Supreme Court:<\/span> In a long-standing environmental litigation regarding enhancement of the Environment Compensation Charge (ECC) levied on commercial vehicles entering Delhi to curb vehicular pollution, the 3-Judge Bench of Surya Kant, CJ., Joymalya Bagchi and Vipul M. Pancholi, JJ., approved the proposed revised ECC rates and the recommendation for 5 per cent annual increase in ECC rates, with clarification that such enhancement shall take effect from 1 April 2026.<\/p>\n

The Court noted that, in compliance with its earlier order dated 21 January 2026, the Commission for Air Quality Management (CAQM) had submitted a proposal recommending revision of ECC rates. The proposal, particularly Para 21, set out revised rates for Category 2 (light duty vehicles) and Category 3 (two-axle trucks) from Rs 1400 to Rs 2000 and for Category 4 (three-axle trucks) and Category 5 (four-axle trucks and above) from Rs 2600 to Rs 4000.<\/p>\n

The CAQM further recommended, in Para 23 of its proposal, that the ECC rates be subject to an annual increase of 5 per cent with effect from 1 April each year. This recommendation was based on an analysis indicating a compounded annual increase of approximately 4.8 per cent in toll rates on the Eastern Peripheral Expressway (EPE) since 2018, along with considerations of inflation, increased vehicle operating costs, and the need to maintain a deterrent against entry of diesel commercial vehicles into Delhi. The proposal also emphasised that such revision would “restore the deterrence value of ECC as originally fixed in 2015” and create a meaningful cost differential between passing through Delhi and using peripheral expressways.<\/p>\n

Additionally, Para 24 of the proposal suggested that the Municipal Corporation of Delhi (MCD) undertake a rationalisation of its toll structure, address disparities in vehicle classification vis-à-vis the National Highways Authority of India (NHAI) framework and conduct a comprehensive traffic and revenue study to assess diversion patterns and traffic potential in light of the revised ECC regime.<\/p>\n

Upon consideration, the Court found the CAQM’s proposal to be “reasonable, just, and fair” and approved the recommendations contained in Paras 21 and 23. However, it clarified that the 5 per cent annual enhancement would take effect from 1 April 2026.<\/p>\n

The Court issued the following directions:<\/p>\n

  1. \n

    Approved the revised ECC rates as proposed in Para 21 of the CAQM report.<\/p>\n<\/li>\n

  2. \n

    Approved the recommendation for 5 per cent annual increase in ECC rates, with clarification that such enhancement shall take effect from 1 April 2026.<\/p>\n<\/li>\n

  3. \n

    Directed all stakeholders to ensure that heavy and commercial vehicles not required to enter Delhi, except for essential supplies, and they must use peripheral expressways to bypass the city. Such diversion would also exempt them from payment of ECC.<\/p>\n<\/li>\n

  4. \n

    Directed the MCD to act in terms of CAQM recommendations, including rationalisation of toll structure.<\/p>\n<\/li>\n

  5. \n

    Directed the NHAI and MCD to work in coordination to implement earlier directions, particularly shifting of toll plazas to suitable locations.<\/p>\n<\/li>\n<\/ol>\n

    In connected civil appeals and transferred cases, the Court directed that matters (other than contempt petitions) be processed analogously and, where necessary, registered as interlocutory applications within the suo motu writ petition. The Court further directed that the contempt petitions were to be listed separately after administrative directions from the Chief Justice of India. Accordingly, it disposed of the writ petition.<\/p>\n
