{"id":384036,"date":"2026-05-14T10:00:24","date_gmt":"2026-05-14T04:30:24","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=384036"},"modified":"2026-05-14T09:47:36","modified_gmt":"2026-05-14T04:17:36","slug":"gauhati-hc-remands-matter-declared-foreigner-by-foreigners-tribunal-discards-evidence-without-reasons","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/05\/14\/gauhati-hc-remands-matter-declared-foreigner-by-foreigners-tribunal-discards-evidence-without-reasons\/","title":{"rendered":"Declared \u201cForeigner\u201d Despite Voters&#8217; Lists from 1966 and Jamabandi from 1958: Gauhati HC sets aside Foreigners Tribunal\u2019s \u2018Cryptic\u2019 Order; Remands Matter"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Gauhati HC:<\/span> In a writ petition filed under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574969\" target=\"_blank\">226<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>, a Division Bench of Kalyan Rai Surana and Susmita Phukan Khaund*, JJ., remanded the matter to the Foreigner&#8217;s Tribunal after setting aside the judgment by the Tribunal where the petitioner was declared a foreigner as he could not prove continuous residence of his parents and grandparents as mandated by Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001568781\" target=\"_blank\">6-A(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002775594\" target=\"_blank\">Citizenship Act, 1955<\/a>. The Court held that the judgment appears to be perverse and requires a thorough and elaborate discussion after dealing with the documentary evidence submitted by the petitioner as the Tribunal discarded multiple documentary evidences presented by the petitioner, without assigning any reasons and holding any discussion as to the veracity of the documents and witnesses.<\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">The Guwahati Police made a reference to Foreigner&#8217;s Tribunal about the nationality of the petitioner after which he appeared and submitted his written statement in support of his nationality. He also adduced the evidence of 3 witnesses and exhibited several documents. After careful examination of entire materials on record, it was held by the Tribunal that the petitioner has failed to prove that he is the grandson of his projected grandfather and no linkage evidence was produced to prove his plea. The petitioner was thereby declared to be a foreigner.<\/p>\n<p style=\"margin-bottom: 3%;\">The same has been assailed before this Court.<\/p>\n<h3>Contentions<\/h3>\n<p style=\"margin-bottom: 3%;\">The petitioners contended that the prosecution&#8217;s case is not maintainable since there is no cause of action and statement of allegation was not furnished to the petitioner along with the notice issued by the Tribunal. Thus, the impugned judgment is liable to be set aside. The petitioner&#8217;s grandfather was a voter since 1966 and his name has been enrolled in the voters list of 1966 in the then District of Kamrup (now Barpeta). The grandfather&#8217;s name also appears in the NRC of 1951 and accordingly, a legacy data was provided in favour of his grandfather vide Legacy Data Code No. 120-0023-1554. Moreover, the petitioner&#8217;s father&#8217;s name has been mutated as pattadar by way of inheritance in respect of a parcel of land for which the authority has also furnished a certified copy of jamabandi for the period of 1958&#8212;1965.<\/p>\n<p style=\"margin-bottom: 3%;\">Additionally, the local Gaonbura also issued 2 certificates certifying that the petitioner is the son of Harmuz Ali and Pawan Nessa, residents of Village Garemari Pathar, P.O. Palhaji in the District of Barpeta. Three witnesses were examined by the petitioner to substantiate his claim. Land revenue paying receipts were also submitted, but these documents and the Gaonbura&#8217;s certificate were not accepted by the Tribunal on the ground that it was issued on the basis of the voters&#8217; list of 1997. The contention that petitioner had 4 paternal uncles who passed away and the father of the petitioner is alive was also ignored by the Tribunal.<\/p>\n<p style=\"margin-bottom: 3%;\">On the point of slight discrepancy in recording the age of the petitioner&#8217;s parents in the electoral rolls, which are noticeable in electoral rolls, it was contended that since the petitioner is illiterate and layman without any knowledge of law, the Tribunal should have considered the irregularity.<\/p>\n<p style=\"margin-bottom: 3%;\">The respondents, highlighting several discrepancies in the evidences adduced by the petitioner, contended that only voters&#8217; lists of 1966 and 1970 were produced and thereafter, there was no record of continuous stay up to 1989 and the voters list from 1989 shows petitioner&#8217;s father to be 30 years old. The jamabandi submitted by the petitioner reflects that the names of the owners in the jamabandi are inserted not by way of inheritance but as joint owners &#8220;Ankhidar Sutre&#8221;. Moreover, the villages mentioned in the various documents were found to be different. There was a long gap between the voters lists of 1970 to 1989, and the other voters lists relied upon by the petitioner also reveal that they are not continuous.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the respondents submitted that the petitioner could not prove continuous residence of the petitioner&#8217;s parents and grandparents as mandated by Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001568781\" target=\"_blank\">6-A(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002775594\" target=\"_blank\">Citizenship Act, 1955<\/a>.<\/p>\n<h3>Analysis<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court observed that there is a significant contradiction when the petitioner stated that all his uncles have passed away, whereas his father stated that one of them is alive.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the petitioner presented several documents which depict the petitioner&#8217;s name along with his father Hormoz Ali and the name of Hormoz Ali along with his father Danesh Ali. The land document reveals that the petitioner&#8217;s grandfather Danesh Ali was owner of a plot of land of patta dating back to the year 1958&#8212;1965. When there are documents linking the names of the petitioner along with his father, and his father with his grandfather, it was incumbent upon the Tribunal to record reasons while discarding the documentary evidence linking the petitioner to his father, and his father to his grandfather.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court found that the petitioner also exhibited an affidavit ascribing reasons that his grandfather was known as Danesh Ali but in the voters list of 1989, EPIC of 2013 and the voters list of 2017, it was recorded as Dagesh, Danesh and Danes instead of Danesh Ali. This point of discrepancies and the affidavit explaining it was not discussed by the Tribunal.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the Tribunal stated that the Sarkari Gaonbura of another village cannot issue a certificate in favour of a person who is a resident of a different village, but it was found that the deponent was the Sarkari Gaonbura of the same village to which the petitioner&#8217;s grandfather shifted his residence under the same police station. These details were also ignored by the Tribunal. The Tribunal held that the petitioner had failed to produce any revenue paying receipts of the land while discarding the jamabandi of 1958&#8212;1965.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further observed that the Tribunal disposed of the case of the petitioner through a cryptic order and there ought to have been some elaborate discussion while discarding the petitioner&#8217;s submissions. Moreover, the Tribunal did not accord sound reasonings as to why despite the appearance of the petitioner&#8217;s name along with his father, and father&#8217;s name along with his grandfather in different documents, the petitioner&#8217;s plea was dismissed. The jamabandi of 1958&#8212;1965 and the voters list of 2005 wherein the petitioner&#8217;s name figures along with his father, Hormoz Ali, was also discarded by the Tribunal without assigning any reasons. The patta of 1958&#8212;1965 was discarded despite the fact that the petitioner has linked his name with his projected father and grandfather. Due to a long gap from 1970&#8212;1989, the Tribunal has held the petitioner to be a foreigner as it was the Tribunal&#8217;s belief that no linking documents could be produced by the petitioner.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court, thus, noted that the voter&#8217;s list of 1997 and 2005 link the petitioner&#8217;s name with his father, grandfather and grandmother. The discrepancies in the name of the petitioner&#8217;s grandfather and father had been clarified through the affidavit attached by the petitioner.<\/p>\n<h3>Decision<\/h3>\n<p style=\"margin-bottom: 3%;\">Thus, after considering the entire facts and circumstances, the Court held that this case is required to be remanded back, as this Court cannot reappreciate the evidence like an appellate court and some documents are required to be included in the assessment of evidence for proper adjudication of the case of the petitioner in accordance with law. The sustainability or perversity of the decision of the Tribunal can only be assessed after certain nuances in the evidence as well as some documents discussing the core issue is properly dealt with by the Tribunal.<\/p>\n<p style=\"margin-bottom: 3%;\">The case being a writ of certiorari, the Court referred to the law laid down by the Supreme Court on this matter and mentioned <span style=\"font-style: italic;\">&#8220;&#8230;the High Court does not exercise the powers of Appellate Tribunal. It does not review or reweigh the evidence upon which the determination of the inferior tribunal purports to be based. It demolishes the order which it considers to be without jurisdiction or palpably erroneous but does not substitute its own views for those of the inferior tribunal. The writ of certiorari can be issued if an error of law is apparent on the face of the record.
