{"id":382854,"date":"2026-04-30T16:30:43","date_gmt":"2026-04-30T11:00:43","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=382854"},"modified":"2026-04-30T18:18:54","modified_gmt":"2026-04-30T12:48:54","slug":"del-hc-stranger-grabbing-minors-hand-criminal-force-section-354-ipc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/30\/del-hc-stranger-grabbing-minors-hand-criminal-force-section-354-ipc\/","title":{"rendered":"Explained | Why Delhi HC Upheld Acquittal Despite Holding Stranger Grabbing Minor\u2019s Hand at Night Constitute Criminal Force Under Section 354 IPC"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p><span style=\"font-weight: bold;\">Delhi High Court:<\/span> The instant appeal preferred by the State under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\" target=\"_blank\">378(1)(<span style=\"font-style: italic;\">b<\/span>)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">Criminal Procedure Code, 1973<\/a> (CrPC), challenging trial court&#8217;s judgment of acquittal dated 29 January 2015, whereby the respondent\/accused had been tried for offences under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561672\" target=\"_blank\">354-D<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">Penal Code, 1860<\/a> (IPC) and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550489\" target=\"_blank\">12<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">Protection of Children from Sexual Offences Act, 2012<\/a> (POCSO Act), in connection with an incident of catching hold of the minor&#8217;s hand without consent with sexual intent by the accused, a stranger. The Single Judge Bench of <span style=\"font-weight: bold;\">Chandrasekharan Sudha*, J.<\/span>, although held that a stranger grabbing minor&#8217;s hand at night held to constitute criminal force under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> but upheld the trial court&#8217;s order of acquittal. The Court reasoned its decision on following grounds:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The ingredients for the offences charged, Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561672\" target=\"_blank\">354-D<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550489\" target=\"_blank\">12<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO Act<\/a>, were not made out.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Although the facts may disclose an offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>, absence of charge and inapplicability of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519474\" target=\"_blank\">222<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a> prevented conviction.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/01\/19\/del-hc-rubbing-penis-against-childs-private-part-not-penetrative-sexual-assault-under-pocso-act\/\" target=\"_blank\">Rubbing penis against child&#8217;s private part not &#8220;Penetrative Sexual Assault&#8221; under POCSO Act; Delhi HC modifies sentence<\/a><\/p>\n<h3>Factual Matrix<\/h3>\n<p style=\"margin-bottom: 3%;\">The prosecution case is that on 20 March 2013 at about 10.00 p.m., PW 2, a minor aged about 17 years, was returning from a common bathroom to her room situated on the fourth floor of a building in Naraina Village.<\/p>\n<p style=\"margin-bottom: 3%;\">At that time, the accused, a stranger, came from behind and caught hold of her hand. PW 2 managed to free herself, ran into her room, bolted the door from inside, and raised alarm. The accused followed her, banged on the door, and shouted abuses. Upon hearing the commotion, other residents gathered, apprehended the accused, and informed the police.<\/p>\n<p style=\"margin-bottom: 3%;\">The police reached the spot, recorded her statement, and arrested the accused. An FIR was registered at Naraina Police Station on the basis of the complaint of PW 2. After investigation, charge-sheet was filed. The trial court framed charges under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561672\" target=\"_blank\">354-D<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550489\" target=\"_blank\">12<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO Act<\/a>. The accused pleaded not guilty and claimed trial.<\/p>\n<p style=\"margin-bottom: 3%;\">The Additional Sessions Judge, by order dated 29 January 2015, acquitted the accused acquitted of offences under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561672\" target=\"_blank\">354-D<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550489\" target=\"_blank\">12<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO Act<\/a>. The State preferred the present appeal under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\" target=\"_blank\">378(1)(<span style=\"font-style: italic;\">b<\/span>)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a>, challenging the impugned order of acquittal.<\/p>\n<p style=\"margin-bottom: 3%; font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2026\/01\/09\/del-hc-making-minor-touch-private-parts-aggravated-sexual-assault-pocso\/\" target=\"_blank\">Making minor touch private parts with sexual intent constitutes Aggravated Sexual Assault under POCSO Act: Delhi High Court<\/a><\/p>\n<h3>Issues for Determination<\/h3>\n<p style=\"margin-bottom: 3%;\">Whether the impugned order of acquittal suffers from any infirmity warranting interference by the appellate court?<\/p>\n<h3>Analysis<\/h3>\n<p style=\"margin-left: 18pt; font-weight: bold;\">Scope of Appellate Interference<\/p>\n<p style=\"margin-bottom: 3%;\">At the outset, the Court observed that under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519673\" target=\"_blank\">386<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a>, the appellate court possesses full power to review, reappreciate and reconsider the evidence upon which the order of acquittal is founded. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a> does not impose any limitation or restriction on the exercise of such power, and the appellate court may reach its own conclusion both on questions of fact and law. At the same time, the Court emphasised that expressions such as &#8220;substantial and compelling reasons&#8221;, &#8220;strong circumstances&#8221; or &#8220;glaring mistakes&#8221; are not intended to curtail this power but merely underscore the reluctance of an appellate court to interfere with an acquittal. However, it was further underscored that in cases of acquittal, a double presumption of innocence operates in favour of the accused: (<span style=\"font-style: italic;\">i<\/span>) the presumption of innocence is a fundamental principle of criminal jurisprudence; and (<span style=\"font-style: italic;\">ii<\/span>) such presumption stands reinforced by the acquittal recorded by the trial court. Consequently, if two reasonable conclusions are possible on the basis of the evidence on record, the appellate court ought not to disturb the finding of acquittal. [See <span style=\"font-style: italic;\">Babu Sahebagouda Rudragoudar<\/span> v. <span style=\"font-style: italic;\">State of Karnataka<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002304641\" target=\"_blank\">(2024) 8 SCC 149<\/a>; <span style=\"font-style: italic;\">Rajesh Prasad<\/span> v. <span style=\"font-style: italic;\">State of Bihar<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001105726\" target=\"_blank\">(2022) 3 SCC 471<\/a>; and <span style=\"font-style: italic;\">Chandrappa<\/span> v. <span style=\"font-style: italic;\">State of Karnataka<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000039512\" target=\"_blank\">(2007) 4 SCC 415<\/a>].<\/p>\n<p style=\"margin-bottom: 3%;\">Relying on <span style=\"font-style: italic;\">Ram Kumar<\/span> v. <span style=\"font-style: italic;\">State of Haryana<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000021206\" target=\"_blank\">1995 Supp (1) SCC 248<\/a>, the Court noted that due weight must be given to the trial court&#8217;s advantage of observing the demeanour of witnesses. It reiterated the settle principle of law that <span style=\"font-style: italic;\">&#8220;if the main grounds on which the court below has based its order acquitting the accused, are reasonable and plausible, and the same cannot entirely and effectively be dislodged or demolished, the High Court should not disturb the order of acquittal&#8221;.<\/span><\/p>\n<p style=\"margin-left: 18pt; font-weight: bold;\">Determination of Charges<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that although the charge-sheet alleged offences under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561672\" target=\"_blank\">354-D<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561863\" target=\"_blank\">509<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> along with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550487\" target=\"_blank\">10<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO Act<\/a>, the trial court had framed charges only under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561672\" target=\"_blank\">354-D<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550489\" target=\"_blank\">12<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO Act<\/a>. Therefore, the enquiry was confined to whether the evidence on record established the ingredients of these specific offences.<\/p>\n<p>The Court noted that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> contemplates sexual harassment and requires the presence of unwelcome and explicit sexual conduct coupled with sexual intent with fulfilling following essential ingredients:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>the victim must be a woman;<\/p>\n<\/li>\n<li>\n<p>there must be unwelcome and explicit sexual conduct; and<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">conduct may include physical contact and advances involving sexual intent, a demand or request for sexual favours, showing pornography against her will, or making sexually coloured remarks.<\/p>\n<\/li>\n<\/ol>\n<p>Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561672\" target=\"_blank\">354-D<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> deals with stalking and the essential ingredients are:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>the accused must follow or contact a woman repeatedly;<\/p>\n<\/li>\n<li>\n<p>such contact must be despite a clear indication of disinterest by the woman; or<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">the accused monitors her use of the internet or electronic communication.<\/p>\n<\/li>\n<\/ol>\n<p>Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550489\" target=\"_blank\">12<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO Act<\/a> prescribes punishment for sexual harassment of a child, essential ingredients are:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>the victim must be a child below 18 years of age;<\/p>\n<\/li>\n<li>\n<p>the accused must engage in sexual harassment without physical contact; and<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">such conduct may include making sexual remarks, gestures, showing pornography, or repeatedly communicating with sexual intent.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2025\/08\/19\/karnataka-hc-pocso-act-gender-neutral-sexual-assault-case-against-woman-not-quashed\/\" target=\"_blank\">&#8220;POCSO Act is gender neutral&#8221;; Karnataka High Court refuses to quash sexual assault case against Woman<\/a><\/span><\/p>\n<p style=\"margin-left: 18pt; font-weight: bold;\">Evaluation of Evidence vis-&agrave;-vis Charged Offences<\/p>\n<p style=\"margin-bottom: 3%;\">Upon examining the materials on record, the Court found that the alleged overt acts of the accused did not satisfy the statutory ingredients of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a> or Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561672\" target=\"_blank\">354-D<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> or Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550489\" target=\"_blank\">12<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO Act<\/a>. The conduct attributed to the accused, though improper, did not amount to sexual harassment in the manner contemplated under Section 354-A, nor did it constitute repeated following or stalking within the meaning of Section 354-D. Similarly, the requirements of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550489\" target=\"_blank\">12<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\">POCSO Act<\/a>, which presuppose non-contact sexual harassment through gestures or communication, were not fulfilled.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court examined Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>, statutory definitions of &#8220;force&#8221; under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561662\" target=\"_blank\">349<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>, &#8220;criminal force&#8221; under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561664\" target=\"_blank\">350<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>, and &#8220;assault&#8221; under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561665\" target=\"_blank\">351<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>, to decide whether the proved facts would constitute an offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>, which penalises assault or use of criminal force to outrage the modesty of a woman.<\/p>\n<p style=\"margin-bottom: 3%;\">Applying these definitions to the facts of the case, the Court observed that the conduct of the accused, being a stranger, approaching the victim at night while she was returning from a common washroom, and catching hold of her hand without her consent, would certainly amount to use of criminal force. The reaction of the victim, who became frightened, ran into her room and bolted the door, further corroborated the nature of the act. The Court noted that such conduct, by its very nature, was &#8220;sexually coloured&#8221; and clearly indicative of an intention to outrage the modesty of the victim. The absence of any prior relationship and the suddenness of the act reinforced this inference.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court thus recorded a clear finding that even if the ingredients of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> were not made out, the facts established on record would squarely constitute an offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Also Read: <a href=\"https:\/\/www.scconline.com\/blog\/post\/2024\/07\/20\/commenting-about-dress-of-girls-touching-inappropriately-constitute-offence-u-s-7-of-pocso-act-hp-hc\/\" target=\"_blank\">Commenting about dress of girls, touching them inappropriately on their back, cheek and neck constitute an offence under Section 7 of POCSO Act: HP HC refuses to quash FIR<\/a><\/span><\/p>\n<p style=\"margin-left: 18pt; font-weight: bold;\">Applicability of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519474\" target=\"_blank\">222<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a><\/p>\n<p style=\"margin-bottom: 3%;\">The Court further considered whether the accused could be convicted under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> despite the absence of a specific charge. For this purpose, reliance was placed on Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519474\" target=\"_blank\">222<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a>, which permits conviction for a &#8220;minor offence&#8221; even if no charge has been framed for such offence.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court referred to the decision in Shamnsaheb M. Multtani v. <span style=\"font-style: italic;\">State of Karnataka<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000030139\" target=\"_blank\">(2001) 2 SCC 577<\/a>, wherein it was held that the concept of &#8220;minor offence&#8221; is not determined merely by the lesser punishment but by the nature of the ingredients, but <span style=\"font-style: italic;\">&#8220;only if the two offences are cognate offences, wherein the main ingredients are common, the one punishable among them with a lesser sentence can be regarded as a minor offence, vis-a-vis the other offence&#8221;.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Upon comparing Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>, the Court found that the ingredients of the two provisions are distinct. While Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> requires use of criminal force with intent to outrage modesty, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> pertains to specific acts of sexual harassment. Despite the punishment under certain sub-clauses of Section 354-A being lesser, the offences cannot be regarded as cognate or interchangeable. Consequently, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> cannot be treated as a &#8220;minor offence&#8221; vis-&agrave;-vis Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561669\" target=\"_blank\">354-A<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">In view of this distinction, the Court held that neither Section 222(1) nor Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519474\" target=\"_blank\">222(2)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a> could be invoked to convict the accused under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> in the absence of a charge.<\/p>\n<h3>Decision<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court held that although the evidence on record disclosed conduct amounting to an offence under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561668\" target=\"_blank\">354<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a>, the legal constraints arising from the absence of a charge and the inapplicability of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519474\" target=\"_blank\">222<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\">CrPC<\/a>, provided no ground for interference.
