modernizing regulation through digital processes and stricter compliance requirements.<\/p>\n<p style=\"margin-bottom: 3%;\">These provisions are deemed to be in effect from 12-11-2025.<\/p>\n<h2>Key Points of Haryana Shops and Commercial Establishments (Amendment) Act:<\/h2>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>This Acts revises the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/VT9q6u2X\" target=\"_blank\">Haryana Shops and Commercial Establishments Act, 1958<\/a>, strengthening and modernizing its regulatory framework.<\/p>\n<\/li>\n<li>\n<p>It introduces a clear distinction between establishments employing <span style=\"font-weight: bold;\">20 or more workers<\/span> and those employing <span style=\"font-weight: bold;\">less than 20 workers<\/span>.<\/p>\n<\/li>\n<li>\n<p>The Act clarifies that the provisions of this Act apply to larger establishments, but with the introduction of Section 13A, the smaller establishments will be governed by simplified &#8220;intimation system.&#8221;<\/p>\n<\/li>\n<li>\n<p>Amendments to Sections 7 and 8 introduce the following changes:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Daily working hours<\/span> increased from <span style=\"font-weight: bold;\">9 to 10 establishments.<\/p>\n<\/li>\n<li>\n<p>Employers of establishments with <span style=\"font-weight: bold;\">20 or more workers<\/span> will now apply online for registration within one month of commencing business, furnishing details such as the employer&#8217;s name, GPS-based address, employee count, and nature of business.<\/p>\n<\/li>\n<li>\n<p>The Inspector is required to verify and issue online certificates within the timelines prescribed under the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002885525\" target=\"_blank\">Haryana Right to Service Act, 2014<\/a>.<\/p>\n<\/li>\n<li>\n<p>Employers will report any changes within <span style=\"font-weight: bold;\">7 days<\/span> and notify closure of the establishment within <span style=\"font-weight: bold;\">30 days<\/span>.<\/p>\n<\/li>\n<li>\n<p>Non-compliance of laws attracts significant penalties:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>&#8377;3,000&#8212;&#8377;10,000 for first violation<\/p>\n<\/li>\n<li>\n<p>&#8377;5,000&#8212;&#8377;25,000 for second violation<\/p>\n<\/li>\n<li>\n<p>&#8377;500 per day for continuous violations<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Newly added <span style=\"font-weight: bold;\">Section 13A<\/span> applies to establishments with <span style=\"font-weight: bold;\">less than 20 workers<\/span>, requiring an online intimation that generates a <span style=\"font-weight: bold;\">Basic Information Performa ID<\/span>, thereby reducing compliance burden while maintaining digital records.<\/p>\n<\/li>\n<li>\n<p>The Amendment Act also updates the penalty structure:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Up to &#8377;500 per day for contravention of Section 20.<\/p>\n<\/li>\n<li>\n<p>For falsification or omission of records:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#9675; &#8377;3,000&#8212;&#8377;10,000 (first offence)<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#9675; &#8377;5,000&#8212;&#8377;25,000 (second offence)<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#9675; &#8377;500 per day for continued violations<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Act now mandates two key employee related documents, with introduction of the following sections:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Section 20A: <span style=\"font-weight: bold;\">Appointment letters<\/span> with employee photographs<\/p>\n<\/li>\n<li>\n<p>Section 20B: <span style=\"font-weight: bold;\">Identity cards<\/span> containing prescribed particulars<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Section <span style=\"font-weight: bold;\">21(2)<\/span> is substituted, imposing a penalty of &#8377;3,000 to
