Saraf and Majive Shukla, JJ., dismissed the application, holding that since the petitioner chose to proceed under the remedy provided in the statute, he could not be allowed to seek a fresh remedy under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574969\" target=\"_blank\">226<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>. The Court reiterated that one cannot claim a fresh remedy under Article 226 after availing a statutory remedy.<\/p>\n<h3>Background<\/h3>\n<p style=\"margin-bottom: 3%;\">The petitioner filed the present petition seeking quashing of the impugned notice under Sections 148 and 148A(d) passed by the Jurisdictional Assessing Officer (&#8220;JAO&#8221;) for the Assessment Year(&#8220;AY&#8221;) 2017-18, as well as the consequential order passed by the JAO under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559391\" target=\"_blank\">147<\/a> read with Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559383\" target=\"_blank\">144<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559385\" target=\"_blank\">144B<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002955939\" target=\"_blank\">IT Act<\/a>. The petitioner also sought a stay on the recovery for AY 2017-18 and release of his bank account.<\/p>\n<h3>Analysis<\/h3>\n<p style=\"margin-bottom: 3%;\">At the outset, the Court noted that the petitioner had filed a rectification application against the impugned order passed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559391\" target=\"_blank\">147<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002955939\" target=\"_blank\">IT Act<\/a>, which was not disclosed in the present writ petition.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"color: #0e101a;\">The Court referred to <span style=\"font-style: italic;\">Rajasthan State Industrial Development &amp; Investment Corpn. v. Diamond &amp; Gem Development Corpn. Ltd.<\/span><\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/NU9Af9bI\" target=\"_blank\"><span class=\"Hyperlink\" style=\"color: #4a6ee0;\">(2013) 5 SCC 470<\/span>,<\/a><span style=\"color: #0e101a;\"> wherein it was held that one cannot &#8216;approbate and reprobate&#8217; at the same time, as it vitiates the legal principle that one cannot accept and reject the same legal instrument or transaction.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">The Court stated that in the present case, the petitioner, after applying for rectification as provided in the statute of an order, subsequently chose to approach the writ court for quashing the same order.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the Court held that since he chose to proceed under the remedy provided in the statute, he could not be allowed to seek a fresh remedy under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574969\" target=\"_blank\">226<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\">Constitution<\/a>.<\/p>\n<p class=\"animate-charcter\" style=\"margin-left: 36pt; margin-bottom: 3%;\"><span style=\"font-weight: bold; font-style: italic;\">&#8220;The rationale behind the same is that when on the same facts, a person has the right to claim one of two reliefs and with full knowledge he elects to claim one and obtains it, it is not open to him thereafter to flunk out on his election and claim the alternative relief.&#8221;<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Accordingly, the writ petition is dismissed.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Anand Kumar Verma v.
