{"id":373532,"date":"2026-01-23T11:00:06","date_gmt":"2026-01-23T05:30:06","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=373532"},"modified":"2026-01-28T15:15:45","modified_gmt":"2026-01-28T09:45:45","slug":"supreme-court-women-reservation-bar-council-election-reforms","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/01\/23\/supreme-court-women-reservation-bar-council-election-reforms\/","title":{"rendered":"30% Women&#8217;s Reservation to apply in Punjab &#038; Haryana Bar Council Elections, Supervisory Committee to continue oversight: SC"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Supreme Court:<\/span> In a writ petition instituted under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001575141\" target=\"_blank\">32<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution of India<\/a> raising issues concerning the functioning of the Bar Councils, transparency in electoral processes, and representation of women advocates in elected bodies, a Division Bench of Surya Kant, CJ., and Joymalya Bagchi, J., issued directed regarding implementation of the Court&#8217;s order in <span style=\"font-style: italic;\">Meena A Jagtap<\/span> v. <span style=\"font-style: italic;\">Bar Council of India<\/span>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9003034891\" target=\"_blank\">2025 SCC OnLine SC 2749<\/a>, dated 08-12-2025.<\/p>\n<p style=\"margin-bottom: 3%;\">The instant matter concerned with implementation of the directions issued by the Supreme Court in <span style=\"font-style: italic;\">Meena A Jagtap<\/span> (Supra), particularly relating to 30% reservation for women members and reforms in Bar Council elections. Several interlocutory applications were filed seeking clarification, modification, implementation of directions and intervention by various stakeholders, including State Bar Councils and the Bar Council of India.<\/p>\n<p style=\"margin-bottom: 3%;\">By an earlier order in <span style=\"font-style: italic;\">Meena A Jagtap<\/span> (Supra), this Court had issued directions, inter alia, regarding reservation for women members in Bar Council elections and made observations concerning the composition and strength of State Bar Councils.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the election process of the Bar Council of Punjab &amp; Haryana had not yet commenced and only the voter list had been finalised and the Bar Council of India had forwarded a proposal to the Ministry of Law and Justice for increasing the strength of State Bar Councils.<\/p>\n<p>The court issued following directions &#8212;<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The High Powered Election Supervisory Committee, headed by Justice Sudhanshu Dhulia, former Judge of the Supreme Court of India, would oversee the process after considering the views of all stakeholders. The Committee shall take into account the viewpoints of the Bar Council of India and the State Bar Councils before issuing appropriate directions<\/p>\n<\/li>\n<li>\n<p>Ordered that the words &#8220;Punjab and Haryana&#8221; appearing in paragraph 4 of <span style=\"font-style: italic;\">Meena A Jagtap<\/span> (Supra) to be deleted.<\/p>\n<\/li>\n<li>\n<p>30% reservation for women members, as contemplated in paragraph 6 of <span style=\"font-style: italic;\">Meena A Jagtap<\/span> (Supra), shall apply to the ensuing elections of the Bar Council of Punjab &amp; Haryana.<\/p>\n<\/li>\n<li>\n<p>Requested the Attorney General for India to intervene and assist the Court on the issue of enhancement of the strength of State Bar Councils.<\/p>\n<\/li>\n<li>\n<p>Directed the Bar Council of India to supply a soft copy of the complete paper book and all previous orders to the offices of the Attorney General for India and the Additional Solicitor General.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Directed to list the main writ petition along with pending interlocutory applications for further hearing on 06-02-2026.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\"><span style=\"font-style: italic;\">Yogamaya M.G.<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/k5gjdQ3M\" target=\"_blank\" rel=\"noopener\">2026 SCC OnLine SC 102<\/a>, Decided on 16-01-2026<\/span>]<\/p>\n<hr\/>\n<p>Advocates who appeared in this case:<\/p>\n<p style=\"margin-left: 18pt;\">Ms. Shobha Gupta, Sr. Adv., with Ms. Yogamaya M.G., Mr. Deepak Prakash, AOR Ms. Komal, Ms. Jyoti P.
