On 10-12-2025, the Ministry of Finance notified the Narcotic Drugs and Psychotropic Substances (‘NDPS’) (Amendment) Rules, 2025<\/span> to introduces significant procedural reforms to the import and export of narcotic drugs.<\/p>\n

These provisions came into effect on 10-12-2025.<\/p>\n

Key Points of NDPS Amendment Rules 2025:<\/h3>\n
    \n
  1. \n

    The Amendment Rules have been issued under Sections 4<\/a>, 9<\/a>, and 76<\/a> of the Narcotic Drugs and Psychotropic Substances Act, 1985<\/a><\/span>, to revise Narcotic Drugs and Psychotropic Substances Rules, 1985<\/a><\/span> (NDPS Rules).<\/p>\n<\/li>\n

  2. \n

    The changes primarily focus on revising Form 4A and Form 5 of the NDPS Rules to:<\/p>\n

      \n
    • \n

      Strengthen compliance and accountability.<\/p>\n<\/li>\n

    • \n

      Enhance traceability of narcotic substances.<\/p>\n<\/li>\n

    • \n

      Align domestic procedures with international narcotics control standards.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

    • \n

      New Form No. 4A for Import Approval<\/p>\n

        \n
      1. \n

        The previous Form 4A has been replaced with a detailed format for issuing import certificates under Rule 54.<\/p>\n<\/li>\n

      2. \n

        The form now includes:<\/p>\n

        ❖ Item description, HSN Code, CAS number, GSTIN of importer.<\/p>\n

        ❖ Conditions for import, including:<\/p>\n

        ⮚ Import within 180 days from certificate issue date.<\/p>\n

        ⮚ Port of entry specification.<\/p>\n

        ⮚ Compliance with security, accounting, and reporting procedures under Rules 42—47.<\/p>\n<\/li>\n

      3. \n

        For manufacturing formulations for export:<\/p>\n

          \n
        • \n

          No diversion for domestic sale.<\/p>\n<\/li>\n

        • \n

          Mandatory submission of export details (shipping bills, invoices) to the Narcotics Commissioner and Drugs Controller General of India.<\/p>\n<\/li>\n

        • \n

          State-level transport permits required.<\/p>\n<\/li>\n

        • \n

          Monthly returns and separate accounts for imported drugs and manufactured formulations.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

        • \n

          For analytical purposes:<\/p>\n

          ❖ Strictly limited to analysis.<\/p>\n

          ❖ Complete utilization reporting to the Narcotics Commissioner.<\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<\/li>\n

        • \n

          Any unutilized morphine, codeine, thebaine, or their salts\/formulations will be surrendered to the Government Opium and Alkaloids Works, with proper accounting.<\/p>\n<\/li>\n

        • \n

          Revised Form No. 5 for Export:<\/span> The export documentation table has been updated to include:<\/p>\n

          • \n

            Number of packages.<\/p>\n<\/li>\n

          • \n

            Drug name and preparation details.<\/p>\n<\/li>\n

          • \n

            Basic substance content.<\/p>\n<\/li>\n

          • \n
