Punjab and Haryana High Court:<\/span> While considering a case wherein Guru Randhawa was accused of outraging religious feelings, promoting enmity and causing public mischief, a<\/span> Single Judge Bench of Surya Partap Singh, J., stayed the proceedings against him till the next hearing considering that the notice was issued to him without recording preliminary evidences.<\/p>\n

In the present case, the respondent had filed a complaint against the petitioner for the commission of offence punishable under Sections 299<\/a>, 302<\/a>, 196<\/a>, 356(1)<\/a>, 356(2)<\/a> and 353<\/a>, Nyaya Sanhita, 2023<\/a> (BNS).<\/p>\n

Guru Randhawa’s counsel argued that the notice was issued to him without recording the preliminary evidence which is contrary to the scheme prescribed under Section 223<\/a>, Nagarik Suraksha Sanhita, 2023<\/a> (BNSS).<\/p>\n

The Court pursued the order in that regard and observed that the notice to Guru Randhawa had been issued without recording the preliminary evidence. Thus, the Court adjourned the matter to 16 July 2026 and ordered stay on proceedings before the trial court till then.<\/p>\n
