Rajasthan High Court:<\/span> While considering a bail application filed under Section 483<\/a> of the Bharatiya Nagarik Suraksha Sanhita 2023<\/a> (‘BNSS’) in offences under Sections 64(1)<\/a> and 137(2)<\/a> of the Bharatiya Nyaya Sanhita 2023<\/a> (‘BNS’) and Sections 3<\/a> and 4<\/a> of the Protection of Children from Sexual Offences Act, 2012<\/a> (‘POCSO Act’), a Single Judge Bench of Pramil Kumar Mathur<\/span>, J., granted bail to the petitioner-accused without going into the merits of the case.<\/p>\n

The accused submitted that the Medical Ossification Report stated the victim’s age between 16-18 years with a possible variation of two years as per settled norms. Hence, the victim’s age would come above 18 years. He argued that the victim herself stated during investigation and trial that she went with him on his call and resided with him without any opposition.<\/p>\n

Considering that the accused was in custody since 7-7-2025, the Court granted benefit of bail to him without expressing any opinion on the merits\/demerits of the case.<\/p>\n

The Court directed the accused to furnish a personal bond of Rs. 50,000 with tw0 sureties of Rs. 25,000 each to the satisfaction of the Trial Court.<\/p>\n
