{"id":376804,"date":"2026-02-26T09:00:33","date_gmt":"2026-02-26T03:30:33","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=376804"},"modified":"2026-02-25T18:32:47","modified_gmt":"2026-02-25T13:02:47","slug":"no-disclosure-of-employer-employee-matter-without-overriding-public-interest-raj-hc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/02\/26\/no-disclosure-of-employer-employee-matter-without-overriding-public-interest-raj-hc\/","title":{"rendered":"Right to Information Act, 2005 | No disclosure of employer-employee matter without overriding public interest: Rajasthan High Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Disclaimer:<\/span> <span style=\"font-style: italic;\">This has been reported after the availability of the order of the Court and not on media reports so as to give an accurate report to our readers.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Rajasthan High Court:<\/span> While considering a writ petition filed under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574969\" target=\"_blank\">226<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a> challenging the judgment passed by Respondent 1 dismissing the information sought by the petitioner and seeking a direction to Respondent 2 to provide the same, a Single Judge Bench of <span style=\"font-weight: bold;\">Kuldeep Mathur<\/span>, J., held that employer-employee matter is not open to disclosure without overriding public interest.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner had sought copies of the pay slips\/details of the salary paid to an employee of the respondent department for the period from January 2024 to March 2024 and the said information under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002760680\" target=\"_blank\">Right to Information Act, 2005<\/a> (RTI Act) was denied by the competent authority, on the ground that the information sought was personal in nature, pertained to a third party, and thus, exempted from disclosure under the RTI Act.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court stated that there was no illegality or infirmity in the action of the respondents in refusing to supply the information relating to a third party. The Court referred to <span style=\"font-style: italic;\">Girish Ramchandra Deshpande<\/span> v. <span style=\"font-style: italic;\">CIC<\/span> <a href=\"http:\/\/www.scconline.com\/DocumentLink\/yG4MXnfO\" target=\"_blank\">(2013) 1 SCC 212<\/a> and observed that <span style=\"font-weight: bold;\">disclosure of information relating to a matter between the employee and the employer, in the absence of any overriding public interest, has no relationship with any public activity or public interest.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the Court dismissed the petition at hand.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\"><span style=\"font-style: italic;\">Kanta
