{"id":371719,"date":"2026-01-05T15:00:49","date_gmt":"2026-01-05T09:30:49","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=371719"},"modified":"2026-01-08T10:46:57","modified_gmt":"2026-01-08T05:16:57","slug":"del-hc-tirupati-laddu-adulteration-ex-parte-injunction-scc-times","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2026\/01\/05\/del-hc-tirupati-laddu-adulteration-ex-parte-injunction-scc-times\/","title":{"rendered":"Tirupati Laddu Adulteration Case | Delhi High Court refuses ex-parte injunction in Defamation Suit"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">Disclaimer: This has been reported after the availability of the order of the Court and not on media reports so as to give an accurate report to our readers.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Delhi High Court:<\/span> In a suit seeking permanent injunction against allegedly defamatory publications concerning the much-publicised issue of Tirupati Tirumala laddu adulteration, a Single-Judge Bench of <span style=\"font-weight: bold;\">Amit Bansal, J.<\/span>, refused to grant an ex parte ad interim injunction without giving opportunity to the defendants to present their defence.<\/p>\n<p style=\"margin-bottom: 3%;\">In the instant matter, the grievance of the plaintiffs, including the former Chairman of the Tirumala Tirupati Devasthanams (TTD), arises from publications made by defendants 1 to 8, levelling allegations of serious wrongdoing against them in relation to the procurement of ghee for the Lord Sri Venkateswara Swamy Temple at Tirumala, &#8220;one of the holiest shrines to all persons who are following faith of Hinduism.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Relying on <span style=\"font-style: italic;\">Bloomberg Television Production Services India (P) Ltd.<\/span> v. <span style=\"font-style: italic;\">Zee Entertainment Enterprises Ltd.<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/ZLXE9IC1\" target=\"_blank\">2024 SCC OnLine SC 426<\/a>, the Court noted that &#8220;ex-parte ad interim injunctions could only be granted under exceptional circumstances.&#8221; On a prima facie consideration, the Court noted that they are not inclined to grant an ex parte ad interim injunction. The Court observed that <span style=\"font-weight: bold;\">&#8220;it would only be reasonable to give an opportunity to the defendants to present their defence in respect of their publications\/posts\/articles.&#8221;<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">While declining interim relief at that stage, the Court clarified that any publications, posts or articles made after the date of the order would be &#8220;after being put to the notice by this Court and would have its own consequences.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">The Court issued notices to
