What made you choose law as a career?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">I am Shivam Chanana, an Advocate enrolled with the Bar Council of Delhi since 2015. Over the years, I have primarily practised in the field of civil litigation and arbitration, appearing before various courts and tribunals in Delhi. My professional journey has included working with a Central Government Standing Counsel at Delhi High Court and law firms. I was also seconded at Nissan Motor India Pvt. Ltd. to handle their dealer disputes. Currently, I am running my own chambers and I work extensively on civil disputes, arbitration matters, family disputes and commercial litigation.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Law, for me, was never just a profession; it was a combination of intellectual challenge and human interaction. I was always fascinated by the idea that words, strategy, and interpretation can shape outcomes that directly impact people&#8217;s lives and businesses. During my early years, I realised that litigation gives you an opportunity to constantly learn, think critically, and stand up for someone&#8217;s rights. That sense of responsibility and the dynamic nature of the profession drew me towards law.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">2. You successfully completed your LLM from King&#8217;s College London. Is there a roadmap you would layout for young students who aim to pursue a Master&#8217;s degree from an international university? How would you layout its advantages as compared to one from an Indian university?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Pursuing an LLM abroad is a transformative experience, but students should approach it with clarity and preparation rather than treating it as merely a degree or a social milestone. My first advice would be to identify <span style=\"font-style: italic;\">why<\/span> you want to pursue an international LLM, whether it is specialisation, global exposure, networking, or academic growth.<\/p>\n<p style=\"margin-left: 18pt;\">A practical roadmap would include:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">1. Building a strong academic and internship profile during law school.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">2. Developing excellent legal research and writing skills.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">3. Gaining some practical exposure before applying, because work experience helps in interacting with other students and understanding classroom discussions better.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">4. Researching universities carefully based on ranking, faculty and specialisation.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt; margin-bottom: 3%;\">5. Preparing early for applications, statements of purpose, recommendations, and finances.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">My LLM in International Dispute Resolution at King&#8217;s College London exposed me to students, lawyers, and professionals from across jurisdictions. That global classroom environment changes the way you analyse legal issues because you stop looking at law from only one country&#8217;s perspective.<\/p>\n<p style=\"margin-left: 18pt;\">As compared to many Indian LLM programs, an international LLM often provides:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">1. Greater practical and comparative exposure.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">2. Access to globally recognised faculty and institutions.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">3. Networking opportunities with international practitioners.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt; margin-bottom: 3%;\">4. Better training in independent thinking, research, and policy analysis.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">However, I also believe that the value of any degree ultimately depends on how a student uses the experience. A foreign degree alone does not guarantee success. What truly matters is how you apply that learning in your professional life.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">3. Which arena of matters would you say you enjoy the most dealing with? What makes it particularly enjoyable?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">I particularly enjoy dispute resolution and civil litigation matters involving complex factual and strategic issues. Arbitration, commercial disputes, and civil litigation are areas that I find intellectually stimulating because every matter comes with a unique set of facts, personalities, and legal challenges.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">What makes litigation enjoyable for me is that no two days are the same. One day you are researching a legal proposition, another day you are strategising with clients, drafting pleadings, or arguing before a court. I also enjoy the analytical aspect of breaking down complicated disputes into clear legal issues and building a persuasive case around them.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Additionally, handling disputes teaches you patience, adaptability, and problem-solving skills that are equally valuable outside the courtroom.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">4. What factors go in before you decide to take up (or not) a particular matter? Is your personal understanding of justice relevant to that decision?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Before taking up a matter, I usually consider three important aspects like the legal merits of the case, the client&#8217;s conduct and expectations, and whether I would be able to effectively contribute towards resolving the dispute.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">As lawyers, we are officers of the court, and while every person deserves representation, professional ethics and credibility remain extremely important. I believe a lawyer must maintain honesty with the client about the strengths and weaknesses of a case instead of creating unrealistic expectations.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">My personal understanding of justice does play a role, particularly in matters involving misuse of process, harassment, or cases where the litigation appears purely vindictive. At the same time, litigation often operates in grey areas where facts and legal positions are contested. Therefore, a lawyer must balance professional duty with ethical responsibility.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">5. How and when did you decide to start your independent practice?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">The idea of independent practice developed gradually over years of litigation experience. Working in different professional environments helped me understand not only the legal side of the profession but also the client management, strategy building, and the realities of litigation practice. I also understood that I need to stay away from the toxicity that law firms offer.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">After spending years in law firms and handling high-stakes disputes, I reached a stage where I wanted greater autonomy in the kind of matters I handle and the professional culture I wished to build. Independent practice also allows a lawyer to develop direct relationships with clients and create a more personalised approach towards dispute resolution.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Like many litigators, I believe there is never a &#8220;perfect&#8221; time to begin independently. At some stage, one has to trust their experience, network, and professional instincts enough to take that step. It has now been more than a year for me and I am truly glad that I took this leap of faith.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">6. According to you, what are some skills that a litigator must definitely possess?<\/p>\n<p style=\"margin-left: 18pt;\">A good litigator requires a combination of legal knowledge, practical wisdom, and interpersonal skills. Some essential qualities include:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">1. Strong research and drafting abilities.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">2. Clarity in communication and advocacy.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">3. Patience and emotional resilience.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">4. Presence of mind during arguments and negotiations.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">5. Attention to detail.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">6. Strategic thinking.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt; margin-bottom: 3%;\">7. Professional ethics and credibility before the court.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Apart from technical skills, adaptability is extremely important. Litigation is unpredictable, and the ability to remain composed under pressure often distinguishes effective lawyers from average ones.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">I also believe young litigators underestimate the importance of observation. Simply watching experienced advocates, Judges, and courtroom dynamics carefully can teach lessons that no textbook can.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">7. Based on your years of practice and the trends that you have witnessed, what matters more: the letter of the law or the spirit behind it?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">In practice, both are equally important and ideally should complement each other. The letter of the law provides certainty, structure, and consistency, whereas the spirit behind the law ensures that justice is not defeated by technicalities.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Courts today increasingly attempt to strike a balance between strict legal interpretation and equitable outcomes. However, excessive reliance on either extreme can create problems. If law is interpreted only mechanically, it may produce unfair outcomes. Conversely, ignoring statutory language entirely can create uncertainty in legal systems.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">In my experience, the best legal arguments are often those that successfully align both, a sound interpretation of the statutory framework along with the larger objective the law seeks to achieve.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">8. In your opinion, what are some aspects of litigation that can be better taught in law schools to prepare students at a foundational stage?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Indian law schools have improved significantly, but there still remains a noticeable gap between academic learning and actual litigation practice.<\/p>\n<p style=\"margin-left: 18pt;\">Some areas that deserve greater practical focus include:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">1. Courtroom procedure and filing practices.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">2. Drafting of pleadings and applications.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">3. Client counselling and communication.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">4. Case strategy and litigation management.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">5. Practical exposure to arbitration proceedings.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt; margin-bottom: 3%;\">6. Professional ethics in real-world situations.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Law students should also be trained to handle pressure, deadlines, and professional uncertainty because litigation is as much about temperament as it is about legal knowledge.<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Internships should not be treated as a formality. Real learning often happens when students observe how matters move in courts, how seniors interact with Judges, and how strategy changes during proceedings.<\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt; font-weight: bold; color: #000080;\">9. Finally, what advice would you give to students and young professionals pursuing litigation?<\/p>\n<p style=\"margin-left: 18pt; margin-bottom: 3%;\">Litigation is a long-term profession that rewards consistency more than instant success. Young lawyers often compare themselves too quickly with others without understanding that every advocate has a different journey.<\/p>\n<p style=\"margin-left: 18pt;\">My advice would be:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">1. Focus on learning before earnings during the initial years.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">2. Read extensively and develop strong drafting skills.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">3. Observe court proceedings regularly.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">4. Build credibility and professionalism from day one.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">5. Do not hesitate to ask questions and learn from seniors.<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">6. Litigation can be demanding, but it is equally important to create space for family, friendships, travel, and personal growth.
