On 13-1-2026, the Ministry of Road Transport and Highways (‘MoRTH’) notified the Central Motor Vehicles (Second Amendment) Rules, 2026<\/span>, introducing new provisions linked to unpaid user fees (toll dues)<\/span> and tightening compliance requirements for vehicle owners.<\/p>\n

These Rules came into effect on 14-1-2026.<\/p>\n

Key Highlights:<\/h3>\n

  1. \n

    These Rules amend Central Motor Vehicles Rules, 1989<\/a><\/span>, strengthening compliance with user fee payment (toll) payments on National Highways.<\/p>\n<\/li>\n

  2. \n

    A new term “unpaid user fee” is introduced, referring to the toll payable by a vehicle where the Electronic Toll Collection (‘ETC’) system has recorded the vehicle’s passage but has not received the applicable toll amount<\/span>, as levied under Section 7<\/a> of the National Highways Act, 1956<\/a>.<\/p>\n<\/li>\n

  3. \n

    Under Rule 55<\/span>, a No Objection Certificate<\/span> (‘NOC’) for transfer of ownership or inter-State transfer of a vehicle will not be granted unless all unpaid user fees are cleared.<\/p>\n<\/li>\n

  4. \n

    Under Rule 62<\/span>, renewal or issuance of a Certificate of Fitness<\/span> will not be permitted unless all outstanding user fee dues are paid.<\/p>\n<\/li>\n

  5. \n

    For commercial vehicles seeking a National Permit, Rule 90<\/span> mandates that the vehicle must have zero unpaid user fee<\/span> to become eligible for the grant or renewal of permits.<\/p>\n<\/li>\n

  6. \n

    ‘Form 28<\/span>’ is revised which now requires applicants to disclose whether any unpaid user fee is pending against the vehicle, along with relevant details.<\/p>\n<\/li>\n

  7. \n

    Promoting digital processes, the amendment to Rule 58<\/span> enables the electronic issuance of Part-III of Form 28 through the designated online portal.<\/p>\n<\/li>\n

  8. \n

    A new declaration is added in ‘Form 28’ to enhance transparency during NOC processing by requiring disclosure of any unpaid user fee.<\/p>\n<\/li>\n

  9. \n

    Form 28 serves as a key document for vehicle transfer, certifying that the vehicle has no pending dues, taxes, challans, or legal issues.<\/p>\n<\/li>\n
