    About the Panel Discussion:<\/h3>\n

    The Panel Discussion aims to address the issues and challenges in arbitration involving State-owned Entities and Micro, Small and Medium Enterprises (‘MSMEs’). State-Owned Entities have, over the years, been a party to numerous arbitration proceedings, given the fact that an arbitration clause has become a de facto clause in any contract. However, they face their own challenges, especially due to their public character, accountability, and bureaucratic processes, which may hamper their autonomy and independence, resulting in harm to the arbitration process itself. What modifications should State-Owned Entities implement in their operations and policies to enhance arbitration friendliness and efficiency? Do the recent policy amendments, such as the Ministry of Roadways’ recent notification, sufficiently address the issue by reducing arbitration occurrences among State-Owned Entities? Additionally, what measures or roles can the judiciary assume to alleviate these challenges and facilitate a seamless process until the enforcement of the Award?<\/p>\n

    MSMEs have traditionally served as a catalyst for economic growth. The recent budget has also introduced a renewed emphasis on this sector by increasing government support to address issues ranging from funding to dispute resolution faced by these enterprises. MSMEs are occasionally involved as opposing parties in disputes with State-Owned Entities (though private conglomerates also engage in disputes with MSMEs), which places them at a disadvantage due to disparities in bargaining power, the costs associated with arbitration processes, and notably, the limitations of the arbitration mechanisms provided under the MSMED Act. This includes the role of MSME Facilitation Councils, as well as challenges associated with the enforcement of arbitral awards. What role can the judiciary assume in resolving these issues and assisting in the development of a more resilient MSME ecosystem?<\/p>\n
