No Prior Sanction Required Under S. 17A PC Act; Corruption Not an Act of Official Duty: Allahabad HC"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Disclaimer:<\/span> <span style=\"font-style: italic;\">This has been reported after the availability of the order of the Court and not on media reports so as to give an accurate report to our readers.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Allahabad High Court:<\/span> In an application filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804270\" target=\"_blank\">528<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">Nagarik Suraksha Sanhita, 2023<\/a> (BNSS), challenging the rejection of discharge, framing of charges, and validity of prosecution sanction,<span style=\"color: #0e101a;\"> the Single Judge Bench of <span style=\"font-weight: bold;\">Subhash Vidyarthi<\/span>, J.<\/span>, upheld the impugned orders, holding that no additional sanction under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803926\" target=\"_blank\">218<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a> [erstwhile Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519442\" target=\"_blank\">197<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">Criminal Procedure Code, 1973<\/a> (CrPC)] is required once sanction under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001564440\" target=\"_blank\">19<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825997\" target=\"_blank\">Prevention of Corruption Act, 1988<\/a> (PC Act) has been granted, as acts of corruption cannot be treated as acts done in discharge of official duty and conspiracy under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804283\" target=\"_blank\">61(2)<\/a>, <span style=\"font-style: italic;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">Nagarik Suraksha Sanhita, 2023<\/a><\/span> (BNSS) is not independent of the substantive offence. It was further held that in trap cases where the accused is caught red-handed, prior sanction under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002896478\" target=\"_blank\">17-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825997\" target=\"_blank\">PC Act<\/a> is not required and subsequently the Court dismissed the petitions.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also Read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/02\/19\/bom-hc-retired-public-servant-cannot-claim-sanction-protection\/\" target=\"_blank\">Sanction under S. 19 Prevention of Corruption Act not required after retirement of public servant: Bombay High Court<\/a><\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">The instant case arose from a complaint made on 3 February 2025 alleging demand of Rs 25,000 for permitting the complainant to join the post of Assistant Branch Post Master (ABPM) under Grameen Dak Sewa (GDS). After discreet verification, CBI registered FIR under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001564458\" target=\"_blank\">7<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825997\" target=\"_blank\">PC Act<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804283\" target=\"_blank\">61(2)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a>, against Ramesh Kumar Tudu and Brikesh Pandey. A trap was laid on 4 February, 2025 by CBI during which the applicant Achche Lal allegedly received the bribe amount on the instructions of a co-accused, while another co-accused, Brikesh Pandey, was also present. All accused were apprehended on the spot.<\/p>\n<p style=\"margin-bottom: 3%;\">Separate prosecution sanction orders were then issued on 30 July 2025. It was stated by the sanctioning authority that after examining the complaint, FIR, verification and trap memos, recorded conversations, witness statements and other material on record, and upon due application of mind, it was concluded that the applicants had committed offences under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804283\" target=\"_blank\">61(2)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001564458\" target=\"_blank\">7<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825997\" target=\"_blank\">PC Act<\/a>, and warranted prosecution.<\/p>\n<p style=\"margin-bottom: 3%;\">The applicants&#8217; discharge applications were rejected on 30 January 2026 by Special Judge, Anti-Corruption, CBI, and charges were framed by the trial court on 21 February 2026, leading to the present challenge.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also Read:<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/03\/26\/delhi-hc-section-17a-lalu-prasad-yadav-land-for-jobs-explained\/\" target=\"_blank\">Why Section 17-A of the Prevention of Corruption Act Didn&#8217;t Shield Lalu Prasad Yadav in Land-for-Jobs Case &mdash; Delhi High Court&#8217;s Ruling Explained<\/a><\/p>\n<h3>Analysis and decision<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court noted that in the present case, the charges are of commission of offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804283\" target=\"_blank\">61(2)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001564458\" target=\"_blank\">7<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825997\" target=\"_blank\">PC Act<\/a>. The Court relied upon <span style=\"font-style: italic;\">Neera Yadav<\/span> v. <span style=\"font-style: italic;\">CBI<\/span>, (Bharat Sangh) <a href=\"http:\/\/www.scconline.com\/DocumentLink\/L4yftN1q\" target=\"_blank\">2005 SCC OnLine All 1217<\/a>, where the Full Bench held that sanction granted under Section 19 would be sufficient for prosecution for the offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561375\" target=\"_blank\">120-B<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">Penal Code, 1860<\/a> (IPC) also, which is equivalent to Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804283\" target=\"_blank\">61(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a>. Further, the Court observed that the <span style=\"font-weight: bold;\">offences under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001564458\" target=\"_blank\">7<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825997\" target=\"_blank\">PC Act<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804283\" target=\"_blank\">61(2)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a> cannot be said to constitute &#8220;acts in discharge of official duty&#8221; and, therefore, no sanction is required for those acts<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court followed the law laid down by the Supreme Court in <span style=\"font-style: italic;\">Parkash Singh Badal<\/span> v. <span style=\"font-style: italic;\">State of Punjab<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/5wXM107M\" target=\"_blank\">(2007) 1 SCC 1<\/a>, <span style=\"font-style: italic;\">Dinesh Kumar<\/span> v. <span style=\"font-style: italic;\">AAI<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/5Tknuwsh\" target=\"_blank\">(2012) 1 SCC 532<\/a>, and <span style=\"font-style: italic;\">CBI<\/span> v. <span style=\"font-style: italic;\">Ashok Kumar Aggarwal<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/h9JkEJlx\" target=\"_blank\">(2014) 14 SCC 295<\/a>, which was that the validity of sanction order has to be examined during the trial and not at pre-trial stage.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further followed <span style=\"font-style: italic;\">CBI<\/span> v. <span style=\"font-style: italic;\">Santosh Karnani<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/9aVeXJ0I\" target=\"_blank\">2023 SCC OnLine SC 427<\/a>, where the accused could not be arrested at the spot during the trap and he had absconded, yet the Supreme Court held that the investigation against a person accused of demanding a bribe does not require any previous approval of the Central Government.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also relied upon <span style=\"font-style: italic;\">Ashok Kumar Choudhary<\/span> v. <span style=\"font-style: italic;\">CBI<\/span>, Neutral Citation: 2026:AHC-LKO:22051, wherein it was held that under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002896478\" target=\"_blank\">17-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825997\" target=\"_blank\">PC Act<\/a>, no prior sanction is required when an accused is caught during a trap. Applying this principle, the Court noted that in the present case, Achche Lal was caught red-handed accepting a bribe and Brikesh Pandey was also arrested during the trap proceedings. Therefore, in light of the first proviso to Section 17-A and the ruling in <span style=\"font-style: italic;\">CBI<\/span> v. <span style=\"font-style: italic;\">Santosh Karnani<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/9aVeXJ0I\" target=\"_blank\">2023 SCC OnLine SC 427<\/a><!-- Please check if this can be replaced with &#8220;Santosh Karnani (supra)&#8221; -->, the Court found that prior sanction was not necessary, and the argument that the proceedings were invalid due to a defective sanction order was therefore rejected by the Court.<\/p>\n<p style=\"margin-bottom: 3%;\">Applying the aforesaid principles, the Court held that there was no error or illegality in the orders dated 30 January 2026 and 21 February 2026, and dismissed the petition finding no merits.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold;
