The Bill seeks to amend the <span style=\"font-weight: bold;\">Legal<\/span><span style=\"font-style: italic;\"><\/span> <span style=\"font-weight: bold;\">Profession Act, 1976<\/span> (&#8216;<span style=\"font-weight: bold;\">LPA<\/span>&#8217;), particularly in relation to the <span style=\"font-weight: bold;\">Legal Profession Qualifying Board (&#8216;LPQB&#8217;)<\/span>.<\/span><\/p>\n<h3>The Concerns:<\/h3>\n<p>Since its establishment in 1976, the LPQB has been chaired by the <span style=\"font-weight: bold;\">Attorney General<\/span> and comprised <span style=\"font-weight: bold;\">five members:<\/span><\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Two<\/span> judges nominated by the Chief Justice,<\/p>\n<\/li>\n<li>\n<p>The<span style=\"font-weight: bold;\"> Chairman<\/span> of the Bar Council, and<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">A <span style=\"font-weight: bold;\">senior academic<\/span> from a Malaysian Faculty of Law.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">This structure has ensured balanced representation from the <span style=\"font-weight: bold;\">judiciary, the Bar, and academia<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">In recent years, however, the LPQB has faced scrutiny from Members of Parliament. To address transparency concerns, Parliament introduced Section 9A in May 2025 mandating annual audits by the Auditor General.<\/p>\n<h3>The Amendments proposed:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The November Bill was presented by <span style=\"font-weight: bold;\">YB M Kulasegaran<\/span>, Deputy Minister in the Prime Minister&#8217;s Department (Law and Institutional Reform), for its first reading.<\/p>\n<\/li>\n<li>\n<p>The Bill proposes several major changes:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Ministerial Appointments:<\/span> The Minister for Law would gain power to appoint <span style=\"font-weight: bold;\">8 out of 13 Board members<\/span>, a majority that does not currently exist under the LPA.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Removal Without Reason:<\/span> The Minister could remove <span style=\"font-weight: bold;\">7 Board members<\/span> without providing justification.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Control Over Remuneration:<\/span> The Minister would determine pay and perks for Board members.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>These changes would reduce representation from the judiciary and the Malaysian Bar to a minority (3 out of 13), undermining professional independence and creating a Board heavily influenced by the executive.<\/p>\n<\/li>\n<li>\n<p>The Bill also allows:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Expansion of the Board from 5 to 13 members,<\/p>\n<\/li>\n<li>\n<p>Creation of unlimited committees with allowances and expenses.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Such measures could deplete the LPQB&#8217;s funds, currently around <span style=\"font-weight: bold;\">RM55.2 million<\/span>, and increase costs for law students, contrary to the principles of responsible reform.<\/p>\n<\/li>\n<\/ol>\n<h3>The Malaysian Bar&#8217;s Position<\/h3>\n<p style=\"margin-bottom: 3%;\">The Malaysian Bar warns that these provisions would gravely compromise professional independence by creating a Board dominated by executive appointees, reducing the judiciary and Bar Council to a minority voice.<\/p>\n<p>The Bar asserts:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>LPQB leadership should rest with the Malaysian Bar, supported by balanced representation from the judiciary and academia.<\/p>\n<\/li>\n<li>\n<p>Governance should remain <span style=\"font-weight: bold;\">transparent, professional, and free from political interference<\/span>.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Operational costs and student fees should be reduced, not inflated.<\/p>\n<\/li>\n<\/ul>\n<p>In a press statement, <span style=\"font-weight: bold;\">Anand Raj<\/span>, Vice-President of the Malaysian Bar, quoted <span style=\"font-weight: bold;\">Hon Dr Lloyd Barnett, OJ<\/span>, former President of the Organisation of Commonwealth Caribbean Bar Associations:<\/p>\n<p class=\"animate-charcter\" style=\"margin-bottom: 3%; margin-left: 36pt; font-style: italic;\">&#8220;A legal profession which is controlled or manipulated or intimidated by politicians cannot effectively carry out its duty of sustaining the independence of the administration of justice. As a corollary, despotic government usually commences with the suppression of the legal profession.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">The Malaysian Bar expressed disappointment with the Government&#8217;s limited consultation sessions. Despite submitting detailed feedback in <span style=\"font-weight: bold;\">May 2025<\/span> and again in <span style=\"font-weight: bold;\">November<\/span>, its concerns have been disregarded.<\/p>\n<p>The Bar pledges that, if entrusted with <span style=\"font-weight: bold;\">LPQB leadership<\/span>, it would:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Reduce operational expenditure,<\/p>\n<\/li>\n<li>\n<p>Lower fees for law students, and<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Ensure transparent, professional, and accountable governance.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">The Malaysian Bar states that while it supports reforms that enhance governance and accountability, it strongly opposes amendments that introduce <span style=\"font-weight: bold;\">political or executive influence<\/span> into the LPQB&#8217;s composition.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p
