{"id":371266,"date":"2025-12-30T15:00:16","date_gmt":"2025-12-30T09:30:16","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=371266"},"modified":"2025-12-30T15:15:19","modified_gmt":"2025-12-30T09:45:19","slug":"legal-profession-publicity-rules-2025-malaysia-explained","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/12\/30\/legal-profession-publicity-rules-2025-malaysia-explained\/","title":{"rendered":"Malaysian Bar Council Issues Updated Publicity Rules 2025 for Lawyers"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 18-12-2025, the <span style=\"font-weight: bold;\">Federal Government of Malaysia<\/span> notified the <span style=\"font-weight: bold;\">Legal Profession (Publicity) Rules 2025<\/span>, a regulatory framework governing publicity by legal practitioners in Malaysia.<\/p>\n<p style=\"margin-bottom: 3%;\">These Rules will come into force 1-1-2026.<\/p>\n<h3>Key Highlights of Legal Profession (Publicity) Rules:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p><span style=\"font-weight: bold;\">Legal Profession (Publicity) Rules 2025<\/span> are formulated by the Bar Council with the approval of the Attorney General under the powers conferred under <span style=\"font-weight: bold;\">Legal Profession Act 1976<\/span>.<\/p>\n<\/li>\n<li>\n<p>These Rules apply broadly to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Advocates and solicitors.<\/p>\n<\/li>\n<li>\n<p>Foreign Lawyers<\/p>\n<\/li>\n<li>\n<p>Malaysian Law Firms,<\/p>\n<\/li>\n<li>\n<p>International Partnerships<\/p>\n<\/li>\n<li>\n<p>Qualified foreign law firms.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The scope and understanding of term &#8220;<span style=\"font-weight: bold;\">Publicise<\/span>&#8221; is defined under <span style=\"font-weight: bold;\">Rule 3<\/span> as an act of making known to the public through any medium, including:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Printed or electronic forms.<\/p>\n<\/li>\n<li>\n<p>Paid or unpaid exposure in public media.<\/p>\n<\/li>\n<li>\n<p>Appearances at seminars, conferences, or forums.<\/p>\n<\/li>\n<li>\n<p>Contact with prospective clients initiated by or on behalf of the person.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Under <span style=\"font-weight: bold;\">Rule 4<\/span>, it is stated that any person publicising the legal practice is expected to do it in a dignified way<span style=\"font-weight: bold;\"> and standing of the legal profession<\/span>. The practitioners must:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Act with <span style=\"font-weight: bold;\">integrity<\/span>.<\/p>\n<\/li>\n<li>\n<p>Act in the <span style=\"font-weight: bold;\">best interest of each client<\/span>.<\/p>\n<\/li>\n<li>\n<p>Maintain <span style=\"font-weight: bold;\">public trust and confidence<\/span> in the profession.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rule 5<\/span> states that the Lawyers should not publicise in a way that is <span style=\"font-weight: bold;\">misleading, false<\/span>, <span style=\"font-weight: bold;\">offensive, or unlawful<\/span>. Publicity is improper if it:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Misrepresents facts,<\/p>\n<\/li>\n<li>\n<p>Omits material details,<\/p>\n<\/li>\n<li>\n<p>Includes unverifiable information, or<\/p>\n<\/li>\n<li>\n<p>Creates unjustified expectations.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Lawyers can claim specialisation but not as &#8220;<span style=\"font-weight: bold;\">experts<\/span>.&#8221; The claims made by them should be justified by qualifications, experience, time spent, and success level.<\/p>\n<\/li>\n<li>\n<p>The Bar Council can issue guidelines to ensure fairness and transparency.<\/p>\n<\/li>\n<li>\n<p>Publicity outside Malaysia is allowed to legal professionals under <span style=\"font-weight: bold;\">Rule 8<\/span>, if it:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Complies with local laws and<\/p>\n<\/li>\n<li>\n<p>Doesn&#8217;t harm Malaysia&#8217;s legal profession.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Publicity that is widely circulated in Malaysia will remain subject to the Rules to maintain professional integrity.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rule 9<\/span> makes lawyers responsible for ensuring compliance with publicity rules, including third-party actions, and requires prompt correction of any improprieties.<\/p>\n<\/li>\n<li>\n<p>The Bar Council can order modification or withdrawal of non-compliant publicity.<\/p>\n<\/li>\n<li>\n<p>The Rules were formulated by the Bar Council replacing the previous <span style=\"font-weight: bold;\">Legal Profession (Publicity) Rules 2001<a id=\"fnref1\" href=\"#fn1\" title=\"1.
