Allahabad High Court:<\/span> In a set of bail applications filed by persons accused of throwing non-veg food in River Ganga after an Iftar party, the Single Judge Bench of Rajiv Lochan Shukla, J., allowed the applications, holding that the investigation about the Iftar party, the video and the alleged larger conspiracy of creating religious disharmony being part of a larger conspiracy, would not be thwarted and can continue without further detention of the accused persons. Considering the entire facts and circumstances of the case, the lack of criminal antecedents, the period of detention already undergone, and the apology expressed, the Court held that, prima facie, a case for bail was made out.<\/p>\n

Background<\/h3>\n

Allegedly, members of the Muslim Community, during an Iftar party, while partaking of food, including non-vegetarian food, threw the remains into the River Ganga. Accordingly, an FIR was filed against them under Sections 298<\/a>, 299<\/a>, 196(1)<\/a>(b<\/span>), 279<\/a>, 223<\/a>(b<\/span>), and 308(5)<\/a>, Nyaya Sanhita, 2023<\/a> (BNS), and Section 67<\/a>, Information Technology Act, 2000<\/a>, and the accused persons were arrested. Hence, the present bail applications.<\/p>\n

The State contended that the accused persons not only desecrated the River Ganga but also, in a brazen attempt to disturb communal harmony, uploaded the video on Instagram through the handle of one of the accused persons. The State further alleged that the video was part of a larger conspiracy to disturb public harmony, and an investigation was presently being conducted to find out who funded the said Iftar party and who was instrumental in promoting the uploading of the video.<\/p>\n

The State also contended that the River Ganga is not only a revered goddess in the Hindu religion but also the lifeline of the Northern part of India. The River Ganga being desecrated by the group of accused persons had hurt the sentiments of the country at large and had created a serious situation of public order.<\/p>\n

Analysis<\/h3>\n

At the outset, the Court perused the decisions cited by the State, such as Ratan Lal<\/span> v. State (NCT of Delhi)<\/span>, 2024 SCC OnLine Del 9002<\/a>, wherein the Court opined that Section 153-A<\/a> Penal Code, 1860<\/a> (IPC) mandates the presence of mens rea, requiring that the accused has acted with the malicious intent or knowledge that their actions could incite hatred or disrupt public tranquillity and create disharmony. The scope of Section 295-A<\/a> IPC<\/a> extends to acts committed in public or private that have the potential to disturb social order or ignite communal tensions by hurting religious sentiments, which disrupt public peace and provoke communal disharmony. The Court also reiterated that Section 295-A does not stipulate everything to be penalised or any and every act would be tantamount to insult or attempt to insult the religion or the religious beliefs of a class of citizens. It penalises only those acts of insults to or those varieties of attempts to insult the religion or religious belief of a class of citizens which are perpetrated with the deliberate and malicious intention of outraging the religious feelings of that class of citizens. Insults to religion offered unwittingly or carelessly or without any deliberate or malicious intention to outrage the religious feelings of that class do not come within the section.<\/p>\n

The Court also perused Geo Miller & Co. (P) Ltd.<\/span> v. U.P. Jal Nigam<\/span>1<\/sup><\/a> wherein the Court delved into the religious and environmental significance of the River Ganga, not only for the Hindu religion but also for the country at large.<\/p>\n

Noting the aforesaid, the Court clarified that while adjudicating upon a bail application, it would not be called upon to address the larger issue of the significance of the River Ganga for the Hindu community and the country at large. However, the Court wholeheartedly agreed with the State’s submissions regarding the significance of the River Ganga.<\/p>\n

The Court also stated that disruption of religious harmony by the acts of a few may lead to a larger incident, and the concern expressed by the State was not unfounded.<\/p>\n

The Court remarked that although it was aware of the role that social media plays in disrupting the even flow of life if misused, while considering the bail application of a person accused of an offence, it must stick to the facts of the case, despite bearing in mind the larger social issues.<\/p>\n

“The social media platforms, which disseminate information at lightning speed to every corner of the globe, have not only become a source of entertainment and information sharing but have also emerged as major hubs of disinformation.”<\/p>\n

On the facts, the Court stated that in its dispassionate opinion, the act of throwing food into the River Ganga, including non-vegetarian food, could rightly be said to hurt the religious sentiments of the Hindu Community.<\/p>\n

The Court noted that, prima facie, the averments made in paragraph 14 of the affidavits filed by the accused persons show that they and their families were apologetic for their actions and regretted the pain that had been caused to society at large. During prosecution in a criminal case, specific acceptance of the crime cannot be made by a person swearing an affidavit on behalf of the incarcerated person, and while considering the grant of bail, an admission to the crime alleged is not warranted. However, the affidavits filed in support of the bail application, in the Court’s opinion, showed genuine remorse for their actions. The Court further opined that the accused persons not denying being in the video and expressing regrets showed that they genuinely accepted what had been said in the affidavits and were not using the same as an excuse to escape the punishment of the law.<\/p>\n

The Court also noted that the FIR was initially lodged for offences under Sections 298, 299, 196(1)(b<\/span>), 270, 279, 223(b<\/span>), and 24 BNS and Section 24<\/a>, Water (Prevention and Control of Pollution) Act, 1974<\/a>. None of these offences initially levelled against the accused persons prescribed a punishment of more than 7 years.<\/p>\n

Furthermore, the Court noted that during the investigation, the boatman who was in charge of the boat where the said Iftar party had been conducted disclosed to the police that he was threatened and his boat was forcibly taken over by the accused. The acts constituting extortion have been disclosed in his statement, which need not be detailed here in this order. However, before registration of the case, the said boatman had not come forward to lodge any report or make any complaint regarding the extortion meted out to him. Thus, the Court opined that the delay by the boatman in coming forward with the allegations of extortion created suspicions about his story.<\/p>\n

Thus, the Court held that the investigation about the Iftar party, the video and the alleged larger conspiracy of creating religious disharmony being part of a larger conspiracy, would not be thwarted and can continue without further detention of the accused persons.<\/p>\n

Taking note of the entire facts and circumstances of the case, the lack of criminal antecedents, the period of detention already undergone, and the apology expressed, the Court held that prima facie a case for bail was made out. Accordingly, the accused persons were directed to be released on bail, on their executing a personal bond and two reliable heavy sureties each, of the like amount to the satisfaction of the Court concerned.<\/p>\n
