From predictive sentencing tools and case outcome analysis to automated document review and judicial research assistants, the panellists discussed how these technologies promise efficiency gains and data-driven insights, yet raise fundamental questions about accuracy, bias, transparency, and the nature of judicial decision-making itself.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/06\/11-30_AI-In-Courtroom-1.png\" alt=\"\" width=\"956\" height=\"430\"\/><\/p>\n<p style=\"margin-bottom: 3%;\">Moderated by <span style=\"font-weight: bold;\">Ms. Leila El Gharbi<\/span>, UK Ambassador, European Legal Technology Association, the panel consisted of esteemed speakers, <span style=\"font-weight: bold;\">Ms. Mona Datt<\/span>, CEO and Founder, Loom Analytics, and <span style=\"font-weight: bold;\">Ms. Caoimhe Powell<\/span>, Director, Disputes (Legal) for Digital Legal Delivery, UK, US &amp; EMEA, HSF Kramer.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/06\/11-30_AI-In-Courtroom-2.png\" alt=\"\" width=\"450\" height=\"600\"\/><\/p>\n<p style=\"text-align: center; color: #0e101a; font-size: 18pt;\"><span style=\"font-weight: bold;\">From Skepticism to Curiosity<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">From the perspective of dispute resolution, <span style=\"font-weight: bold;\">Ms. Caoimhe Powell<\/span> explained that in the last year itself, there had been a huge shift in perception of Generative AI as clients were no longer skeptical but rather asking how it could be used. They had plenty of questions in their attempt to understand AI, especially regarding security, solicitations, and validations. Similarly, legal practitioners had gotten more comfortable with using AI. However, she emphasized that while experimentation and integration were growing rapidly, the legal sector had not yet reached full adoption.<\/p>\n<p style=\"margin-bottom: 3%;\">Agreeing with Ms. Powell, <span style=\"font-weight: bold;\">Ms. Mona Datt<\/span> stated that there was a lot of skepticism 2 years ago, but now there is a general acceptance around using AI, and it is at the stage of adoption. She explained that Courts are the most conservative towards AI and new tech as they handle sensitive data and are courts of record. Thus, nervousness was justified. However, there had been a shift in perception due to improvement in its use for law, and immense progress in the last 12 months, even though adoption in courtrooms was not as fast as in law firms.<\/p>\n<p style=\"text-align: center; color: #0e101a; font-size: 18pt;\"><span style=\"font-weight: bold;\">Can AI replace lawyers?<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Responding to questions about whether AI could eventually eliminate the need for legal practitioners, Ms. Powell firmly rejected that possibility. According to her, generative AI should be used to manage large data volumes, improve efficiency, and accelerate what lawyers are doing, but it cannot replace a legal practitioner&#8217;s judgment.<\/p>\n<p style=\"margin-bottom: 3%;\">She stressed that litigation remains heavily regulated across jurisdictions. In the UK, civil procedure rules require solicitors to supervise disclosure processes and remain accountable for their decisions. Consequently, lawyers must remain actively involved in designing workflows, evaluating methodologies, and ensuring that AI-generated outcomes are legally defensible. She suggested that it was better to have a hybrid workflow rather than just using generative AI.<\/p>\n<p style=\"margin-bottom: 3%;\">Ms. Powell underscored that though outputs produced by generative AI are professional, fluid, and coherent, but unlike a junior, it does not mention assumptions used by it, exceptions to the general rule, or uncertainties about an issue. Thus, there was a need for human input to ensure that the AI outputs are sensible and meet the expectations of courts, clients, and regulators.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/06\/11-30_AI-In-Courtroom-3.png\" alt=\"\" width=\"450\" height=\"600\"\/><\/p>\n<p style=\"margin-bottom: 3%;\">Adding to this, Ms. Datt agreed that keeping a human in the loop was crucial, as ultimately, AI was a machine, and the human or legal professional was accountable for their work. This was substantiated by the recent regulations for AI use in courts, reminding lawyers and AI providers of the limits of AI usage.<\/p>\n<p style=\"text-align: center; color: #0e101a; font-size: 18pt;\"><span style=\"font-weight: bold;\">Transparency and disclosure<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Ms. Powell explained that there were indeed obligations surrounding AI use disclosures, but they depended upon the specific legal task being performed. If the task required an internal document or inbound disclosures, practitioners had greater flexibility. However, if the practitioner was attempting to meet obligations like the UK&#8217;s Civil Procedure Rules, then they had to think about the guidance in practice directions, which included transparency with the opposing party. Thus, in cases where generative AI had to be used at the disclosure stage, practitioners sought the opposing party&#8217;s consent to use it and explained their methodology in advance.<\/p>\n<p style=\"margin-bottom: 3%;\">She remarked that there were some grey areas that required judicial guidance and predicted that procedural rules would likely become more comprehensive soon.<\/p>\n<p style=\"text-align: center; color: #0e101a; font-size: 18pt;\"><span style=\"font-weight: bold;\">AI in trials<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Responding to a question about the best use cases of AI, Ms. Datt reflected on her company&#8217;s experience in evidence management, wherein they dealt with both collected evidence and real-time evidence of trials. She remarked that dealing with such data was extremely risky to eradicate a human from the process.<\/p>\n<p style=\"margin-bottom: 3%;\">Ms. Powell added that the use of AI had a real impact in disclosure cases, as millions of documents were scanned; in fact, in one case, there were five million documents. She emphasized the importance of having humans in the loop, as just practitioners would not have taken five million documents; they would have used traditional discovery methods, like email threads, keyword search, or analytics, to get a reasonable number of documents for analysis.<\/p>\n<p style=\"margin-bottom: 3%;\">Approximately 100,000 documents were ultimately processed using generative AI, which was able to provide predictions regarding relevance, exception cases, etc., in 12 hours. This would have taken weeks of manual review. Despite these advantages, Ms. Powell emphasized that substantial human review remained necessary to resolve edge cases, privilege issues, and legal defensibility.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; text-align: center;\"><span style=\"font-weight: bold; font-style: italic;\">&#8220;One of the real advantages of that case was we were able to get insights from the documents really quickly, so we could see the key documents after the 12-hour period, and that really helped us think about the strategy of the case.&#8221;<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">She also agreed with Ms. Datt that there was immense risk in making the process entirely human-based, as human judgment of a practitioner was still crucial. She stated that technology is not perfect and it was not there to replace us, rather to assist us. <span style=\"font-weight: bold; font-style: italic;\">&#8220;We really need to think about where we need to challenge the technology to make sure that we&#8217;re doing the best we can.&#8221;<\/span><\/p>\n<p style=\"text-align: center; color: #0e101a; font-size: 18pt;\"><span style=\"font-weight: bold;\">Critical thinking in the age of AI<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Regarding the loss of critical thinking and common sense due to AI use, Ms. Datt explained that she deliberately uses different AI platforms for different purposes, like one tool for creative tasks, another for coding, etc. She suggested providing a specific purpose to the AI rather than using the default setting. Understanding each tool&#8217;s strengths and limitations allows users to obtain better results while avoiding misplaced confidence.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/06\/11-30_AI-In-Courtroom-4.png\" alt=\"\" width=\"450\" height=\"550\"\/><\/p>\n<p>Agreeing with Ms. Datt, Ms. Powell stated that there were different tools for different tasks. One had to assess the following before using a generative AI tool:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>Is the task appropriate for the tool?<\/p>\n<\/li>\n<li>\n<p>What is the risk profile of inputting that data?<\/p>\n<\/li>\n<li>\n<p>What is the task at hand?<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">What is the risk profile of the task at hand?<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\">She added that the practitioner should strategize their workflow, create their methodology, and identify whether the usage of the tool aligns with their company or firm&#8217;s policies and professional obligations.<\/p>\n<p style=\"margin-bottom: 3%;\">Underscoring the importance of critical thinking for lawyers, Ms. Powell stated that this skill is becoming increasingly important, and the way to develop it is through experience. One needed to think about their teams, not just lawyers, whether they were in a company or business, using generative AI to develop critical thinking skills.<\/p>\n<p style=\"margin-bottom: 3%;\">Ms. Datt remarked that despite being an engineering company, they had guardrails around what tools they use for what tasks. Her company&#8217;s developers could not upload proprietary code into public AI tools and had to use specific licenses designed for handling their code. They used their critical thinking and relied on tools for groundwork.<\/p>\n<p style=\"margin-bottom: 3%;\">She argued that every organization should establish similar governance frameworks to minimize operational and legal risk.<\/p>\n<p style=\"text-align: center; color: #0e101a; font-size: 18pt;\"><span style=\"font-weight: bold;\">Conclusion<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">In conclusion, the speakers suggested how AI can be deployed, such as in documentation processes. Ms. Powell stated that practitioners should focus on the few things that they could apply AI to on a large scale. <span style=\"font-weight: bold; font-style: italic;\">&#8220;Concentrate on the things that are going to make the biggest difference to your business or to your clients. &#8221;<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">She added that practitioners must learn from their AI use and document the process, i.e., assess the methodologies, lessons learned, successes, failures, process improvements, etc. She remarked that this would create valuable institutional knowledge that can be shared throughout organizations and continuously refined.<\/p>\n<p style=\"margin-bottom: 3%;\">Responding to an audience question, the panel acknowledged that younger legal professionals face a unique challenge. Growing up alongside AI may make them highly proficient in technology.
