{"id":377395,"date":"2026-03-05T12:00:57","date_gmt":"2026-03-05T06:30:57","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=377395"},"modified":"2026-03-10T10:04:30","modified_gmt":"2026-03-10T04:34:30","slug":"madhya-pradesh-hc-directs-protection-of-jal-jeevan-mission-pipelines","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/03\/05\/madhya-pradesh-hc-directs-protection-of-jal-jeevan-mission-pipelines\/","title":{"rendered":"\u201cEnsure No Damage to Jal Jeevan Mission Infrastructure\u201d: MP High Court directs protection of pipelines during optical fibre cable work"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Disclaimer:<\/span> <span style=\"font-style: italic;\">This has been reported after the availability of the order of the Court and not on media reports so as to give an accurate report to our readers.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Madhya Pradesh High Court:<\/span> In a writ petition filed by Larsen And Toubro Limited (L&amp;T) seeking protection of the pipelines laid down by them under the Jal Jeevan Mission, <span style=\"color: #0e101a;\">the Single Judge Bench of <span style=\"font-weight: bold;\">Amit Seth, J., directed the Bharat Broadband Network Limited and NCC Limited to ensure that while executing the work of laying down optical fibre cables, no further damage is caused to the existing infrastructure.<\/span><\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">L&amp;T contended that via a communication dated 27 November 2025, the Collector, Shivpuri, informed and requested Bharat Broadband Network Limited that NCC Limited was causing damage while laying down optical fibre cables, including the pipelines laid down by L&amp;T under the Jal Jeevan Mission. Despite such communication, Bharat Broadband Network Limited did not take any action in the matter. Hence, the present writ petition.<\/p>\n<h3>Analysis<\/h3>\n<p style=\"margin-bottom: 3%;\">Considering the submissions and subject to hearing the other side, the Court directed Bharat Broadband Network Limited and NCC Limited to ensure that while executing the work of laying down optical fibre cables, no further damage is caused to the existing infrastructure, including the pipelines laid down by L&amp;T and all safety measures in the said regard were being taken, till next date of hearing.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\"><span style=\"font-style: italic;\">Larsen And Toubro Limited<\/span> v. <span style=\"font-style: italic;\">State of Madhya Pradesh<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/eh2iYcN4\" target=\"_blank\" rel=\"noopener\">2026 SCC OnLine MP 1395<\/a>, decided on 26-2-2026<\/span>]<\/p>\n<hr\/>\n<p>Advocates who appeared in this case:<\/p>\n<p style=\"margin-left: 18pt;\"><span style=\"font-weight: bold;\">For the petitioner:<\/span> Siddharth Sijoria and Madhur Bhargava<\/p>\n<p style=\"margin-left: 18pt;\"><span style=\"font-weight: bold;\">For the respondent:<\/span> Deputy Solicitor General Praveen Newaskar and Government Advocate G.K.
