{"id":382759,"date":"2026-04-29T17:30:13","date_gmt":"2026-04-29T12:00:13","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=382759"},"modified":"2026-04-29T17:18:52","modified_gmt":"2026-04-29T11:48:52","slug":"nclt-streamlines-hearings-through-single-benches","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/29\/nclt-streamlines-hearings-through-single-benches\/","title":{"rendered":"NCLT Targets Case Backlog with Single-Judge Benches&#151;What Changes Now"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 27 April 2026, the <span style=\"font-weight: bold;\">National Company Law Tribunal (NCLT)<\/span> issued an order authorising <span style=\"font-weight: bold;\">Single Judicial Member Benches<\/span> to hear and dispose of specified classes of matters under the <span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/Members\/NoteView.aspx?enc=SlRYVC0wMDAyNzY2MjUxJiYmJiY0MCYmJiYmU2VhcmNoUGFnZSN1bmRlZmluZWQ=\" target=\"_blank\">Companies Act, 2013<\/a> and the <a href=\"https:\/\/www.scconline.com\/Members\/NoteView.aspx?enc=SlRYVC0wMDAyODAyMTc4JiYmJiY0MCYmJiYmU2VhcmNoUGFnZSN1bmRlZmluZWQ=\" target=\"_blank\">Insolvency and Bankruptcy Code, 2016<\/a> (IBC).<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">The order came into force with immediate effect and applies to all <span style=\"font-weight: bold;\">NCLT benches<\/span> across the country unless otherwise directed.<\/p>\n<h2>Key Points:<\/h2>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The order has been issued in exercise of powers conferred under the proviso to Section <a href=\"http:\/\/www.scconline.com\/DocumentLink\/1H2mJi37\" target=\"_blank\">419(3)<\/a> of the <span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002766251\" target=\"_blank\">Companies Act, 2013<\/a><\/span>, with the objective of ensuring timely disposal of cases, reducing pendency, and improving overall case management across NCLT benches.<\/p>\n<\/li>\n<li>\n<p>Ordinarily, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/1H2mJi37\" target=\"_blank\">Section 419(3)<\/a> mandates that the Tribunal&#8217;s powers be exercised by a two-member bench comprising a Judicial Member and a Technical Member.<\/p>\n<\/li>\n<li>\n<p>However, the <span style=\"font-style: italic;\">proviso<\/span> empowers the <span style=\"font-weight: bold;\">President of the Tribunal<\/span> to constitute <span style=\"font-weight: bold;\">Single Judicial Member Benches<\/span> and to specify, by general or special order, the class of cases that may be heard by such benches.<\/p>\n<\/li>\n<li>\n<p>Invoking this statutory flexibility, the NCLT has now classified certain procedural, urgent, and uncontested matters as suitable for adjudication by a <span style=\"font-weight: bold;\">Single Judicial Member<\/span>.<\/p>\n<\/li>\n<li>\n<p>The order recognises that several matters coming before the NCLT are <span style=\"font-weight: bold;\">procedural, uncontested, or urgent<\/span> in nature and do not require the attention of a full Division Bench. By reallocating such matters to Single Judicial Member Benches, the Tribunal aims to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Reduce pendency,<\/p>\n<\/li>\n<li>\n<p>Improve case management, and<\/p>\n<\/li>\n<li>\n<p>Ensure quicker procedural adjudication without compromising legal safeguards.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The order clearly specifies the <span style=\"font-weight: bold;\">classes of matters<\/span> that can be heard and disposed of by a <span style=\"font-weight: bold;\">Single Judicial Member Bench<\/span>. These include:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Applications for <span style=\"font-weight: bold;\">early hearing<\/span><\/p>\n<\/li>\n<li>\n<p>Orders for <span style=\"font-weight: bold;\">completion of pleadings<\/span> and compliance with Tribunal directions<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Condonation of delay<\/span> in filing applications, replies, or affidavits<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Unopposed applications<\/span> for extension of <span style=\"font-weight: bold;\">CIRP or liquidation periods<\/span><\/p>\n<\/li>\n<li>\n<p>Extension of <span style=\"font-weight: bold;\">interim relief<\/span> earlier granted by a Division Bench<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Uncontested applications<\/span> for confirmation, substitution, or replacement of <span style=\"font-weight: bold;\">IRP\/RP\/Liquidator<\/span><\/p>\n<\/li>\n<li>\n<p>Substitution of parties or legal representatives (LRs)<\/p>\n<\/li>\n<li>\n<p>Taking on record <span style=\"font-weight: bold;\">progress reports<\/span> filed by IRP\/RP\/Liquidator<\/p>\n<\/li>\n<li>\n<p>Recording <span style=\"font-weight: bold;\">constitution or reconstitution of the Committee of Creditors (CoC)<\/span><\/p>\n<\/li>\n<li>\n<p>Issuing <span style=\"font-weight: bold;\">procedural directions to the Registry.<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>To prevent any dilution of adjudicatory standards, the order includes key safeguards:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>If <span style=\"font-weight: bold;\">any party requests a hearing before a Division Bench<\/span>, the matter will be placed accordingly.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Contested matters affecting substantive rights<\/span> cannot be finally adjudicated by a Single Judicial Member.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Matters <span
