{"id":380473,"date":"2026-04-08T16:00:36","date_gmt":"2026-04-08T10:30:36","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=380473"},"modified":"2026-04-17T10:33:49","modified_gmt":"2026-04-17T05:03:49","slug":"cognizance-under-bnss-del-hc-flags-conflict-refers-issue","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/04\/08\/cognizance-under-bnss-del-hc-flags-conflict-refers-issue\/","title":{"rendered":"Delhi HC Raises Key Question on BNSS Cognizance, Seeks Larger Bench Clarity"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> While hearing a quashing petition filed by petitioner against the order dated 17 January 2025 passed by the trial court in a defamation criminal complaint, Single Judge Bench of Dr Justice Swarana Kanta Sharma referred the matter to a larger Bench for consideration.<\/p>\n<p style=\"margin-bottom: 3%;\">The issue raised by the petitioner involved the interpretation of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803932\" target=\"_blank\">223<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">Nagarik Suraksha Sanhita, 2023<\/a> (BNSS), and in particular, the scope and effect of the newly introduced first proviso to Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803932\" target=\"_blank\">223(1)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a>, which mandates that no cognizance of an offence on a complaint shall be taken by the Magistrate without affording the accused an opportunity of being heard.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court, in <span style=\"font-style: italic;\">Rita Bakshi<\/span> v. <span style=\"font-style: italic;\">Seema Bajaj<\/span>, had addressed a significant question concerning the stage at which &#8220;cognizance&#8221; is taken under the BNSS and expressly dissented from earlier decisions of coordinate Benches of the Court, including <span style=\"font-style: italic;\">Brand Protectors India (P) Ltd.<\/span> v. <span style=\"font-style: italic;\">Anil Kumar<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002794583\" target=\"_blank\">2025 SCC OnLine Del 5046<\/a> and <span style=\"font-style: italic;\">Neeti Sharma<\/span> v. <span style=\"font-style: italic;\">Saranjit Singh<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9002631543\" target=\"_blank\">2025 SCC OnLine Del 2329<\/a>. These judgments had held that the recording of statements of the complainant and witnesses is a step preceding the taking of cognizance, and that the opportunity of hearing under the proviso to Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803932\" target=\"_blank\">223(1)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a> arises only thereafter.<\/p>\n<p style=\"margin-bottom: 3%;\">However, the Court in <span style=\"font-style: italic;\">Rita Bakshi<\/span> had formed a prima facie opinion that cognizance is taken at the stage when the Magistrate applies judicial mind to proceed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803932\" target=\"_blank\">223<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a>, and that the examination of the complainant is a subsequent step. While arriving at this conclusion, the Court had analysed several decisions of the Supreme Court on the concept of &#8220;taking cognizance&#8221;, which has consistently been interpreted as the application of judicial mind to the facts of a case for the purpose of proceeding in a particular manner.<\/p>\n<p style=\"margin-bottom: 3%;\">In light of the apparent divergence from established precedent, the present issue had been raised.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner challenged the impugned order on multiple grounds. First, it was contended that taking cognizance in a complaint case is a judicial act involving the Magistrate&#8217;s application of mind to the alleged offence, whereas the examination of the complainant on oath (pre-summoning evidence) is merely a procedural step that follows cognizance. Second, it was argued that the trial court could not have proceeded to examine the complainant and witnesses without first taking cognizance, and that such action was undertaken without affording the petitioner an opportunity of hearing as required under the proviso to Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803932\" target=\"_blank\">223(1)<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">Third, the petitioner submitted that although Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001803932\" target=\"_blank\">223<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001804327\" target=\"_blank\">BNSS<\/a> introduced an important safeguard by mandating a pre-cognizance hearing for proposed accused persons in private complaints, this safeguard was rendered ineffective in the present case.
