Jayasankaran Nambiar*<\/span> and Preeta A.K., JJ. reversed the decision. The Court held that the practice of Electro-Homeopathy is regulated under the statutory framework governing Homeopathic medical practitioners and that no person can lawfully practice Electro-Homeopathy in Kerala without complying with the registration and qualification requirements prescribed under the applicable medical practitioners&#8217; statutes.<\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">The first respondent claimed to be a practitioner of Electro-Homeopathy based on a diploma certificate issued by the Council of Electro Homeopathy System of Medicine, Kanpur, Uttar Pradesh. He alleged that the Travancore-Cochin Medical Council had caused interference by the State and police authorities with his practice of Electro-Homeopathy without any legal basis.<\/p>\n<p style=\"margin-bottom: 3%;\">He filed a petition seeking protection from such interference. The Single Judge relied on an earlier Division Bench decision in <span style=\"font-style: italic;\">Anil Kumar<\/span> v. <span style=\"font-style: italic;\">State of Kerala<\/span><a id=\"fnref1\" href=\"#fn1\" title=\"1. W.P.(C) No. 19484 of 2008.\"><sup>1<\/sup><\/a>, and held that since there was no demonstrated legal prohibition against the practice of Electro-Homeopathy, the police could not interfere with his activities.<\/p>\n<p style=\"margin-bottom: 3%;\">Aggrieved by this decision, the Travancore-Cochin Medical Council preferred the present writ appeal.<\/p>\n<h3>Issues<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>Whether the practice of Electro-Homeopathy is regulated under the Travancore-Cochin Medical Practitioners Act, 1953 and the Kerala State Medical Practitioners Act, 2021.<\/p>\n<\/li>\n<li>\n<p>Whether a person possessing a diploma in Electro-Homeopathy can lawfully practice without registration under the applicable medical practitioners&#8217; statutes.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Whether <span style=\"font-style: italic;\">Anil Kumar<\/span> constituted a binding precedent.<\/p>\n<\/li>\n<\/ol>\n<h3>Analysis and Decision<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court observed that Indian constitutional jurisprudence does not recognise absolute liberty. The rights and freedoms guaranteed under the Constitution are subject to reasonable limitations and must be balanced with a citizen&#8217;s duties and obligations towards others. Therefore, a person cannot claim an unrestricted right to engage in any activity merely because there is no express statutory prohibition against it.<\/p>\n<p style=\"margin-bottom: 3%;\">The earlier Division Bench judgment was held to be per incuriam because it failed to consider the relevant statutory framework governing medical practitioners.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court rejected the proposition that citizens are free to undertake any activity unless expressly prohibited by law. Under Indian constitutional jurisprudence, rights and liberties are not absolute and may be subject to reasonable regulation in the public interest.<\/p>\n<p style=\"margin-bottom: 3%;\">The respondent&#8217;s own qualification indicated that he was trained in a branch of Homeopathic medicine. Consequently, his practice falls within the scope of legislation regulating medical practitioners.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court emphasised that regulation of medical practice is necessary to protect public health and safety. Medical professions directly affect the lives and well-being of patients and therefore require statutory oversight. The fundamental right to practice a profession under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574926\" target=\"_blank\">19(1)(<span style=\"font-style: italic;\">g<\/span>)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a> is subject to laws prescribing professional qualifications and standards of conduct.<\/p>\n<p class=\"animate-charcter\" style=\"margin-left: 36pt; margin-bottom: 3%; font-style: italic; color: #090909;\">&#8220;While a citizen is guaranteed a fundamental right to practice any profession or to carry out any occupation, trade or business, that right is by no means absolute in nature. It is subject to laws regulating professional qualification and conduct that are enacted with a view to balancing the rights of the professional concerned with the right to life and proper healthcare of persons who receive medical care and treatment.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that Electro-Homeopathy is regulated by the Travancore-Cochin Medical Practitioners Act, 1953 and the Kerala State Medical Practitioners Act, 2021. A person practicing Electro-Homeopathy must comply with the registration and regulatory requirements prescribed under these enactments<\/p>\n<p style=\"margin-bottom: 3%;\">The Court allowed the writ appeal, set aside the judgment of the Single Judge, and dismissed the writ petition.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\"><span style=\"font-style: italic;\">Travancore Cochin Medical Council<\/span> v. <span style=\"font-style: italic;\">Rajesh K<\/span>., W.A.NO.1737 OF 2020, decided on 17-6-2026<\/span>]<\/p>\n<hr\/>\n<p>Advocates who appeared in this case:<\/p>\n<p style=\"margin-left: 18pt;\"><span style=\"font-weight: bold;\">For Appellant:<\/span> N.
