Sujatha, J.<\/span>, enhanced the compensation to &#8377;1692060 with interest at 7.5 per cent per annum from the date of filing of the petition till the date of realisation, after holding the respondent insurer liable for paying the compensation to the claimants. The Court considered the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002814532\" target=\"_blank\">Minimum Wages Act, 1948<\/a> (MWA) to calculate the annual income, applied multiplier of 15, deducted one fourth towards personal and living expenses and awarded additional 40 per cent towards future prospects and &#8377;40000 to each claimant under the head of loss of consortium.<\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">The petitioners i.e. wife, daughter, son and parents of the deceased filed claim petition under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001569568\" target=\"_blank\">166<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726964\" target=\"_blank\">Motor Vehicles Act, 1988<\/a> claiming compensation of &#8377;15,00,000 with interest and costs, for the death of the deceased in a motor vehicle accident.<\/p>\n<p style=\"margin-bottom: 3%;\">Due to tractor turning turtle, the deceased fell beneath stone load and died on spot. Case was registered against the respondents under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561610\" target=\"_blank\">304-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">Penal Code<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioners claimed that the 37-year-old deceased was healthy and earning &#8377;300 per day, so they lost income, company, love and affection due to sudden demise of deceased. The driver i.e. Respondent 1, owner as Respondent 2 and insurer as Respondent 3, are jointly and severally liable to pay the compensation amount to the petitioners with interest from the date of the petition till realisation.<\/p>\n<p style=\"margin-bottom: 3%;\">While Respondents 1 and 2 remained ex parte, Respondent 3 denied allegations. Resultantly, the petitioners were put to strict proof with regard to the manner of accident, rash and negligence on the part of driver, registration of crime, age, occupation and income of the deceased.<\/p>\n<p style=\"margin-bottom: 3%;\">Respondent 3 contended that the deceased travelled in the tractor as passenger, not as a coolie to unload the stones as the tractor had hydrolic system to unload by itself. The tractor was only for agricultural purpose, not for commercial. Moreover, the other respondents violated the policy, thus they have no liablity to pay compensation and prayed to dismiss the petition.<\/p>\n<p style=\"margin-bottom: 3%;\">The Tribunal allowed the claim petition, awarding &#8377;12,40,000 as compensation, with interest at 7.5 per cent per annum from the date of petition, till the date of realisation directing Respondents 1 and 2 to deposit the compensation amount within 1 month from the date of order.<\/p>\n<p style=\"margin-bottom: 3%;\">Aggrieved appellants filed this appeal on the ground that the Tribunal did not award adequate compensation after proper appreciation of the facts and applicable legal principles and erred in holding that the insurance company is not liable to pay compensation to the appellants instead of directing the insurance company to pay first and then recover it from Respondents 1 and 2.<\/p>\n<h3>Issue<\/h3>\n<p style=\"margin-bottom: 3%;\">Whether the order of the Tribunal needs any interference?<\/p>\n<h3>Analysis &amp; Decision<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court observed that during the examination of the eyewitness who called Respondent 2 (owner) for slabs for construction of water tank, it was found that Respondent 2 sent Respondent 1 (driver) and the deceased for construction work. The deceased was sitting on the load of stones when the driver drove the tractor in negligent manner. The rash and negligent driving turned the tractor turtle and the deceased fell down and slabs fell on him, leading to his death on spot.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the Tribunal, upon examining the certified copies of FIR, charge-sheet, inquest report, post-mortem examination certificate of deceased and motor vehicle inspection report held that the accident occurred due to rash and negligent driving of Respondent 1.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that this finding of tribunal needs no interference.<\/p>\n<p style=\"margin-bottom: 3%;\">With respect to liability of Respondent 3, the Court noted the contention of the insurance company, relied upon by the Tribunal, that the deceased happened to travel in trailer with no seating capacity, which is breach of policy conditions. The tractor had seating capacity only for driver, making deceased an unauthorised passenger and the tractor and trailer were insured only for agricultural purpose, not for carrying goods, so the insurance company is not liable to pay any compensation to the claimants.<\/p>\n<p style=\"margin-bottom: 3%;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/03\/18\/insurance-company-liable-satisfy-award-death-bodily-injuries-of-unauthorised-passenger-jammu-and-kashmir-and-ladakh-high-court-legal-news-updates\/\" target=\"_blank\">Also Read: Motor Accidents Claim| Can Insurance Claim Be Recovered In Case Of Death\/Bodily Injuries Of Unauthorised Passengers? J&amp;K And Ladakh High Court Answers<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that as per the Tribunal, Respondent 3 was not liable for compensation because the policy clearly reflected that it empowered travel of only one person and the Respondents 1 and 2 were alone held to be liable to pay compensation.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court perused the attested copy of policy and found that additional premium was paid for trailer, which covered the deceased travelling in trailer and the policy was also in force on the date of the accident. Therefore, the Court held that Respondent 3 cannot escape from the liability and it was jointly and severally fixed on each respondent.<\/p>\n<p style=\"margin-bottom: 3%;\">On the point of tribunal fixing the notional income of the deceased to be &#8377;300 per day, the Court opined that in the absence of any documentary evidence to prove the income, the Tribunal ought to have considered the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002814532\" target=\"_blank\">Minimum Wages Act, 1948<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">It was the finding of the Court that the deceased was entitled to &#8377;256 per day as per the memo 2016 of MWA 1948, and one fourth of it was to be deducted towards personal and living expenses due to 5 dependents, which made the annual income to be &#8377;69120. The age of the deceased at the time of the accident was determined to be 40 so he was held to be entitled to an additional 40 per cent of his income towards future prospects on application of the principles in <a href=\"http:\/\/www.scconline.com\/DocumentLink\/Cj8bsNxR\" target=\"_blank\"><span style=\"font-weight: bold;\"><span style=\"font-style: italic;\">National Insurance Co. Ltd.<\/span> v. <span style=\"font-style: italic;\">Pranay Sethi, (2017) 16 SCC 680<\/span><\/span><\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court applied multiplier 15 to the new income of &#8377;96804, which is applicable for the age group of 35 to 40 years. Thus, the loss of dependency was determined to be &#8377;1452060.<\/p>\n<p style=\"margin-bottom: 3%;\">Funeral expenses of &#8377;25000 were awarded by the Tribunal.
