Madras High Court:<\/span> In a petition filed seeking to quash the criminal proceedings the petitioners alleged to have committed an act against the image and memory of Dr B.R. Ambedkar, L. Victoria Gowri, J., on being fully satisfied that the petitioners displayed genuine regret and remorse, stated that the present matter has moved beyond the stage of mere compromise. Thus, the Court quashed the criminal proceedings against the petitioners. Further, the Court emphasised that schools should not teach the Constitution as mere facts, rather, teach the constitutional journey of India through the lives of those who shaped it. Among them, Dr B.R. Ambedkar stands foremost.<\/p>\n

Accordingly, regarding directions to include Dr B.R. Ambedkar in the TN school curriculum, the Court directed the Chief Secretary and the Principal Secretary (School Education) to take appropriate policy steps, subject to feasibility. These steps include introducing lessons in Classes III—X on Dr B.R. Ambedkar’s role as Chairman of the Drafting Committee and his contributions to justice, liberty, equality and fraternity. They also cover his role in the freedom movement, nation-building, and his scholarly work in economics, law and social thought.<\/p>\n

Background<\/h3>\n

The case arose when Respondent 3 lodged a First Information Report (FIR) against the petitioners for the offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989<\/a>. According to him, in order to commemorate the birthday of Dr B.R. Ambedkar, posters bearing his photograph were pasted at Pulikuthi Bus Stand. Allegedly, Petitioner 1 tore one such poster and urinated upon it and Petitioner 2 videographed the said act and circulated it in a WhatsApp group. Upon completion of the investigation, the final report was filed before the Additional District and Sessions Judge, Exclusive Court for Trial of Protection of Civil Rights Act, 1955<\/a> (PCR) Cases.<\/p>\n

The petitioners approached the Court to seek quashment of the said proceedings based on a Joint Compromise Memo, voluntarily entered between the parties. According to which, Responent 3 had no objection with quashing the criminal proceedings against the petitioners, and the continuance of the trial would serve no useful purpose.<\/p>\n

Further, vide interim order dated 19 December 2025, the Court directed the petitioners to purchase 101 Tamil books on Dr B.R. Ambedkar, read and retain one copy each, and distribute the remaining copies to students at Murugappa Government Higher Secondary School. They were required to obtain acknowledgment, prepare for an oral test before the Court, and pay Rs 5000 each to the Adyar Cancer Institute.<\/p>\n

To ensure the directions were reformative, the Court conducted an in camera oral test and found that the petitioners had genuinely read and understood Dr B.R. Ambedkar’s life and contributions, rather than merely complying in form. The Court observed that the petitioners answered the questions satisfactorily and demonstrated that they had not merely purchased and distributed books as a ritualistic act but had in fact read and understood the substance of the text.<\/p>\n

Analysis, Law, and Decision<\/h3>\n

The Court stated that the offence in the present case cannot be trivialised, as the act of this nature has a social resonance extending beyond the immediate parties. Dr B.R. Ambedkar represents the constitutional promise made by this nation to the historically oppressed. He represents the moral authority of law over graded inequality. He represents the transformative aspiration of a Republic which declared that liberty, equality, and fraternity are governing commitments.<\/p>\n

The Court stated that they are often tasked with deciding whether a prosecution should continue or end. Yet, on rare occasions like the present case, the Courts must do more, transforming a moment of social fracture into one constitutional reaffirmation. The petitioners appeared before the Court as young men accused of a deeply insensitive act. They leave not with unexamined acquittal, but after being made to read, reflect, learn, and express remorse. Respondent 2 had also chosen reconciliation. In these unique circumstances, the law has achieved something beyond punishment; it has fostered understanding.<\/p>\n

On being fully satisfied that the petitioners displayed genuine regret and remorse, the Court stated that the present matter has moved beyond the stage of mere compromise. Since Respondent 2 had also chosen reconciliation over retribution, the Court observed that the possibility of conviction has become remote and bleak considering the voluntary settlement between the parties. Thus, the Court quashed the criminal proceedings against the petitioners.<\/p>\n

Inclusion of Dr B.R. Ambedkar in TN school curriculum<\/h3>\n

Further, the Court observed that in a nation that takes pride in being the world’s largest democracy, it is profoundly regrettable that many young minds are not introduced, with sufficient depth and seriousness, to the life and contributions of the Father of our Constitution. Dr B.R. Ambedkar did not merely chair the Drafting Committee; he laid the very foundations of democratic modernity in India. He was a jurist of exceptional intellect, an economist of rare distinction, a social reformer of unmatched courage, and a nation-builder who transformed centuries of civilisational suffering into a vision of constitutional hope.<\/p>\n

The Court stated that Dr B.R. Ambedkar’s larger-than-life legacy is too often reduced to a sectional symbol, when in truth he belongs to the entire nation, to every classroom, every court, every institution of learning, and every citizen who cherishes dignity under the law. A democratic nation that neglects to instill constitutional wisdom and morality in its youth does not progress toward development or empowerment; instead, it risks descending into a fractured society marked by divisiveness and caste prejudice.<\/p>\n

The Court emphasised that schools should not teach the Constitution as mere facts, but through the lives of those who shaped it. Among them, Dr B.R. Ambedkar stands foremost. Understanding him explains the meaning of equality, the need for social democracy, and reminds us that the Republic is a moral vision, not just a territorial arrangement. Thus, the Court impleaded the Chief Secretary to the State of Tamil Nadu and the Principal Secretary to Government, School Education Department, as Respondents 4 and 5 in this petition, for the limited purpose of issuing broader directions in public interest.<\/p>\n

Accordingly, the Court directed Respondents 4 and 5 to take appropriate policy steps, subject to feasibility, to introduce lessons in the State Social Science curriculum (Classes III—X) covering Dr B.R. Ambedkar’s role as Chairman of the Drafting Committee, his contributions to the ideals of justice, liberty, equality and fraternity, his role in the freedom movement and nation-building, and his scholarly work in economics, law and social thought.<\/p>\n

While this Court recognised that it cannot compel the State to adopt specific policies or dictate school curriculum, it emphasised that the constitutional value of fraternity cannot be left to chance. The ideals of justice, liberty, equality, and fraternity must be deliberately nurtured to endure. Constitutional literacy is a vital social responsibility, and for the future of India, such efforts to shape informed and responsible citizens can no longer be delayed.<\/p>\n
