Curriculum"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 13-12-2025, the Bar Council of India (&#8216;BCI&#8217;) announced the <span style=\"font-weight: bold;\">integration of &#8220;Drafting of Legislation&#8221; and &#8220;Plain Language Drafting&#8221;<\/span> into the subject <span style=\"font-weight: bold;\">Drafting, Pleading and Conveyance<\/span> under Schedule II, Part II(B<span style=\"font-weight: bold;\">) of the Rules of Legal Education, 2008.<\/span><\/p>\n<h3>Background:<\/h3>\n<p style=\"margin-bottom: 3%;\">This step was taken by BCI after extensive consultations with <span style=\"font-weight: bold;\">Legislative Department, Law Ministry<\/span> and other legal educators. On 24-10-2025, in an interactive meeting it was suggested that there is a need to equip future legal minds with the skill to draft legislation and draft plain, clear and precise legal documents.<\/p>\n<p style=\"margin-bottom: 3%;\">Again on 30-10-2025, it was highlighted that <span style=\"font-weight: bold;\">drafting of legislation<\/span> and <span style=\"font-weight: bold;\">plain language drafting<\/span> to be included in the curriculum of law courses.<\/p>\n<p style=\"margin-bottom: 3%;\">Then on 5-12-2025, BCI arrived on clear consensus that future lawyers should be equipped not only to interpret laws but also to <span style=\"font-weight: bold;\">draft legislation that is clear, precise, and citizen-friendly<\/span>, aligning legal education with the needs of a modern, accessible justice system.<\/p>\n<h3>Changes:<\/h3>\n<p style=\"margin-bottom: 3%;\">On 6-12-2025, <span style=\"font-weight: bold;\">BCI<\/span> in its general council meeting considered BCI resolved to include these competencies within <span style=\"font-weight: bold;\">Paper 21- Drafting, Pleading and Conveyance<\/span>. BCI acted under its powers conferred under <span style=\"font-weight: bold;\">Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543876\" target=\"_blank\">7(1)(h)<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543876\" target=\"_blank\">7(1)(i)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\">Advocates Act, 1961<\/a> and Rules of Legal Education 2008.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Previously, <span style=\"font-weight: bold;\">Paper 21<\/span> focused on general drafting principles. BCI has now includes <span style=\"font-weight: bold;\">&#8220;Drafting of Legislation&#8221;<\/span> and <span style=\"font-weight: bold;\">&#8220;Plain Language Drafting&#8221;<\/span> into <span style=\"font-weight: bold;\">Paper 21<\/span> within Schedule II, Part II (B). This move enhances the scope of Drafting in the law courses without altering the structure of the courses.<\/span><\/p>\n<p>Paper 21 will now explicitly include:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Legislative Drafting<\/span>: Translating policy objectives into legislative provisions, drafting primary and subordinate legislation.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Plain Language Drafting<\/span>: Applying techniques to make legal and legislative texts comprehensible without compromising legal accuracy.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">BCI has clarified that his directive does not add <span style=\"font-style: italic;\">new papers<\/span> but <span style=\"font-weight: bold;\">raises the standard of existing clinical training in drafting<\/span>.<\/p>\n<h3>Implementation:<\/h3>\n<p>Centres of Legal Education (&#8216;CLEs&#8217;) are expected to reflect the changes update teaching plans, course materials, and methodologies to reflect:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Legislative Drafting:<\/span> Translating policy objectives into legislative provisions, drafting primary and subordinate legislation.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Plain Language Drafting:<\/span> Making legal and legislative texts comprehensible without compromising accuracy.<\/p>\n<\/li>\n<\/ul>\n<p>The inclusion and changes in Paper 21 will ensure that:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Out of the 15 mandatory drafting exercises, at least <span style=\"font-weight: bold;\">5 will focus on legislative drafting<\/span><\/p>\n<\/li>\n<li>\n<p>Out of the 15 mandatory conveyancing exercises, at least <span style=\"font-weight: bold;\">5 will require plain language application<\/span>.<\/p>\n<\/li>\n<li>\n<p>Students will be required to demonstrate their ability to:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#9642; Understand legislative drafting&#8217;s role in public policy.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#9642; Prepare basic legislative clauses and subordinate legislation.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">&#9642; Re-draft legal texts in plain language while preserving legal effect.<\/p>\n<\/li>\n<\/ul>\n<p>The directive reaffirms the BCI&#8217;s authority to take necessary steps toward strengthening the legal education system.
