The discussion focused on the growing role of mediation in modern dispute resolution, contrasting developments in the United Kingdom and India while examining how businesses increasingly prioritise speed, cost efficiency, confidentiality and preservation of commercial relationships.<\/p>\n<p style=\"margin-bottom: 3%; text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2026\/06\/15-30_Mediation-or-Adjudication-UK-and-Indian-Practitioners-Debate-1.jpg\" alt=\"\" width=\"700\" height=\"400\"\/><\/p>\n<p style=\"margin-bottom: 3%;\">Moderated by <span style=\"font-weight: bold;\">Ms. Caroline Pounds KC<\/span> (Quadrant Chambers), the panel brought together <span style=\"font-weight: bold;\">Mr. Robert-Jan Temmink KC<\/span> (Quadrant Chambers), <span style=\"font-weight: bold;\">Mr. Marc Keidan<\/span> (Keidan Harrison LLP), <span style=\"font-weight: bold;\">Mr. Prashanto Chandra Sen<\/span>, Senior Advocate (India) and Associate Member, Quadrant Chambers, and <span style=\"font-weight: bold;\">Mr. Sidharth Sethi<\/span>, Advocate-on-Record, Supreme Court of India, and Disputes Partner at JSA Advocates &amp; Solicitors, to discuss the evolving role of mediation alongside arbitration and litigation in commercial dispute resolution.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Has Arbitration Lost Its Original Promise?<\/p>\n<p style=\"margin-bottom: 3%;\">Opening the discussion from a UK perspective, <span style=\"font-weight: bold;\">Mr. Robert-Jan Temmink KC<\/span> delivered a candid assessment of modern arbitration.<\/p>\n<p>As he observed:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Arbitration was designed as a faster and cheaper alternative to litigation but in my view it has largely ceased to be either.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Referring to International Chamber of Commerce (ICC) and London Court of International Arbitration (LCIA) statistics, Mr. Temmink noted that complex arbitrations frequently take between three and five years to conclude and often involve costs comparable to High Court litigation. According to him, arbitration increasingly resembles traditional litigation, with extensive pleadings, document production exercises and procedural applications becoming commonplace.<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Temmink also raised concerns regarding arbitrator quality and accountability, describing it as an underappreciated issue within the arbitration community. While recognising the English courts&#8217; longstanding policy of deference towards arbitration, he questioned whether parties are sometimes left without meaningful avenues to challenge flawed decisions.<\/p>\n<p style=\"margin-bottom: 3%;\">He further criticised the tendency to describe &#8220;international arbitration&#8221; as a distinct practice area, arguing that arbitration is merely a method of dispute resolution rather than a substantive field of law.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Litigation Still Offers Significant Advantages<\/p>\n<p style=\"margin-bottom: 3%;\">Turning to litigation, Mr. Temmink acknowledged that the English Commercial Court remains one of the world&#8217;s most respected forums for commercial dispute resolution.<\/p>\n<p style=\"margin-bottom: 3%;\">He noted that unlike arbitration, litigation provides parties with specialist judges appointed on merit, established appellate mechanisms and procedural consistency.<\/p>\n<p style=\"margin-bottom: 3%;\">However, he also recognised that court proceedings are not immune from delay, observing that substantial commercial disputes can still take eighteen months or more to reach trial.<\/p>\n<p style=\"margin-bottom: 3%;\">The discussion therefore shifted to whether mediation offers a more effective means of resolving commercial disputes.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Why Timing Is Critical in Mediation<\/p>\n<p style=\"margin-bottom: 3%;\">According to Mr. Temmink, mediation&#8217;s effectiveness often depends on when it takes place.<\/p>\n<p style=\"margin-bottom: 3%;\">He cautioned against mediation occurring too early in proceedings, before disclosure, witness statements and expert evidence have been exchanged.<\/p>\n<p>As he explained:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Mediation ordered too early, before disclosure, before witness statements and before expert reports, places the parties in an impossible epistemic position.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Without access to critical information, parties frequently overestimate the strengths of their own positions and underestimate the risks associated with litigation or arbitration.<\/p>\n<p style=\"margin-bottom: 3%;\">Drawing comparisons with financial dispute resolution procedures in family law, Mr. Temmink argued that mediation is often most effective when parties enter the process with a realistic understanding of the evidence and legal issues.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">The Importance of Effective Mediators<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Temmink also stressed the importance of mediator quality.<\/p>\n<p>In his view:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Mediation is only as good as the mediator.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">While acknowledging the value of facilitatory mediation, he suggested that sophisticated commercial disputes frequently require mediators willing to challenge unrealistic assumptions and test the strengths and weaknesses of each side&#8217;s case.<\/p>\n<p>As he put it:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Parties and their lawyers sometimes need to be told by a credible neutral that their case has weaknesses.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">According to him, mediators who actively engage in &#8220;reality testing&#8221; often produce better outcomes than those who merely act as intermediaries passing settlement offers between parties.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">The UK&#8217;s Strong Mediation Culture<\/p>\n<p style=\"margin-bottom: 3%;\">Offering a practitioner&#8217;s perspective, <span style=\"font-weight: bold;\">Mr. Marc Keidan<\/span> reflected on the evolution of mediation within England and Wales.<\/p>\n<p style=\"margin-bottom: 3%;\">Although initially sceptical of mediation early in his career, he explained that both lawyers and clients increasingly recognised its practical advantages.<\/p>\n<p>As he candidly observed:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;I have a bias towards undertaking mediation and undertaking it earlier.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">According to Mr. Keidan, clients often discover that mediation provides many of the benefits they seek from litigation, but without the delays, costs and uncertainty associated with formal proceedings.<\/p>\n<p>He explained:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;The mediation process could be a proxy for going through that whole litigation process, but a lot quicker and a lot cheaper.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Keidan suggested that England&#8217;s strong mediation culture has been driven by a combination of incentives and pressures.<\/p>\n<p style=\"margin-bottom: 3%;\">On the one hand, mediation offers parties flexibility and commercially tailored solutions that courts cannot impose. On the other hand, England&#8217;s adverse costs regime encourages parties to realistically assess settlement opportunities.<\/p>\n<p>As he noted:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Even if you win, you&#8217;re not going to make full cost recovery.&#8221;<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">India&#8217;s Long Tradition of Mediation<\/p>\n<p style=\"margin-bottom: 3%;\">Responding from an Indian perspective, <span style=\"font-weight: bold;\">Mr. Sidharth Sethi<\/span> emphasised that mediation has deep historical roots in India.<\/p>\n<p>As he stated:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Mediation is not a new concept in India.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Tracing the history of consensual dispute resolution, Mr. Sethi referred to traditional Panchayat systems and even the Mahabharata, describing Lord Krishna&#8217;s efforts to mediate between the Kauravas and the Pandavas as an early example of mediation principles. According to him, modern mediation legislation merely formalises practices that have long existed within Indian society.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">India&#8217;s Evolving Mediation Framework<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Sethi outlined the development of mediation within India&#8217;s legal framework, referring to the Industrial Disputes Act, 1947, the Legal Services Authorities Act, 1987, Section 89 of the Civil Procedure Code, 1908, the Commercial Courts Act, 2015 and, most recently, the Mediation Act, 2023 (Mediation Act).<\/p>\n<p style=\"margin-bottom: 3%;\">He described the Mediation Act as a significant milestone because it formally recognises mediation, strengthens the enforceability of mediated settlements, promotes institutional mediation and facilitates online dispute resolution. At the same time, he emphasised that modern businesses increasingly seek outcomes extending beyond legal victory.<\/p>\n<p>As he observed:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Businesses today are not merely interested in getting a decision. They want quicker resolution, lower cost, confidentiality and most importantly preservation of future cooperation.&#8221;<\/p>\n<p>According to Mr. Sethi:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;The real question in India today is not whether we should go for arbitration or mediation. The question is which method is best suited to resolve the dispute, preserve future business cooperation and business value.&#8221;<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">The Growing Relevance of Arb-Med-Arb<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Sethi also discussed the increasing importance of hybrid dispute resolution models such as Arb-Med-Arb. Although India does not presently have a codified Arb-Med-Arb framework equivalent to Singapore&#8217;s model, he explained that India&#8217;s Arbitration and Conciliation Act, 1996 provides structural support for similar approaches.<\/p>\n<p style=\"margin-bottom: 3%;\">Such mechanisms allow arbitration proceedings to be paused while parties attempt mediation, before either converting settlements into enforceable awards or returning to arbitration if settlement efforts fail.<\/p>\n<p style=\"margin-bottom: 3%;\">According to Mr. Sethi, these models combine the flexibility of mediation with the certainty and enforceability associated with arbitration.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Court Backlogs and India&#8217;s Push Towards Mediation<\/p>\n<p style=\"margin-bottom: 3%;\">Offering a broader institutional perspective, <span style=\"font-weight: bold;\">Mr.<\/span> <span style=\"font-weight: bold;\">Prashanto Chandra Sen<\/span> argued that mediation&#8217;s growing importance in India must be viewed against the backdrop of significant judicial backlogs.<\/p>\n<p style=\"margin-bottom: 3%;\">Referring to the large number of pending cases across Indian courts, he explained that policymakers increasingly view mediation as an important mechanism for reducing pressure on the judicial system.<\/p>\n<p style=\"margin-bottom: 3%;\">At the same time, he cautioned against placing too much emphasis on raw settlement statistics.<\/p>\n<p>As he observed:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Statistics by themselves can be a bit deceptive on what the future possibilities are and where things are moving.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">According to Mr. Sen, sectors such as oil and natural gas have recorded exceptionally high success rates in mediation and conciliation because parties often seek to preserve long-term commercial relationships.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">&#8220;It Is Intrinsic in Indian Business Culture to Settle&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Sen also challenged perceptions that Indian commercial parties are inherently resistant to settlement.<\/p>\n<p>As he explained:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;It is intrinsic in Indian business culture to settle, or by settle I mean end a dispute quickly.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">According to him, commercial clients frequently seek practical solutions rather than prolonged litigation, particularly where ongoing business relationships are involved. He suggested that the success of mediation often depends on aligning dispute resolution processes with this commercial instinct.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">The Role of Lawyers in Successful Mediations<\/p>\n<p style=\"margin-bottom: 3%;\">The panellists unanimously agreed that lawyers play a crucial role in determining whether mediations succeed or fail.<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Sen recounted examples where lawyers&#8217; willingness to continue discussions at critical moments ultimately resulted in settlement.<\/p>\n<p style=\"margin-bottom: 3%;\">Similarly, Mr. Sethi stressed that lawyers have a professional responsibility to provide realistic advice regarding costs, risks and settlement opportunities. He explained that his firm routinely conducts cost-benefit analyses at the outset of major disputes, helping clients evaluate whether mediation may offer a more commercially sensible outcome than years of litigation or arbitration. According to him, lawyers should act not merely as advocates but also as trusted advisers capable of helping clients achieve practical solutions.<\/p>\n<p style=\"text-align: center; font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">What Makes a Good Mediator?<\/p>\n<p style=\"margin-bottom: 3%;\">The discussion concluded with reflections on the qualities that contribute to successful mediations.<\/p>\n<p>For Mr. Sen, one characteristic stands above all others:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;The mediator has to be someone who listens.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Keidan offered a more practical observation, joking that parties should always arrange dinner in advance because meaningful settlement discussions often occur late in the day.<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Temmink emphasised the importance of efficient time management, while Mr. Sen highlighted the need to carefully assess when mediation should be proposed.<\/p>\n<p style=\"margin-bottom: 3%;\">Mr. Sethi, however, advocated strongly for early intervention.<\/p>\n<p>As he concluded:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-weight: bold; font-style: italic;\">&#8220;Early intervention is very important if you want to see a successful mediation because once the positions become entrenched, then it becomes very difficult.&#8221;<\/p>\n<p style=\"font-weight: bold;\">Concluding Reflections<\/p>\n<p style=\"margin-bottom: 3%;\">The discussion demonstrated that while arbitration continues to dominate major commercial disputes, mediation is increasingly gaining recognition as an effective and commercially attractive alternative.<\/p>\n<p style=\"margin-bottom: 3%;\">Although the United Kingdom currently possesses a more mature mediation ecosystem supported by judicial encouragement, adverse costs consequences and established mediation institutions, developments in India suggest a growing shift towards consensual dispute resolution. Legislative reforms, institutional support and changing commercial expectations are steadily strengthening mediation&#8217;s position within India&#8217;s dispute resolution landscape.<\/p>\n<p style=\"margin-bottom: 3%;\">Ultimately, the panel suggested that the future may not lie in choosing between mediation, arbitration or litigation.
