{"id":387644,"date":"2026-06-19T10:00:07","date_gmt":"2026-06-19T04:30:07","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=387644"},"modified":"2026-06-19T09:58:58","modified_gmt":"2026-06-19T04:28:58","slug":"sc-upholds-fresh-tnpsc-motor-vehicle-inspector-recruitment-process","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/06\/19\/sc-upholds-fresh-tnpsc-motor-vehicle-inspector-recruitment-process\/","title":{"rendered":"Administrative Delays in Workshop Renewals Can\u2019t Prejudice Eligible Candidates: SC Upholds Fresh TNPSC Motor Vehicle Inspector Recruitment Process"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Supreme Court:<\/span> In a batch of civil appeals, arising out of a prolonged Tamil Nadu Public Service Commission (TNPSC) motor vehicle inspector recruitment dispute, challenging the legality of the directions issued by the Madras High Court by judgment dated 22 December 2023, the Division Bench of J.K. Maheshwari and Justice <span style=\"font-weight: bold;\">Atul S. Chandurkar*<\/span>, JJ., upheld the impugned directions, holding that these direction provided a level playing field to all the candidates so that they are placed at par with each other and a wider competition amongst eligible candidates.<\/p>\n<p>The Court held that:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>Candidates whose workshop experience became valid after retrospective approval of workshops must be considered in the recruitment process.<\/p>\n<\/li>\n<li>\n<p>The State Government&#8217;s exercise regarding retrospective renewal of workshop approvals was justified and necessary.<\/p>\n<\/li>\n<li>\n<p>Candidates included in the revised list of 226 candidates acquired no vested right and must participate in the fresh selection process.<\/p>\n<\/li>\n<li>\n<p>Certificates issued by Heads of Institutions were sufficient for claiming Persons Studied in Tamil Medium (PSTM) benefits where the recruitment notification prescribed no further requirement.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Marks of candidates outside the zone of consideration could be disclosed individually in public interest, though answer sheets need not be furnished.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/06\/16\/procedural-irregularity-final-appointment-process-fair-recruitment-haryana-cooperative-society\/\" target=\"_blank\"><span class=\"Hyperlink\"><span style=\"color: #0000ff;\">Procedural irregularity in final appointment process cannot invalidate fair recruitment: SC directs Haryana Cooperative Society to reconsider employees&#8217; appointments<\/span><\/span><\/a><\/p>\n<h3>Factual Matrix<\/h3>\n<p style=\"margin-bottom: 3%;\">The TNPSC issued Notification No. 3 of2018 on 14 February 2018 inviting applications for direct recruitment to 113 posts of Motor Vehicle Inspector Grade II. The selection process consisted of 3 stages: A written examination, verification of certificates and documents, and an oral interview.<\/p>\n<p style=\"margin-bottom: 3%;\">A total of 2176 applications were received. After preliminary scrutiny, 1328 candidates were permitted to appear in the written examination. 33 candidates qualified in the written examination and their names were published on 15 July 2019. 1 candidate subsequently declined participation, resulting in a list of 32 candidates who were provisionally selected and issued appointment orders on 4 November 2019.<\/p>\n<p style=\"margin-bottom: 3%;\">The selection of these 32 candidates was challenged before the Madras High Court. By judgment dated 24 January 2020, the Single Judge set aside the appointments and directed fresh verification of workshop experience certificates of all 1328 candidates. The Court clarified that the required one-year experience would be deemed satisfied if a candidate had worked for at least 240 days during the relevant year. Consequently, the earlier list of 32 candidates ceased to exist.<\/p>\n<p style=\"margin-bottom: 3%;\">The Division Bench, while partly allowing appeals against the Single Judge&#8217;s decision, upheld almost all directions and ordered fresh verification of workshop experience, driving licence validity and driving experience. It directed preparation of a list in the ratio of 1:2 for oral interview. The challenge to that order before the Supreme Court was dismissed on 19 January 2021.<\/p>\n<p style=\"margin-bottom: 3%;\">Pursuant thereto, TNPSC published a fresh list of 226 candidates on 28 April 2021 for oral examination. Their principal contention was that they satisfied the experience requirements under Clause 6(B) of the recruitment notification.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the exercise directed in para 88(<span style=\"font-style: italic;\">a<\/span>) of the High Court judgment had already been carried out before the Supreme Court stayed further operation of the impugned judgment. The reverification report had been submitted to TNPSC on 10 April 2024 and remained unchallenged.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that once the competent authority had verified and reverified the workshop experience certificates and confirmed that each appellant possessed more than 1 year of valid experience, those candidates became entitled to consideration for inclusion in the select list to be prepared under para 88(<span style=\"font-style: italic;\">b<\/span>) of the High Court judgment.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court clarified that the appellants would not secure automatic appointment. Rather, they would compete with all other eligible candidates and be considered according to merit. Considering that more than 6 years had elapsed since initiation of the recruitment process, the Court directed the TNPSC to complete the process expeditiously in accordance with the timeline fixed by the High Court.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court disposed of the appeals with a direction that the appellants be considered in the recruitment process along with all other eligible candidates.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/02\/03\/del-hc-error-in-recruitment-notice-doesnt-create-vested-rights\/\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #0000ff;\">Error in recruitment notice does not create vested right to appointment on candidate: Delhi High Court<\/span><\/a><\/p>\n<p style=\"font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Appeals by Candidates Included in the List of 226 Candidates<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the candidates whose names appeared in the revised list dated 28 April 2021 contended that the Division Bench had erred in directing a fresh exercise. They argued that they had already undergone verification and oral tests and that reopening the issue of retrospective workshop approvals would nullify the progress made in the recruitment process. Reliance was placed on several precedents dealing with recruitment and selection.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court examined the reasoning adopted by the Division Bench and found that the Division Bench had correctly noted the absence of any consistent policy governing retrospective approvals of workshops. Prior to 2012&#8212;2013, approvals had often been granted retrospectively. Subsequently, no policy decision was placed on record showing that retrospective approvals had been prohibited. Decisions regarding retrospective approval were being taken on a discretionary basis by the Director, resulting in arbitrariness and discrimination. The Division Bench had also found that many workshops continued to be treated as approved establishments, performed repairs on government vehicles, and remained functional even while their renewal applications were pending. Candidates who obtained experience in such workshops had no control over administrative delays in processing renewal applications.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court agreed with the Division Bench&#8217;s reasoning and observed that the directions issued by the Division Bench ensured a level playing field for all candidates and expanded the pool of eligible and meritorious candidates, thereby serving public interest. Placement in the revised list of 226 candidates did not confer any vested right to appointment. Since those candidates were also permitted to participate in the fresh process, no prejudice warranting interference was demonstrated. Consequently, the Court upheld the Division Bench&#8217;s directions concerning retrospective renewal and fresh consideration of candidates.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/01\/05\/all-hc-on-assistant-teachers-termination-over-entering-higher-marks\/\" target=\"_blank\"><span class=\"Hyperlink\"><span style=\"color: #0000ff;\">Deliberate Entering of higher marks in recruitment forms cannot be regularised under guise of &#8220;human error&#8221;: Allahabad High Court<\/span><\/span><\/a><\/p>\n<p style=\"font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Appeals by TNPSC<\/p>\n<p>The Court noted that the TNPSC challenged 2 directions issued by the Division Bench:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>Recognition of candidates under the PSTM quota based on certificates issued by educational institutions.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Disclosure of marks obtained by candidates who were outside the zone of consideration.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\">The Court noted that the recruitment notification did not prescribe any additional requirement beyond production of certificates issued by the Head of the Institution. The Single Judge had already held that such certificates were sufficient proof for PSTM eligibility. The Division Bench affirmed that conclusion.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court agreed with both courts and held that when the notification itself did not require any certification from the Directorate of Technical Education, TNPSC could not insist on such an additional condition. The fact that candidates had undertaken their education and examinations in Tamil medium supported their eligibility.<\/p>\n<p style=\"margin-bottom: 3%;\">With regards to disclosure of marks, the Court noted that the Division Bench had considered the prolonged litigation affecting the recruitment process for more than 5 years. Since marks of certain candidates had already been disclosed, the Division Bench found it to be in public interest that marks of the remaining candidates also be communicated individually. Importantly, the Division Bench had clarified that disclosure of marks would not entitle candidates to copies of answer scripts.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that the precedent relied upon by TNPSC, <span style=\"font-style: italic;\">Joint Directors and Central Public Information Officer<\/span> v. <span style=\"font-style: italic;\">T.R. Rajesh<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002851558\" target=\"_blank\">(2018) 4 SCC 530<\/a>, itself recognised the Court&#8217;s power to direct disclosure where public interest so required. Considering the prolonged controversy and the need to bring finality to disputes, the direction was justified.
