{"id":381389,"date":"2026-04-17T18:30:45","date_gmt":"2026-04-17T13:00:45","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=381389"},"modified":"2026-04-20T15:59:46","modified_gmt":"2026-04-20T10:29:46","slug":"constitution-131st-amendment-bill-2026-introduced-inlok-sabha","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/17\/constitution-131st-amendment-bill-2026-introduced-inlok-sabha\/","title":{"rendered":"131st Constitutional Amendment: Linking Delimitation with Women\u2019s Reservation"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 16 April 2026, during a special parliamentary session, the <span style=\"font-weight: bold;\">Constitution (One Hundred and Thirty First Amendment) Bill, 2026<\/span>, was introduced in the Lok Sabha, marking a significant step towards enabling fresh delimitation and operationalising women&#8217;s reservation in legislatures.<\/p>\n<h2>Background:<\/h2>\n<p style=\"margin-bottom: 3%;\">Articles <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/1ssPX28w\" target=\"_blank\">82<\/a> and <a href=\"http:\/\/www.scconline.com\/DocumentLink\/6Gs29Mn3\" target=\"_blank\">170<\/a><\/span> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution of India<\/a> mandate that parliamentary and legislative assembly constituencies be periodically readjusted after every census to reflect changes in population.<\/p>\n<p style=\"margin-bottom: 3%;\">However, constitutional amendments enacted in <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/q6a3bmR8\" target=\"_blank\">2001<\/a> and <a href=\"http:\/\/www.scconline.com\/DocumentLink\/1bUe394F\" target=\"_blank\">2003<\/a><\/span> froze the allocation of seats on the basis of the 1971 Census, permitting only limited redrawing of constituency boundaries. While this freeze was intended to encourage population control and ensure political stability, it has over time created significant imbalances in representation due to population growth, migration, and rapid urbanisation.<\/p>\n<p style=\"margin-bottom: 3%;\">Furthermore, the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/Z4xdb9zS\" target=\"_blank\">106th Constitutional Amendment<\/a>, which provides for <span style=\"font-weight: bold;\">one third reservation of seats for women<\/span>, could not be implemented without a fresh delimitation exercise.<\/p>\n<p style=\"margin-bottom: 3%;\">This <span style=\"font-weight: bold;\">One Hundred and Thirty First Amendment Bill<\/span> was therefore introduced to revive the process of delimitation based on the latest census figures and to enable the timely implementation of women&#8217;s reservation, thereby making representative system more equitable, inclusive, and responsive to present demographic realities.<\/p>\n<h2>Key Points of the Constitution (One Hundred and Thirty First Amendment) Bill:<\/h2>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The amendment seeks to rationalise population-based representation by enabling a fresh delimitation of seats after the 2026 census and by operationalising women&#8217;s reservation in Parliament and State Legislative Assemblies through the removal of constitutional freezes.<\/p>\n<\/li>\n<li>\n<p>It proposes to revise the definition of <span style=\"font-weight: bold;\">&#8220;population&#8221; under the Article 55<\/span> for Presidential elections, linking it to census figures as may be determined by Parliament, instead of the 1971 census.<\/p>\n<\/li>\n<li>\n<p>Amendment to the <span style=\"font-weight: bold;\">Article 81<\/span> proposes to enhance democratic representation by increasing the maximum strength of the <span style=\"font-weight: bold;\">Lok Sabha to 815 members from States and 35 from Union Territories<\/span>, along with updating the population criteria for seat allocation.<\/p>\n<\/li>\n<li>\n<p>It seeks to amend <span style=\"font-weight: bold;\">Article 82 to remove the existing freeze on the readjustment of parliamentary constituencies<\/span> and to explicitly authorise delimitation on the basis of the latest published census figures.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Article 170<\/span> is proposed to be amended to permit the <span style=\"font-weight: bold;\">readjustment of seats and constituencies in State Legislative Assemblies<\/span> in accordance with updated population data.<\/p>\n<\/li>\n<li>\n<p>The amendment to <span style=\"font-weight: bold;\">Article 330 s<\/span>eeks to align the <span style=\"font-weight: bold;\">reservation of seats for Scheduled Tribes in the Lok Sabha<\/span> with revised population-based delimitation.<\/p>\n<\/li>\n<li>\n<p>It aims to revise <span style=\"font-weight: bold;\">clauses (3A) and (3B) of Article 332<\/span> to update reservation provisions for Scheduled Tribes in State Legislative Assemblies, while retaining special constitutional safeguards for specified northeastern States.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Article 334A<\/span> is proposed to be substituted to operationalise<span style=\"font-weight: bold;\"> one third reservation for women
