{"id":379830,"date":"2026-03-31T16:30:10","date_gmt":"2026-03-31T11:00:10","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=379830"},"modified":"2026-03-31T16:28:52","modified_gmt":"2026-03-31T10:58:52","slug":"bci-withdraws-three-year-moratorium-law-colleges","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/03\/31\/bci-withdraws-three-year-moratorium-law-colleges\/","title":{"rendered":"BCI Withdraws Three-Year Moratorium: Revives Inspection-Based Approval of Law Colleges"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 5 March 2026, the <span style=\"font-weight: bold;\">Bar Council of India<\/span> (&#8216;BCI&#8217;) announced the withdrawal of three-year moratorium on law colleges and a resolution-based processing mechanism for approving and regulating Centres of Legal Education (CLEs).<\/p>\n<h2>Background:<\/h2>\n<p>The <span style=\"font-weight: bold;\">Rules of Legal Education&#8212;Moratorium (Three-Year Moratorium), 2025<\/span>, notified on <span style=\"font-weight: bold;\">13 August 2025<\/span>, imposed a blanket prohibition on the growth of legal education institutions across India. The Rules barred:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Establishment of new law colleges, and<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Expansion of existing CLE, including additional intake, new sections, or new courses.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">The moratorium was introduced due to the concerns over declining academic standards, unchecked growth of sub-standard institutions, and commercialization of legal education.<\/p>\n<p style=\"margin-bottom: 3%;\">However, the rigid implementation of the three-year ban soon became contentious and led to <span style=\"font-weight: bold;\">judicial scrutiny<\/span>, first before the <span style=\"font-weight: bold;\">Madras High Court<\/span> and thereafter before the <span style=\"font-weight: bold;\">Supreme Court of India<\/span>, following challenges raised by several law institutions.<\/p>\n<p style=\"margin-bottom: 3%;\">On <span style=\"font-weight: bold;\">2 February 2026<\/span>, the Madras High Court observed that the BCI itself had <span style=\"font-weight: bold;\">reconsidered and replaced the moratorium<\/span> through a subsequent resolution. Thereafter, on <span style=\"font-weight: bold;\">23 February 2026<\/span>, the Supreme Court of India took note of BCI&#8217;s stand and formally recorded that the <span style=\"font-weight: bold;\">moratorium had been done away with<\/span>, allowing institutions to apply for approvals for the academic year <span style=\"font-weight: bold;\">2026&#8212;27<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">Following these, BCI clarified that the <span style=\"font-weight: bold;\">moratorium notification dated 13 August 2025 is no longer operative or enforceable<\/span>.<\/p>\n<h2>Key highlights:<\/h2>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The <span style=\"font-weight: bold;\">three-year moratorium stands withdrawn<\/span> and has been replaced by an <span style=\"font-weight: bold;\">inspection-based approval system<\/span> under the <span style=\"font-weight: bold;\">Rules of Legal Education, 2008.<\/span><\/p>\n<\/li>\n<li>\n<p> All proposals relating to <span style=\"font-weight: bold;\">Centres of Legal Education (CLEs)<\/span> will be processed strictly in accordance with <span style=\"font-weight: bold;\">Chapter III of the Rules of Legal Education, 2008<\/span>, based on:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>documentary scrutiny,<\/p>\n<\/li>\n<li>\n<p>physical inspection by BCI-constituted inspection teams, and<\/p>\n<\/li>\n<li>\n<p>reasoned decisions taken on merit.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The <span style=\"font-weight: bold;\">extra-statutory pre-inspection filtering mechanism<\/span>, including any Inspection Permission Committee, has been <span style=\"font-weight: bold;\">discontinued<\/span>, and no prior clearance is required before inspection.<\/p>\n<\/li>\n<li>\n<p>Applications from existing CLEs seeking additional intake, or additional sections in already approved courses, will <span style=\"font-weight: bold;\">not be rejected at the threshold<\/span> and will be evaluated solely on <span style=\"font-weight: bold;\">academic and infrastructural adequacy<\/span>.<\/p>\n<\/li>\n<li>\n<p>Applications for introduction of new courses by existing CLEs, and establishment of new law colleges, will also be processed under the <span style=\"font-weight: bold;\">same statutory inspection framework<\/span>, subject to full compliance with applicable legal requirements.<\/p>\n<\/li>\n<li>\n<p>In accordance with <span style=\"font-weight: bold;\">Rule 16 and Rule 16(2)<\/span> of the Rules of Legal Education, 2008, a <span style=\"font-weight: bold;\">prior and valid order of university affiliation<\/span>, together with applicable <span style=\"font-weight: bold;\">government permissions or No-Objection Certificates (NOCs)<\/span>, remains a <span style=\"font-weight: bold;\">mandatory statutory prerequisite<\/span> before the BCI proceeds to inspection and consideration of approval.<\/p>\n<\/li>\n<li>\n<p>As reiterated under <span style=\"font-weight: bold;\">Rule 17<\/span>, universities are required to conduct their <span style=\"font-weight: bold;\">own inspection and verification<\/span> of infrastructure, faculty, library, and allied facilities before granting affiliation; however, <span style=\"font-weight: bold;\">university affiliation does not substitute BCI inspection<\/span>, and an <span style=\"font-weight: bold;\">independent inspection by the BCI<\/span> remains compulsory in all cases seeking approval or recognition.<\/p>\n<\/li>\n<li>\n<p>All applications will be submitted <span style=\"font-weight: bold;\">only through the official BCI portals<\/span>, with:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>applications by existing CLEs to be filed through the <span style=\"font-weight: bold;\">existing CLE portal<\/span>, and<\/p>\n<\/li>\n<li>\n<p>applications for the establishment of new law colleges to be filed through the <span style=\"font-weight: bold;\">dedicated new-institution application links<\/span> hosted on the BCI website.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Applications may be submitted <span style=\"font-weight: bold;\">up to 31 March 2026<\/span> (unless extended), along with the <span style=\"font-weight: bold;\">applicable processing and allied fees<\/span>, strictly in accordance with the <span style=\"font-weight: bold;\">fee structure prevailing on the date of submission<\/span> as hosted on the official BCI website.<\/p>\n<\/li>\n<li>\n<p>All legal education notifications, circulars, operational directions, and compliance requirements applicable to such applications will be those <span style=\"font-weight: bold;\">hosted on the official website of the BCI<\/span>, and will operate as <span style=\"font-weight: bold;\">supplementary to, and not in derogation of<\/span>, the Rules of Legal Education, 2008 and the present framework.<\/p>\n<\/li>\n<li>\n<p>The application process will follow a <span style=\"font-weight: bold;\">four-stage statutory workflow<\/span>, namely:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>online submission of the application<\/p>\n<\/li>\n<li>\n<p>administrative scrutiny by the BCI office for completeness, statutory compliance, fees, affiliation, NOC, and other prerequisites<\/p>\n<\/li>\n<li>\n<p>inspection by BCI-constituted inspection teams in accordance with the Rules<\/p>\n<\/li>\n<li>\n<p>consideration of the inspection report and final decision by the competent committee or body under the Rules.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Mere submission of an online application will <span style=\"font-weight: bold;\">not create any entitlement<\/span> to approval, recognition, affiliation, or permission, and <span style=\"font-weight: bold;\">no pre-inspection clearance or pre-inspection adjudicatory committee<\/span> will be required or insisted upon at any stage.<\/p>\n<\/li>\n<li>\n<p>Applications that were earlier <span style=\"font-weight: bold;\">returned, not registered, or kept pending solely due to the moratorium or the earlier pre-inspection mechanism<\/span> may be <span style=\"font-weight: bold;\">re-submitted or revived<\/span> and will thereafter be processed under the present inspection-based framework, subject to compliance with current documentation, affiliation, fee, and portal requirements.<\/p>\n<\/li>\n<li>\n<p>The office of the BCI will perform the <span style=\"font-weight: bold;\">administrative scrutiny function<\/span>, including checking completeness, fee compliance, category mapping, statutory prerequisites, and curing of defects, after which the matter will be placed for <span style=\"font-weight: bold;\">inspection and decision strictly in accordance with law<\/span>.<\/p>\n<\/li>\n<li>\n<p>All decisions, whether <span style=\"font-weight: bold;\">approval, rejection, deferral, or conditional approval<\/span>, will be <span style=\"font-weight: bold;\">reasoned, recorded, and based on inspection reports and applicable statutory provisions<\/span>.<\/p>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p style=\"font-style: italic;\">BCI has formally clarified that the three-year moratorium on law colleges has ended, and approvals will now be decided through inspections under the Rules of Legal Education,
