{"id":377634,"date":"2026-03-07T15:00:24","date_gmt":"2026-03-07T09:30:24","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=377634"},"modified":"2026-03-12T10:17:34","modified_gmt":"2026-03-12T04:47:34","slug":"guj-hc-held-not-every-insult-offence-under-sc-st-act","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/03\/07\/guj-hc-held-not-every-insult-offence-under-sc-st-act\/","title":{"rendered":"Gujarat High Court: Not every insult or intimidation amounts to an offence under SC ST Act"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Gujarat High Court:<\/span> In an appeal against an order dated 22 May 2012 (impugned order), passed by the trial court for offences punishable under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561632\" target=\"_blank\">323<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561858\" target=\"_blank\">504<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561860\" target=\"_blank\">506(2)<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561366\" target=\"_blank\">114<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">Penal Code, 1860<\/a> (IPC) and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001551147\" target=\"_blank\">3(1), (10)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002828505\" target=\"_blank\">Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989<\/a> (SC\/ST Act), the Single Judge Bench of Sanjeev J. Thaker, J, dismissed the appeal and held that not every insult would amount to an offence under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002828505\" target=\"_blank\">SC\/ST Act<\/a>.<\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">According to the prosecution, the children of Accused 2 and 3 had been sitting in an open plot opposite the house of the complainant, who had objected to their presence. Upon learning this, Accused 2 and 3 had come to the spot and begun abusing the complainant. Shortly thereafter, Accused 1 and 4 had also arrived armed with a stick and allegedly used caste-based derogatory words against the complainant in public and threatened him not to disclose the incident.<\/p>\n<p style=\"margin-bottom: 3%;\">Based on this incident, a complaint had been filed alleging offences under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561632\" target=\"_blank\">323<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561858\" target=\"_blank\">504<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561860\" target=\"_blank\">506(2)<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561366\" target=\"_blank\">114<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\">IPC<\/a> and Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001551147\" target=\"_blank\">3(1), (10)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002828505\" target=\"_blank\">SC\/ST Act<\/a>. After investigation, a chargesheet had been filed, and the case was committed to the Sessions Court. After evaluating the evidence, the trial court, vide the impugned order, held that the prosecution failed to prove the case beyond reasonable doubt and acquitted the accused.<\/p>\n<h3>Analysis, Law and Decision<\/h3>\n<p style=\"margin-bottom: 3%;\">Upon consideration of the material on record, the Court noted that at the time of the complaint, the complainant had alleged that 8 to 10 people had gathered and were all abusing, but had failed to take any names.
