{"id":386658,"date":"2026-06-09T18:00:58","date_gmt":"2026-06-09T12:30:58","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=386658"},"modified":"2026-06-09T17:47:10","modified_gmt":"2026-06-09T12:17:10","slug":"delhi-high-court-art-act-age-limit-ivf-continuation-cryopreserved-embryos-fet-50-year-old-woman","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/06\/09\/delhi-high-court-art-act-age-limit-ivf-continuation-cryopreserved-embryos-fet-50-year-old-woman\/","title":{"rendered":"Age limit under ART Act Applies to Initiation of Treatment, Not Continuation Through Cryopreserved Embryos: Delhi HC Permits 50-Year-Old Woman to Undergo Frozen Embryo Transfer"},"content":{"rendered":"<style>\n.animate-charcter{background-image: linear-gradient(-225deg, #231557 0%, #44107a 29%, #ff1361 67%, #fff800 100%); background-size: 200% auto; -webkit-background-clip: text; -webkit-text-fill-color: transparent; animation: textclip 0s linear infinite;}\n@keyframes textclip {to {background-position: 200% center;}}\n<\/style>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> In a writ petition filed seeking directions permitting the petitioners to undergo frozen embryo transfer (FET Procedure) of their remaining 5 cryopreserved embryos at Cloudnine Hospital, Dwarka, under the provisions of the Assisted Reproductive Technology Regulation Act, 2021 (ART Act), the Single Judge Bench of Purushaindra Kumar Kaurav, J. held that the denial of permission solely on the ground that the petitioners had marginally crossed the statutory age threshold after the commencement of the ART process would not advance the object and purpose of the ART Act.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the petitioners were within the prescribed age-limits when the embryos were created and cryopreserved and that the case concerned the continuation of an already initiated reproductive process rather than the commencement of a fresh ART cycle. Emphasising the constitutional protection afforded to reproductive autonomy and decisional privacy under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>, the Court adopted a purposive interpretation of the ART Act and held that the remaining cryopreserved embryos could not be denied utilisation merely because the petitioners had subsequently crossed the statutory age-limit.<\/p>\n<p style=\"margin-bottom: 3%;\">Accordingly, the writ petition was allowed, and the petitioners were permitted to undergo frozen embryo transfer of their remaining 5 cryopreserved embryos, subject to all necessary medical safeguards.<\/p>\n<h3>Facts<\/h3>\n<p style=\"margin-bottom: 3%;\">The petitioners, a married couple, suffered the tragic loss of their son on 10 May 2025. Thereafter, with the intention of having another child, they approached Cloudnine Hospital, Dwarka, to undergo -in vitro fertilisation (IVF) treatment under the provisions of the ART Act, 2021. At the time of commencement of the treatment, both petitioners satisfied the age eligibility criteria prescribed under Section 21(<span style=\"font-style: italic;\">g<\/span>) of the Act. Following medical evaluation, counselling, and execution of the requisite consent forms, 6 embryos were successfully created and cryopreserved on 7 March 2026. Subsequently, 1 embryo was transferred through a FET procedure; however, the attempt was unsuccessful, as the Beta-HCG test returned negative. Consequently, 5 cryopreserved embryos remained preserved with the hospital. When the petitioners sought to undergo a further FET procedure using the remaining embryos, the hospital declined their request on the ground that Petitioner 1 (the wife) had, in the meantime, crossed the upper age-limit of 50 years prescribed under Section 21(<span style=\"font-style: italic;\">g<\/span>), ART Act. Aggrieved by the refusal to permit the utilisation of the remaining cryopreserved embryos, the petitioners approached the High Court seeking appropriate directions to allow them to proceed with the FET procedure.<\/p>\n<h3>Issue<\/h3>\n<p style=\"margin-bottom: 3%;\">Whether the age restriction prescribed under Section 21(<span style=\"font-style: italic;\">g<\/span>), ART Act can be construed in a manner so as to prevent the <span style=\"font-style: italic;\">continuation<\/span>, as opposed to the <span style=\"font-style: italic;\">initiation<\/span>, of an ART process beyond the age-limit prescribed under Section 21(<span style=\"font-style: italic;\">g<\/span>), ART Act.<\/p>\n<h3>Analysis and Decision<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court observed that a plain reading of Section 21(<span style=\"font-style: italic;\">g<\/span>), ART Act, 2021, demonstrates that the provision prescribes age eligibility criteria separately for men and women seeking ART services. Under the provision, ART services may be provided to a woman above 21 years and below 50 years of age and to a man above 21 years and below 55 years of age.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further noted that the ART Act is a beneficial regulatory legislation enacted to ensure safe, ethical, and regulated assisted reproductive technology practices. While acknowledging that the statutory age restrictions are founded upon legitimate concerns relating to maternal health and child welfare, the Court emphasised that the interpretation of such regulatory provisions must remain consistent with the constitutional guarantees enshrined under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>. Accordingly, any interpretation of the Act must balance the legislative objective of regulating ART procedures with the protection of reproductive rights, decisional autonomy, privacy, and personal liberty of individuals seeking to avail such services.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court emphasised that a clear distinction must be drawn between the initiation of a fresh ART cycle after an individual has crossed the statutory age-limit and the continuation of an already commenced treatment involving pre-existing cryopreserved embryos. While the former would amount to the commencement of a new ART procedure and would therefore be subject to the eligibility requirements prescribed under Section 21(<span style=\"font-style: italic;\">g<\/span>), ART Act, the latter constitutes merely the continuation of a treatment process that was lawfully initiated when the parties satisfied the statutory age criteria. Consequently, the utilisation of embryos that were created and cryopreserved during the period of eligibility cannot be equated with the initiation of a fresh ART cycle after crossing the prescribed age threshold. The Court held that continuation of an already initiated reproductive process is fundamentally different from commencement of a new ART procedure.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court emphasised that the petitioners were not seeking a fresh IVF cycle after crossing the age-limit. Instead, they sought only to use embryos that had already been retrieved, fertilised, created, and cryopreserved while they were fully eligible under the statute.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that cryopreserved embryos are not merely biological material but are intimately connected with reproductive autonomy, decisional privacy, family life, and personal liberty.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court relied upon <span style=\"font-style: italic;\">Suchita Srivastava<\/span> v. <span style=\"font-style: italic;\">State (UT of Chandigarh)<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000043693\" target=\"_blank\">(2009) 9 SCC 1<\/a> and <span style=\"font-style: italic;\">K.S. Puttaswamy<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002748027\" target=\"_blank\">(2017) 10 SCC 1<\/a>, wherein the Supreme Court recognised reproductive choice, decisional autonomy, and privacy in matters concerning procreation and family life as integral facets of the right to life and personal liberty guaranteed under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>. Drawing upon these constitutional principles, the Court held that statutory provisions regulating ART procedures must be interpreted purposively and in a manner that advances constitutional freedoms. While giving due regard to the regulatory objectives of the ART Act, such provisions should not be construed so rigidly as to defeat an individual&#8217;s reproductive autonomy and constitutionally protected choice to pursue parenthood.<\/p>\n<p style=\"margin-bottom: 3%;\">Referring to the decision in <span style=\"font-style: italic;\">Sarbjit Kaur<\/span> v. <span style=\"font-style: italic;\">State of Punjab<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9003129190\" target=\"_blank\">2026 SCC OnLine P&amp;H 689<\/a>, the Court observed that the primary object of the ART Act is to regulate and supervise ART clinics and banks so as to ensure safe and ethical reproductive practices and prevent misuse of ART procedures. Consequently, the statutory framework should not be interpreted in a manner that defeats the very purpose of the legislation by imposing restrictions not expressly contemplated by the statute. The Court noted that the ART Act prescribes age criteria separately for a woman and a man under Section 21(<span style=\"font-style: italic;\">g<\/span>) and does not impose any joint or composite age restriction upon a &#8220;commissioning couple&#8221;.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also found support for this interpretation in the text of the statute itself. Section 21(<span style=\"font-style: italic;\">a<\/span>) requires a commissioning couple to satisfy the eligibility requirements at the stage when ART services are availed, while Section 2(<span style=\"font-style: italic;\">e<\/span>) defines a commissioning couple as a couple who &#8220;approach&#8221; an ART clinic for such services. Reading these provisions together, the Court held that the relevant point for assessing eligibility is when the couple approaches the clinic and initiates the ART process. Section 21(<span style=\"font-style: italic;\">h<\/span>), which requires issuance of a discharge certificate to the commissioning couple in respect of the ART procedure performed, further reinforces this interpretation. Accordingly, the statutory scheme supports a purposive construction whereby eligibility is determined at the commencement of treatment and not by importing additional restrictions at later stages of an already initiated reproductive process.<\/p>\n<p style=\"margin-bottom: 3%;\">Therefore, the Court adopted a purposive interpretation of the ART Act and said that Section 21(<span style=\"font-style: italic;\">g<\/span>) prescribes eligibility at the stage of availing ART services. The petitioners satisfied the age requirement when they approached the clinic and initiated treatment. The Act does not expressly prohibit transfer of embryos lawfully created before the age-limit was crossed. Thus, the age requirement should be assessed at the commencement of treatment rather than during every subsequent step of an already initiated process.<\/p>\n<p class=\"animate-charcter\" style=\"margin-left: 36pt; margin-bottom: 2%; font-style: italic;\">&#8220;This Court is also conscious of the fact that reproductive rights and access to parenthood in the contemporary constitutional jurisprudence cannot be reduced to purely technical or pedantic application of statutory conditions divorced from factual context in which such rights are asserted.&#8221;<\/p>\n<p class=\"animate-charcter\" style=\"margin-left: 36pt; margin-bottom: 3%; font-style: italic;\">&#8220;The ART Act is fundamentally regulatory in character. The object of the enactment is to ensure ethical and safe ART practices and not to create insurmountable barriers defeating legitimate continuation of treatment processes already lawfully undertaken.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held that Section 21(<span style=\"font-style: italic;\">g<\/span>), ART Act cannot be interpreted to prohibit the continuation of an ART process through transfer of cryopreserved embryos that were lawfully created while the parties were within the prescribed age-limits. The statutory age restriction applies primarily to the initiation of ART treatment and not to the utilisation of embryos already created during a validly commenced treatment process.<\/p>\n<p
