The Court held that if an ad interim injunction is not implemented in letter and spirit, its purpose is defeated. The Court observed that civil courts can order police assistance to implement ad interim injunction under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523743\" target=\"_blank\">151<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\">Civil Procedure Code, 1908<\/a> (CPC). Accordingly, the impugned order was set aside, and directions were issued for enforcement of the injunction.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also Read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/12\/24\/ori-hc-police-assistance-can-be-directed-to-implement-injunction-order\/\" target=\"_blank\">Police assistance can be directed to implement injunction order: Ori HC<\/a><\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">The plaintiff claimed exclusive and absolute ownership and possession based on the purchase in 2023 and subsequent demarcation conducted by the Revenue Authorities where they defined the boundaries of the suit land in presence of the adjoining landowners. The plaintiff also obtained permission from the Town and Country Planning Department for the construction over the suit land and started levelling it. It was alleged that the defendants appeared on the spot and obstructed the development work, created hindrance, and did not allow the plaintiff to carry out the development on her own land without any lawful justification. It was averred that the defendants, had no right, title, or interest over the suit property.<\/p>\n<p style=\"margin-bottom: 3%;\">Thereafter, the plaintiff instituted a suit for permanent prohibitory injunction restraining the defendants through their agents, servants, family members and assignees from causing interference in her peaceful possession, enjoyment, and construction over the suit land. It was also prayed that if the defendant caused any obstruction or damage, then decree for damages be passed in favour of the plaintiff. Along with the suit, an application under Order <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523435\" target=\"_blank\">39 Rules 1<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523437\" target=\"_blank\">2<\/a> read with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523743\" target=\"_blank\">151<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\">CPC<\/a> was also filed for the grant of ad interim injunction. The trial court granted an ad interim injunction restraining the defendants from digging, raising construction, changing nature or interfering over the suit land till further orders.<\/p>\n<p style=\"margin-bottom: 3%;\">Subsequently, an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001523743\" target=\"_blank\">151<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726944\" target=\"_blank\">CPC<\/a> was filed by the plaintiff seeking police assistance to enforce the injunction, alleging unlawful and unwarranted interference by the defendants in violation of the trial court&#8217;s order. It was stated that the defendants were not even adjoining landowners but were being instigated by the political persons to prejudice the plaintiff&#8217;s rights. However, the defendants contested the application, alleging that the plaintiff wanted to encroach over the adjoining government land described as Gair Mumkin Rasta in the revenue records, for which the plaintiff and her husband had uprooted and extended the boundary marks. Accordingly, the trial court dismissed the application.<\/p>\n<p style=\"margin-bottom: 3%;\">The dismissal was challenged and the plaintiff&#8217;s counsel contended that the trial court&#8217;s order was erroneous and that refusing the police assistance caused prejudice to her rights. On the other hand, the respondents reiterated that under the garb of the ad interim injunction, the plaintiff intended to encroach upon the government land and was trying to uproot the passage being used by the general public.<\/p>\n<h3>Analysis<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court noted that the trial court concluded that the excavation work was carried out near the public pathway for which complaints were also made by the Gram Panchayat and villagers regarding alleged damage to it, and therefore, the trial court had dismissed the plaintiff&#8217;s request for police assistance. The Court observed that the plaintiff had already made out a prima facie case in her favour and had obtained the ad interim injunction. The Court opined that the defendants&#8217; stand that the plaintiff was trying to encroach on government land could not be sustained to override the ad interim injunction. The Court highlighted that there was no material on record to substantiate that any construction being raised by the plaintiff was to encroach upon the government land. The Court opined that if the defendants were alleging that the plaintiff was trying to encroach, the best way to resolve the issue was to obtain the demarcation from the Revenue Authority.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further observed that the impugned order granted a premium to the defendants to interfere with the suit land, which made the injunction lose its efficacy. The Court noted that the allegations of encroachment were raised only by private defendants and neither the Gram Panchayat nor the State was a party defendant. It further highlighted that the plaintiff had placed on record the necessary permissions and had established a prima facie entitlement to protection, balance of convenience and irreparable loss. Therefore, the Court opined that in case the ad interim injunction was not implemented in its letter and spirit, then the very purpose of passing such an order would be defeated.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court emphasised that the majesty of the Court orders must be upheld, and observed that because of the defendants defying the orders, the plaintiff was compelled to approach the Court for grant of interim protection and for police assistance. Once the interim protection was granted, then the same could not be permitted to be violated to the detriment to the rights of the plaintiff. The Court referred to <span style=\"font-style: italic;\">Sanjay Kumar<\/span> v. <span style=\"font-style: italic;\">Vijay Kumar<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/E0i0xsq2\" target=\"_blank\">2023 SCC OnLine HP 1894<\/a>, wherein it was observed that if the circumstances of a case are such that assistance of police for the enforcement of an order is necessary, an order to this effect can be passed.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court opined that if the interim protection granted by the trial court was not implemented, then the very purpose of the ad interim injunction would be defeated.
