modak, JJ., expressed that <span style=\"font-weight: bold;\">\u201cif we will say that any news article pertaining to two Sections of any Department will fall within the purview of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561859\" target=\"_blank\" rel=\"noopener\">505(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Indian Penal Code<\/a>, in that case, we are interpreting the provisions of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561859\" target=\"_blank\" rel=\"noopener\">505(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Indian Penal Code<\/a> too far and it is not expected by legislatures.\u201d<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">While deciding <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/04\/29\/declaration-of-reciting-religious-verses-at-someones-residence-personal-liberty-bombay-high-court\/\" target=\"_blank\" rel=\"noopener\">whether declaration of reciting religious verses at someone\u2019s residence is an act of breaching personal liberty of another person<\/a> in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Navneet Ravi Rana<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span><\/span>,<a id=\"fnref12\" title=\"12. WP No. 1286 of 2022, decided on 25-4-2022.\" href=\"#fn12\"><sup>12<\/sup><\/a> a petition was filed for quashment of an FIR registered for the commission of an offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561667\" target=\"_blank\" rel=\"noopener\">353<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>, the Division Bench of Prasanna B. Varale and S.M. Modak, JJ., while stating that, <span style=\"font-weight: bold;\">\u201cGreat power comes with greater responsibility\u201d<\/span>, expressed that the expectation of responsible behaviour or responsible conduct from those persons who are active in public life cannot be an extra expectation but would be a basic expectation. The Court stated that the second FIR was registered against the Petitioners attracting of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561667\" target=\"_blank\" rel=\"noopener\">353<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code<\/a>, in case the State Government was desirous of initiating any action including the action against the Petitioners in pursuant to the FIR, the Officials of the State Government shall issue 72 hours\u2019 notice to the Petitioners before taking such action.<\/p>\n<p style=\"margin-bottom: 3%;\">While deciding <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/11\/04\/festival-of-lights-would-spread-joy-and-happiness-but-few-members-of-marginalized-section-are-deprived-of-basic-requirements-of-human-life\/\" target=\"_blank\" rel=\"noopener\">whether Aadhaar the only criteria for identification of beneficiaries under National Food Security Act<\/a> in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Ganpat Dharma Mengal<\/span> v. <span style=\"font-style: italic;\">Tehsildar Office<\/span><\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/Sn7hLYe7\" target=\"_blank\" rel=\"noopener\">2021 SCC OnLine Bom 13720<\/a><\/span>, a Division Bench of Prasanna B. Varale and Madhav J. Jamdar, JJ., expressed that, <span style=\"font-style: italic;\">\u201cit is disheartening situation for us when we the fortunates are eagerly awaiting as the festive season is approaching and the festival of lights would spread joy and happiness in the society throughout the State or the whole nation, here are the few petitioners who are the members of the marginalised section in general and tribals in particular who have approached this Court on a grievance that they are deprived of the basic requirement of human life, i.e., food, only on account that the State machinery is not technically equipped to give them the benefits flowing from the scheme formulated and floated by the Union of India and to be implemented and executed by the respective States.\u201d<\/span> The Court stated that it is unable to find any logic, reason or rationale for denying the benefits of distribution of foodgrains to the petitioners and alike persons raising certain technical ground by the respondent authorities, hence by way of interim direction Court directed Respondents 1, 2 and 3 to distribute the foodgrains to the petitioners and similarly circumstanced persons \u2014 the tribal beneficiaries under the PDS as well as the provisions of the National Food Security Act and the Pradhan Mantri Garib Kalyan Anna Yojana.<\/p>\n<p style=\"margin-bottom: 3%;\">While deciding <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/04\/13\/circumstantial-evidence\/\" target=\"_blank\" rel=\"noopener\">whether husband be convicted based on him being last seen with dead wife<\/a>, in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Sandip Baburao Waidande<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span><\/span>, <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/h05biVkb\" target=\"_blank\" rel=\"noopener\">2021 SCC OnLine Bom 560<\/a><\/span>, a Division Bench of Prasanna B. Varale and S.M. Modak, JJ., held that in a matter of circumstantial evidence, the law doesn\u2019t require a particular number of circumstances to establish the chain, it only depends on nature. The Court stated that it has almost been 5 years since the accused was behind the bars. Further, even if the circumstance of the last seen together was considered, the Court did not think that other circumstances were sufficient to prove the guilt of the accused. The Court opined that prejudice was caused to the accused.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cLaw does not require a particular number of circumstance so as to establish the chain. It altogether depends upon the nature of the transaction.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Imran Shabbir Gauri<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/cGrB537u\" target=\"_blank\" rel=\"noopener\">2021 SCC OnLine Bom 511<\/a><\/span>, the Division Bench of Prasanna B. Varale and S.M. Modak, JJ., held that the finding that electronic evidence also needs to be proved just like any other evidence. Further, the Court stated that the present set of facts and circumstances warrants that there are certain materials suggesting sexual intercourse, but the hands of the Court are tied due to the provisions of law. The Court expressed that <span style=\"font-style: italic;\">\u201c<\/span><span style=\"font-style: italic;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/04\/06\/rape-2\/\" target=\"_blank\" rel=\"noopener\">relationship in between brother and sister, relationship in between mother and son, relationship in between father and daughter<\/a> and so on were considered as sacrosanct. However, due to passage of time, these relationships have no more remained sacrosanct and there are various instances of overstepping the sacrosanct relationship by the near relationship.\u201d<\/span><\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold;\">\u201cWe hope that legislatures will also consider the practical realities of the life which the victim has to face. The trauma which victim has to undergo, after the incident does not stop there and when it comes to facing real-life issues, there may be occasion for the victim to forego all the trauma which she had undergone and to take U turn.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">While questioning the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2020\/04\/29\/bom-hc-fear-of-corona-infection-spreading-through-newspapers-not-supported-by-evidence-court-questions-blanket-ban-on-door-to-door-delivery-of-newspapers\/\" target=\"_blank\" rel=\"noopener\">blanket ban on door-to-door delivery of newspapers<\/a> in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">High Court of Bombay<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span><\/span>,<a id=\"fnref13\" title=\"13. Suo Motu PIL (St.) No. 10567 of 2020, dated 27-4-2020\" href=\"#fn13\"><sup>13<\/sup><\/a> a single-judge bench comprising of Prasanna B. Varale, J. took cognizance of the amendment made in the Government Order whereby door-to-door delivery of newspapers has been completely prohibited in Mumbai Metropolitan Region (MMR), Pune Municipal Corporation (PMC) and in all containment zones as may be decided by the District Magistrates.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">State of Maharashtra<\/span> v. <span style=\"font-style: italic;\">Shatrughna Baban Meshram<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/41918eE8\" target=\"_blank\" rel=\"noopener\">2015 SCC OnLine Bom 5052<\/a><\/span>, a first sentencing of its kind, a bench comprising of Bhushan Gavai and Prasanna B. Varale, JJ. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2015\/10\/17\/double-death-sentence-and-double-life-imprisonment-in-rape-and-murder-case-confirmed\/\" target=\"_blank\" rel=\"noopener\">confirmed double death sentence and double life imprisonment in a case of rape and murder of a two-year-old girl by her uncle.<\/a> The sentence was awarded under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561702\" target=\"_blank\" rel=\"noopener\">376-A<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> which was brought through the Criminal Law Amendment Act, 2014 after the gruesome Nirbhaya case. This section provides for death sentence for an offence of committing rape and inflicting injury which causes death or causes the woman to be in a persistent vegetative state.<\/p>\n<p style=\"margin-bottom: 3%;\">While deciding on the question <a href=\"https:\/\/www.scconline.com\/blog\/post\/2015\/08\/19\/issue-of-jurisdiction-to-be-decided-before-deciding-on-divorce\/\" target=\"_blank\" rel=\"noopener\">whether a couple having their native place in particular city or state can file for divorce in Family Court situated in another city or state<\/a> in <span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">Kalpana Dhone<\/span> v. <span style=\"font-style: italic;\">Gorakhnath Govinda Dhone<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/B663w3zc\" target=\"_blank\" rel=\"noopener\">2015 SCC OnLine Bom 4709<\/a><\/span>, a division bench comprising of V.M. Naik and Prasanna B.
