Upon reappreciating the evidence on record, the Court found the testimony of the survivor (PW 1) to be wholly reliable and sufficiently supported by the surrounding circumstances and the evidence of other prosecution witnesses. According to the prosecution, on 25 August 2020, a nine-year-old student of the Madrassa visited the accused&#8217;s room to seek clarification regarding an online examination. The Court further found no merit in the defence argument that the prosecution was motivated by sectarian differences within the Muslim community, noting that no convincing evidence had been produced in support of such a claim.<\/p>\n<p style=\"margin-bottom: 3%;\">Accordingly, the Court concluded that the prosecution had proved beyond reasonable doubt that the accused committed the offences punishable under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561707\" target=\"_blank\">377<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">Penal Code<\/a>, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550527\" target=\"_blank\">5(<span style=\"font-style: italic;\">f<\/span>) and (<span style=\"font-style: italic;\">m<\/span>)<\/a> read with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550528\" target=\"_blank\">6(1)<\/a>, and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550531\" target=\"_blank\">9(<span style=\"font-style: italic;\">m<\/span>) and (<span style=\"font-style: italic;\">o<\/span>)<\/a> read with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550487\" target=\"_blank\">10<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO<\/a>, as well as Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001520228\" target=\"_blank\">75<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806282\" target=\"_blank\">JJ Act<\/a>.
