Allahabad High Court:<\/span> In a bail application filed by the President of Ittefaq Minnat Council who allegedly gave the call for the crowd to assemble and cause violence in the Bareilly Violence case, the Single Judge Bench of Arun Kumar Singh Deshwal, J.<\/span>, rejected the application, holding that there was a significant risk that, if released, he may once again incite a particular community and disturb peace and harmony.<\/p>\n

Background<\/h3>\n

On 26 September 2025, violence erupted in Bareilly when a peaceful congregation turned into a mob of around 200-250 people who damaged property and attacked the police. This came to be known as the “I love Mohammed” controversy or the Bareilly Violence case.<\/p>\n

In the present case, the accused was the President of Ittefaq Minnat Council. He had allegedly given a call in a public meeting on 19 May 2025, persuading the members of the Muslim community to assemble in the field of Islamia Inter College for the protest against the atrocities being faced by them as well as the lodging of false cases against the Muslim community by the State Government.<\/p>\n

Thus, he was arrested under Sections 190<\/a>, 191(2)<\/a>, 191(3)<\/a>, 124(2)<\/a>, 121<\/a>, 125<\/a>, 352<\/a>, 351(3)<\/a>, 109<\/a>, 299<\/a>, 223<\/a> and 61(2)<\/a>, Nyaya Sanhita, 2023<\/a> (BNS), and Section 7 C.L.A. Act. Aggrieved, he filed the present bail application.<\/p>\n

The accused contended that he was not named in the FIR and was implicated despite there being no substantive material indicating that he persuaded or provoked the crowd to assemble at Islamia Inter College, commit arson, or destroy public property. He further submitted that a viral video demonstrates the applicant did not incite any member of the Muslim community.<\/p>\n

The State contended that an eyewitness stated that he had participated in the aforesaid public meeting wherein the accused provoked the people that the government is committing atrocities upon the Muslim community, therefore, they should openly demonstrate and assemble at Islamia Inter College on 26 September. If required, they should also commit arson and destroy public property, and if anyone stops them, they should attack them. It was further submitted that after the Bareilly violence, the accused circulated a thank you speech through a video clip, wherein he expressed his thanks to the members of the Muslim community for destroying public property and successfully conducting the demonstration.<\/p>\n

Analysis<\/h3>\n

Considering the facts, circumstances, and records of the case, the Court noted that, undisputedly, the accused had persuaded several youths of the Muslim community in a public meeting held on 19 September to assemble at Islamia Inter College for atrocities being faced by them and for submitting a memorandum to the District Magistrate. The Court further noted that the crowd, while proceeding towards Islamia Inter College, despite the invocation of Section 163<\/a>, Nagarik Suraksha Sanhita, 2023<\/a>, was stopped by the police. Then the crowd became involved in arson and started pelting stones, throwing petrol bombs, and destroying public property, including causing injuries to several police personnel.<\/p>\n

The Court noted that the statement of the eyewitness and the video clip also show that the accused was the main person who persuaded these people through provocative speech to assemble at Islamia Inter College. He was aware that a highly emotional and volatile crowd incited by him in the name of Prophet Mohammad may resort to arson, rioting, and attack police personnel and damage public property.<\/span> Therefore, the accused was liable for the offence committed by the crowd and for being the main conspirator under various sections of the BNS. Thus, the Court held that the accused could not be absolved of his liability for such illegal acts.<\/p>\n

The Court referred to Rihan<\/span> v. State of U.P.<\/span>, 2025 SCC OnLine All 8089<\/a>, wherein the Court observed that destroying public property, attacking the police party and raising slogans like “gustakh-e-nabi ki ek saja, sar tan se juda, sar tan se juda”<\/span> will amount to threatening the authority of law as well as the sovereignty and integrity of India, as the same incites the people for arm rebellion, therefore, this act not only will be punishable under Section 152<\/a> BNS<\/a> but also against the basic tenets of Islam.<\/span><\/p>\n

Furthermore, the Court referred to the State of Punjab<\/span> v. Balraj Singh<\/span>1<\/sup><\/a>, wherein the Supreme Court observed that a person’s personal liberty cannot prevail over the sovereignty and integrity of India.<\/p>\n

The Court remarked that “communal harmony forms the bedrock of a democratic nation such as India. Permitting individuals like the accused to incite divisions on religious grounds for political gain threatens to unravel the social fabric of the country and poses a serious risk to national integrity.”<\/span><\/p>\n

In the present case, the applicant persuaded the crowd on 2 occasions, one at the house of another person and second, at Beg Marriage Hall, to assemble and proceed towards Islamia Inter College at any cost.<\/p>\n

Considering his extensive criminal history in similar cases, the Court held that there was a significant risk that, if released, he may once again incite a particular community and disturb peace and harmony. Therefore, the Court rejected the bail application.<\/p>\n
