Justice Surya Kant:<\/h3>\n<p style=\"margin-bottom: 3%;\">Regarding the expansion of the scope of mediation to cross-border disputes, <span style=\"font-weight: bold;\">Justice Surya Kant<\/span> strongly agreed. He substantiated his answer by stating that Section 2 of the Mediation Act expressly recognizes international mediation and Section 13 permits online mediation even for cross-border disputes. He explained that the reason for such promotion was the preservation of commercial relationships, which are crucial when they are between two governments.<\/p>\n<p style=\"margin-bottom: 3%;\">Justice Kant also explained that the different arbitration frameworks of different jurisdictions created difficulties for dispute resolution, such as non-enforcement of an award. Thus, cross-border mediation was a solution to these issues. It is a mutual settlement that preserves commercial relationships, increases investor confidence, and provides quicker and more practical solutions than prolonged arbitration proceedings.<\/p>\n<h3>B. Lord Nicholas Archibald Hamblen:<\/h3>\n<p style=\"margin-bottom: 3%;\">Adding to the discussion, <span style=\"font-weight: bold;\">Lord Hamblen<\/span> turned the discussion towards the future of international commercial mediation by highlighting the significance of the Singapore Convention on Mediation, 2018 (the Singapore Convention), which both India and the United Kingdom have signed and are in the process of implementing.<\/p>\n<p style=\"margin-bottom: 3%;\">He explained that the Convention was conceived to provide mediation settlements with an enforcement mechanism comparable to that enjoyed by arbitral awards under the New York Convention. By allowing mediated settlement agreements to be directly enforced in contracting states, the Singapore Convention aims to encourage businesses to choose mediation over lengthy litigation and arbitration.<\/p>\n<p>According to Lord Hamblen, the intention of the Singapore Convention was to promote the greater use of mediation, thereby increasing international trade, maintaining commercial relationships, whilst reducing costs to the states involved. It will:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Aid the growth of international commercial mediation centres.<\/p>\n<\/li>\n<li>\n<p>Improve the quality of international mediation practices.<\/p>\n<\/li>\n<li>\n<p>Strengthen mediator training programmes.<\/p>\n<\/li>\n<li>\n<p>Encourage greater judicial support for mediation.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Reduce the burden on national courts and international arbitration institutions.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">He also noted that the United Kingdom was currently examining an appropriate registration mechanism for enforcement while considering the necessary level of judicial oversight.<\/p>\n<h3>C. Ms. Kirsty Brimelow KC:<\/h3>\n<p style=\"margin-bottom: 3%;\">Taking the discussion further, <span style=\"font-weight: bold;\">Ms. Brimelow drew<\/span> upon her extraordinary experience as a mediator during Colombia&#8217;s peace process. She recalled participating in conflict resolution efforts following more than five decades of internal civil conflict. Acting as mediator between the Colombian government and the San Jos&eacute; de Apartad&oacute; farming community, she helped facilitate a historic public apology delivered by then-President Juan Manuel Santos in 2013. She explained that the mediation was never primarily about compensation but about restoring dignity and recognition to victims who had been wrongly stigmatized as terrorists.<\/p>\n<p style=\"margin-bottom: 3%;\">Reflecting on that experience, she emphasized that mediation often uncovers deeper human concerns hidden beneath legal or financial disputes.<\/p>\n<p>She observed:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Many disputes appearing to concern money are about trust, dignity, or acknowledgment.<\/p>\n<\/li>\n<li>\n<p>Neutral international mediators can build confidence where domestic institutions suffer from trust deficits.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Cross-border mediation provides an additional safeguard by ensuring independence and confidentiality.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">She also highlighted mediation&#8217;s growing importance in international family law matters, particularly child abduction cases, where negotiated settlements often prove more effective than rigid legal proceedings.<\/p>\n<h3>D. Mr. Brett Dixon:<\/h3>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Mr. Dixon<\/span> reinforced the importance of ratifying the Singapore Convention while focusing on mediation&#8217;s practical advantages for clients engaged in cross-border transactions. He identified flexibility as mediation&#8217;s greatest strength, noting that parties can resolve selected issues without necessarily settling every aspect of a dispute. This incremental approach allows negotiations to continue while preserving valuable business relationships.<\/p>\n<p style=\"margin-bottom: 3%;\">He also stressed the significance of confidentiality, which enables parties to negotiate openly without fear that discussions will later become part of public court proceedings.<\/p>\n<p style=\"margin-bottom: 3%;\">According to Mr. Dixon, modern legal practice increasingly requires lawyers to advise clients on selecting the most appropriate dispute resolution mechanism from a broad spectrum that includes litigation, arbitration, and mediation.<\/p>\n<p style=\"text-align: center; font-weight: bold; font-size: 16pt;\">Use of Technology in Streamlining Mediation<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/06\/14_indian-high-comm-londn-mediation-event-panel-2.png\" alt=\"\" width=\"650\" height=\"450\"\/><\/p>\n<h3>A. Justice Surya Kant:<\/h3>\n<p>At the outset, Justice Surya Kant remarked, <span style=\"font-weight: bold; font-style: italic;\">&#8220;Technology is actually revolutionising the mediation.&#8221;<\/span> He explained that technology has overcome three major barriers to justice in India, i.e., social, economic, and geographical.<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p><span style=\"font-weight: bold;\">Geographical Benefits:<\/span> He explained that online mediation has enabled parties from distant locations to participate without incurring substantial travel costs or delays. It had liberated the process from the conventional burdens.<\/p>\n<p>He highlighted that when he assumed responsibility for mediation initiatives within the Supreme Court, only six dedicated mediation rooms existed. Recognizing increasing demand, these facilities were expanded from 6 to 12, with 18 technologically equipped mediation rooms expected to become operational shortly. Each room was designed to facilitate secure online mediation proceedings.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Data Analytics:<\/span> Another advantage of technology, according to Justice Kant, was data-driven systems, which aided in identifying cases suitable for mediation. By analysing litigation history, the nature of disputes, and multiple proceedings between parties, data analytics could identify foundational conflicts and assist mediators in developing customized settlement approaches.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Grassroots Justice:<\/span> He explained how the nationwide &#8220;Mediation for Nation&#8221; campaign successfully reached district, subdivision, and village levels through hybrid technological models. Judicial officers and paralegal volunteers worked alongside mediators using digital platforms while translating local languages and facilitating communication with parties in remote areas.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Confidentiality Safeguards:<\/span> Justice Surya Kant emphasized that the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001624318\" target=\"_blank\">Mediation Act, 2023<\/a>, contains robust statutory protections ensuring confidentiality. This includes a prohibition on using mediation discussions in further litigation, statutory penalties for violations, and a complete prohibition on audio and video recording of mediation proceedings.<\/span><\/p>\n<\/li>\n<\/ol>\n<h3>B. Lord Nicholas Archibald Hamblen:<\/h3>\n<p style=\"margin-bottom: 3%;\"><span style=\"color: #0e101a;\">Speaking from the UK perspective, Lord Hamblen<\/span> reflected on how the COVID-19 pandemic accelerated the adoption of remote hearings and online mediation. He observed that remote mediation has remained popular even after the pandemic, with approximately 38 percent of commercial mediations in 2024 being conducted virtually.<\/p>\n<p style=\"margin-bottom: 3%;\">He acknowledged several advantages, such as reduced costs, significant time savings, greater convenience, and easier participation for international parties. However, he also cautioned against excessive reliance on technology. According to Lord Hamblen, remote mediation cannot fully replicate non-verbal communication, interpersonal trust-building, spontaneous interaction, and sustained participant engagement.<\/p>\n<p style=\"margin-bottom: 3%;\">While technology is an invaluable facilitator, he argued that in-person mediation remains the ideal environment for resolving complex disputes requiring nuanced negotiation.<\/p>\n<h3>C. Ms. Kirsty Brimelow KC:<\/h3>\n<p style=\"margin-bottom: 3%;\">Ms. Brimelow highlighted the adaptability of barristers to technological innovation, particularly in relation to small claims mediation. She discussed the Civil Mediation Council&#8217;s fixed-fee model and online dispute resolution platforms designed to provide affordable public access to justice. She argued that digital mediation can significantly reduce delays and increase efficiency, especially for lower-value disputes that would otherwise burden traditional courts.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;This is about public access, dispute resolution for the public. Often, the court system, the traditional court system, including mediation, can be very cumbersome and too slow.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">At the same time, she reiterated the value of physical presence in complex mediations. Being in the same room, she suggested, often transforms perceptions and helps parties recognize one another as individuals rather than adversaries.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Despite the ability to use the technology, there still is that aspect of that feeling that people have when they are suddenly in the same room, that that person perhaps is not quite the way they envisaged them in their head. When they are sat opposite them, or around a round table, of course, rather than directly opposite.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">She also underscored the practical necessity of reliable internet infrastructure for uninterrupted connectivity and simultaneous transcription technologies for improving international mediations.<\/p>\n<h3>D. Mr. Brett Dixon:<\/h3>\n<p style=\"margin-bottom: 3%;\">Drawing on his experience representing vulnerable clients who lacked digital literacy, Mr. Dixon emphasized that technology-driven mediation must remain accessible to everyone. He argued that vulnerability should be assessed not by labels but by whether an individual can fully participate in proceedings. Digital disadvantage, he explained, may arise from limited internet access, inadequate devices, restricted data availability, or lack of digital literacy.<\/p>\n<p style=\"margin-bottom: 3%;\">Regarding the use of AI, he warned of emerging AI-related challenges, such as hallucinated legal authorities and prompt injection attacks.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;If we approach the advent of AI both as a risk and an opportunity, then it gives us a metric to measure how that might work. It is a tool that is used by humans, that&#8217;s us, in case any of us have missed what we actually do in this world, and we are the people who deliver solutions to human problems.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">He explained that in the Online Procedure Rule Committee, the Law Society was trying to identify the best solutions for issues in dispute resolution. Solutions were given by lawyers who provide unique safeguards through professional ethics, confidentiality obligations, legal privilege, and insurance-backed accountability.<\/p>\n<p style=\"margin-bottom: 3%;\">He cautioned that clients themselves may unknowingly compromise confidentiality by uploading sensitive information to public AI platforms before seeking legal advice.<\/p>\n<p style=\"text-align: center; font-weight: bold; font-size: 16pt;\">AI in Mediation<\/p>\n<h3>A. Chief Justice of India Surya Kant<\/h3>\n<p style=\"margin-bottom: 3%;\">Justice Kant observed that AI has already begun playing a significant role in mediation by supporting various procedural and administrative functions. According to him, AI is an advanced evolution of technologies that have long assisted dispute resolution mechanisms.<\/p>\n<p>He identified several practical applications:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Management of virtual mediation platforms.<\/p>\n<\/li>\n<li>\n<p>Compilation and organization of case data.<\/p>\n<\/li>\n<li>\n<p>Structuring questions and issues arising between disputing parties.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Assisting mediators in identifying the core issues requiring resolution.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">He noted that these tasks were increasingly likely to be handled through AI-powered technologies. However, he cautioned against the growing misconception that AI could substitute the role of mediators.<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Mediation involves a lot of pure human exercise. And human exercise is that exercise coming out of both the brain and the heart. You have to apply your mind, you have to use your heart, and then only you can really be a successful mediator, besides knowing the art of mediation.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the role of a mediator cannot be substituted or replaced by an AI-based platform.<\/p>\n<h3>Data Privacy:<\/h3>\n<p style=\"margin-bottom: 3%;\">Highlighting data privacy as an issue, Justice Kant explained that judicial records contain highly sensitive information entrusted to courts and mediation institutions. Allowing unrestricted AI access to such data could risk misuse and compromise the confidentiality of the data that belongs to litigants who trusted the judicial platform.<\/p>\n<p style=\"margin-bottom: 3%;\">Prediction of Outcomes:<\/p>\n<p>He raised significant concerns about AI&#8217;s ability to predict mediation outcomes. He distinguished between:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Predicting litigation risks that may encourage parties to consider mediation, and<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Predicting mediation success, which attempts to model human behaviour and emotional responses.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">He warned that allowing AI to predict mediation success would infringe upon privacy and undermine the voluntary and human-centric nature of mediation.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/06\/14_indian-high-comm-londn-mediation-event-panel-3.png\" alt=\"\" width=\"650\" height=\"450\"\/><\/p>\n<h3>B. Lord Nicholas Archibald Hamblen:<\/h3>\n<p style=\"margin-bottom: 3%;\">At the outset, Lord Hamblen referred to guidelines issued by the International Bar Association (IBA), outlining several legitimate applications of AI in mediation. Some examples of generic applications were information summarization and analysis, legal research, improving communication between parties, language interpretation, and wider training. In terms of mediation, it could be used for generating dispute timelines, evaluating negotiation positions of parties, suggesting targeted questions, and generating settlement options or suggestions.<\/p>\n<p style=\"margin-bottom: 3%;\">Despite acknowledging AI&#8217;s benefits, he agreed with Justice Kant that AI was merely a tool, and it could never replace a mediator. He remarked that the human elements, like trust and emotional intelligence in mediation, were very important. These qualities, he argued, could not be replicated by machines.<\/p>\n<h3>C. Ms. Kirsty Brimelow KC:<\/h3>\n<p style=\"margin-bottom: 3%;\">Further agreeing with Justice Kant that AI was not human, Ms. Brimelow referred to a widely discussed incident involving a New York attorney who unknowingly cited six fictitious cases generated by AI. The attorney repeatedly questioned the AI about the authenticity of the cases, and ChatGPT reaffirmed that the authorities existed within legal databases. This example illustrated the phenomenon known as &#8220;AI hallucination,&#8221; demonstrating the dangers of treating AI outputs as authoritative legal advice.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">She proposed that rather than replacing negotiators, AI could help in reframing harsh demands or language tone.<\/p>\n<p style=\"margin-bottom: 3%;\">In terms of commercial litigation, some law firms now anticipate disclosure obligations extending to AI prompts used during case preparation, such as asking how a client&#8217;s weak case could be strengthened. The concerns about revealing such prompts were already encouraging parties to settle disputes earlier.<\/p>\n<p style=\"margin-bottom: 3%;\">Accordingly, she suggested that professionals should exercise caution and transparency while using AI-generated assistance.<\/p>\n<h3>D. Mr. Brett Dixon:<\/h3>\n<p style=\"margin-bottom: 3%;\">Mr. Dixon reflected on his experience of using AI to summarise the IBA guidelines and identify broad issues, which demonstrated its effectiveness in narrowing complex issues quickly. However, he emphasized that AI is merely a tool, while mediators remain the conductors directing the entire process.<\/p>\n<p style=\"margin-bottom: 3%;\">Reflecting on India&#8217;s context, he discussed one of mediation&#8217;s biggest challenges: scale. Drawing from experiences in England and Wales, he explained that large volumes of disputes often exceed the available number of trained mediators.<\/p>\n<p style=\"margin-bottom: 3%;\">He mentioned that while England and Wales primarily operate in English and Welsh, India functions across numerous languages. For multilingual India, AI could be used for productivity improvements to scale mediation benefits, such as multilingual mediation. He suggested that advancing AI language models could make global collaboration, including partnerships between India and the United Kingdom, even more effective.<\/p>\n<p style=\"text-align: center; font-weight: bold; font-size: 16pt;\">Conclusion<\/p>\n<p style=\"margin-bottom: 3%;\">Chief Justice Surya Kant concluded the discussion by informing the audience that an AI Committee had been constituted to develop a comprehensive framework for the responsible use of AI throughout the judicial system. He announced that the committee had recently <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/06\/05\/sc-issues-draft-ai-regulations-for-courts\/\" target=\"_blank\">published draft AI regulations<\/a> on the Supreme Court website on 2 June, which also applied to mediation, both domestic and cross-border.<\/p>\n<p>Thus, the event concluded with these insightful contributions made by each panelist.<\/p>\n<p style=\"margin-bottom: 3%;\">The panel unanimously endorsed mediation as the future of commercial dispute resolution, particularly when supported by technological innovation. Indian and UK legal professionals emphasized that artificial intelligence, online platforms, secure digital infrastructure, and data-driven tools will enhance accessibility and efficiency without replacing the human judgment essential to successful mediation. The discussions also reflected a shared vision of mediation as the preferred mechanism for domestic and cross-border disputes, capable of preserving commercial relationships and reducing litigation
