Union of India<\/span> W.P. (C) No. 589 of 2026, the Supreme Court, comprising <span style=\"font-weight: bold;\">Chief Justice of India Surya Kant and Justice Joymalya Bagchi<\/span>, found the existing dispute-resolution mechanism for State Bar Council elections inadequate and directed the constitution of additional Election Tribunals, while stressing the need for expeditious disposal of election disputes to uphold the integrity of the electoral process within Bar Councils.<\/p>\n<h3>Key Highlights of New Election Tribunals:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>On 25 May 2026, in compliance with the Supreme Court&#8217;s directions, the BCI notified the constitution of <span style=\"font-weight: bold;\">two new Election Tribunals<\/span>, as under:<\/p>\n<p style=\"font-weight: bold;\">Election Tribunal I:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Justice Deepak Gupta (Former Judge, SC) &#8212; Chairperson<\/p>\n<\/li>\n<li>\n<p>Justice Dhiraj Singh Thakur (Former Chief Justice, Andhra Pradesh HC) &#8212; Member<\/p>\n<\/li>\n<li>\n<p>Ms. Mahalakshmi Pavani (Senior Advocate) &#8212; Member<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<p style=\"font-weight: bold;\">Election Tribunal II:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Justice Hima Kohli (Former Judge, SC) &#8212; Chairperson<\/p>\n<\/li>\n<li>\n<p>Justice Tarlok Singh Chauhan (Former Chief Justice, Jharkhand HC) &#8212; Member<\/p>\n<\/li>\n<li>\n<p>Ms. Kaveeta Wadia (Senior Advocate) &#8212; Member<\/p>\n<\/li>\n<\/ul>\n<li>\n<p>These Tribunals are tasked with adjudicating disputes arising from the State Bar Council elections conducted in 2026.<\/p>\n<\/li>\n<li>\n<p>The Tribunals will deal with election petitions challenging:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Election results<\/p>\n<\/li>\n<li>\n<p>Validity of elected candidates<\/p>\n<\/li>\n<li>\n<p>Entire election processes, where necessary<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Petitions must be filed within <span style=\"font-weight: bold;\">30 days of the declaration of results<\/span>, or within <span style=\"font-weight: bold;\">15 days from the notification date<\/span> in cases where results were declared earlier.<\/p>\n<\/li>\n<li>\n<p>All election petitions must be filed before the Secretary of the BCI, who will act as the Registrar for the tribunals.<\/p>\n<\/li>\n<li>\n<p>The BCI will then allocate cases to the appropriate tribunal based on factors such as nature of the dispute, workload, and convenience.<\/p>\n<\/li>\n<li>\n<p>To ensure procedural discipline and seriousness of claims, a mandatory fee will be charged as follows:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">&#8377;30,000<\/span> for election petitions<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">&#8377;5,000<\/span> for other complaints.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>A key feature of the new framework is its emphasis on speed. The tribunals are expected to dispose of cases <span style=\"font-weight: bold;\">within six weeks<\/span>, as far as practicable.
