The provisions came into force on 7-11-2025.<\/p>\n<p>These Rules will <span style=\"font-weight: bold;\">apply<\/span> to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Indian citizens globally;<\/p>\n<\/li>\n<li>\n<p>Aircraft registered in India, regardless of location;<\/p>\n<\/li>\n<li>\n<p>Foreign aircraft operating in or over India;<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Aircraft operated by non- Indian citizens with a principal place of business or residence in India.<\/p>\n<\/li>\n<\/ul>\n<h3>Key Provisions:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>These Rules come under the ambit of <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/RAl83dp1\" target=\"_blank\">Bharatiya Vayuyan Adhiniyam, 2024<\/a>.<\/span><\/p>\n<\/li>\n<li>\n<p>The only <span style=\"font-weight: bold;\">purpose of investigating<\/span> any accidents and incidents will be to stop such events from happening again and not assigning blame or finding fault.<\/p>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Notification of occurrence:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>In case of any accident or incident, the <span style=\"font-weight: bold;\">pilot-in-command<\/span> will have to report it within <span style=\"font-weight: bold;\">24 hours<\/span> of becoming aware of it.<\/p>\n<\/li>\n<li>\n<p>In case, the pilot is killed or unable to report, then the owner, operator, hirer, or any person responsible will have to report the accident or incident.<\/p>\n<\/li>\n<li>\n<p>The notification has to be made to the following:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Aircraft Accident Investigation Bureau<\/span> (&#8216;AAIB&#8217;);<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Directorate General of Civil Aviation<\/span> (&#8216;DGCA&#8217;);<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; In case of <span style=\"font-weight: bold;\">serious accident or incident that happened in India<\/span>, the following must also be informed:<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">&#9830; District Magistrate;<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">&#9830; Nearest Police Station about the event and its location.<\/p>\n<\/li>\n<li>\n<p>In the case of<span style=\"font-weight: bold;\"> unmanned aircraft<\/span>&#8211; the <span style=\"font-weight: bold;\">remote pilot-in-command<\/span> will have to follow the same reporting procedure.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Information that will be included in the notification in plain language:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Abbreviations to be used:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">ACCID<\/span>&#8211; for accidents;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">INCID<\/span>&#8211; for incidents;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">SINCID<\/span>&#8211; for serious incidents.<\/p>\n<\/li>\n<li>\n<p>manufacturer, model, nationality and registration marks, and serial number of the aircraft;<\/p>\n<\/li>\n<li>\n<p>name of owner, operator, and hirer, if any, of the aircraft;<\/p>\n<\/li>\n<li>\n<p>qualification of the pilot-in-command, and nationality of crew and passengers;<\/p>\n<\/li>\n<li>\n<p>date and time in local time or UTC of the accident or incident;<\/p>\n<\/li>\n<li>\n<p>last point of departure and point of intended landing of the aircraft;<\/p>\n<\/li>\n<li>\n<p>position of the aircraft with reference to some easily defined geographical point and latitude and longitude;<\/p>\n<\/li>\n<li>\n<p>number of crew and passengers; aboard, killed and seriously injured; others, killed and seriously injured;<\/p>\n<\/li>\n<li>\n<p>description of the accident or incident and the extent of damage to the aircraft so far as is known;<\/p>\n<\/li>\n<li>\n<p>physical characteristics of the accident or incident area, as well as an indication of access difficulties or special requirements to reach the site;<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 2%;\">presence and description of dangerous goods on board the aircraft.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Note<\/span>&#8211; Notification should not be delayed due to the lack of complete information.<\/p>\n<li>\n<p>The <span style=\"font-weight: bold;\">Aircraft Accident<\/span> <span style=\"font-weight: bold;\">Investigation Bureau<\/span> will have to notify the facts in the territory of India or in the assigned oceanic airspace beyond the territory of India without making delay to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>State of Registry;<\/p>\n<\/li>\n<li>\n<p>State of Operator;<\/p>\n<\/li>\n<li>\n<p>State of Design:<\/p>\n<\/li>\n<li>\n<p>State of Manufacture;<\/p>\n<\/li>\n<li>\n<p>International Civil Aviation Organization when the aircraft involved is of a maximum mass of over 2,250 kilograms or is a turbojet powered airplane.<\/p>\n<\/li>\n<\/ul>\n<li>\n<p style=\"font-weight: bold;\">Who must investigate and when:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>If an accident or serious incident happens in India, regardless of where the aircraft is registered:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Aircraft Accident<\/span> <span style=\"font-weight: bold;\">Investigation Bureau<\/span> will investigate<span style=\"font-weight: bold;\">&#8211;<\/span><\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">&#9830; All accidents;<\/p>\n<p style=\"margin-left: 54pt; text-indent: -18pt;\">&#9830; Serious incidents involving aircraft <span style=\"font-weight: bold;\">weighing over 2250 kg<\/span> or <span style=\"font-weight: bold;\">turbojet aircraft<\/span>.<\/p>\n<\/li>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Directorate General of Civil Aviation<\/span> will investigate- all other incidents and serious incidents not covered above.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Central Government<\/span> can start a formal investigation if it thinks it&#8217;s necessary for any aircraft registered in India.<\/p>\n<\/li>\n<li>\n<p>Even if the Directorate General of Civil Aviation is supposed to investigate, the Aircraft Accident Investigation Bureau can take over if it believes it&#8217;s important to do so.<\/p>\n<\/li>\n<li>\n<p>The Aircraft Accident Investigation Bureau decides whether an event is an accident, serious incident, or incident &#8212; and its <span style=\"font-weight: bold;\">decision is final<\/span>.<\/p>\n<\/li>\n<li>\n<p>If an accident or serious incident happens <span style=\"font-weight: bold;\">outside any country&#8217;s territory<\/span> to an aircraft <span style=\"font-weight: bold;\">registered in India<\/span>, Aircraft Accident Investigation Bureau will investigate.<\/p>\n<\/li>\n<li>\n<p>If an accident happens in <span style=\"font-weight: bold;\">international waters<\/span> and India is the <span style=\"font-weight: bold;\">closest country<\/span>, and the aircraft is <span style=\"font-weight: bold;\">not Indian<\/span>, Aircraft Accident Investigation Bureau will:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; Ask the aircraft&#8217;s home country to investigate;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; Help with the investigation as much as it can.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Investigator-in-Charge will have unhampered access to the wreckage and to all other relevant material and information, including flight recorders and Air Traffic Services records.<\/p>\n<p class=\"List&nbsp;Paragraph\" style=\"Times New Roman&quot;;\">He will also have unrestricted control over it to ensure that a detailed examination can be conducted without delay by authorized personnel participating in the investigation.<\/p>\n<\/li>\n<li>\n<p>The <span style=\"font-weight: bold;\">Director General of Aircraft Accident<\/span> <span style=\"font-weight: bold;\">Investigation Bureau<\/span> can allow any person, including an <span style=\"font-weight: bold;\">Aircraft Accident<\/span> <span style=\"font-weight: bold;\">Investigation Bureau officer<\/span>, to carry out <span style=\"font-weight: bold;\">preliminary investigations<\/span> into an aircraft accident, serious incident or incident.<\/p>\n<p class=\"List&nbsp;Paragraph\" style=\"Times New Roman&quot;;\">The early investigation helps:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Understand the happened;<\/p>\n<\/li>\n<li>\n<p>Decide how serious the event is;<\/p>\n<\/li>\n<li>\n<p>Figure out what kind of experts are needed for a full investigation.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Investigator-in-Charge\/ Court will forward a copy of the draft final Report to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>State of Registry;<\/p>\n<\/li>\n<li>\n<p>State of operators<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Non- disclosure of records:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Certain records from aircraft accident or incident investigations will not be shared, except for investigation purposes, unless the Central Government decides that sharing them is more beneficial than the possible negative effects.<\/p>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Confidential records include:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Statements<\/span> taken from people during the investigation;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Communications<\/span> between crew or others involved in flying the aircraft;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Medical or private details<\/span> of people involved;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Cockpit voice recordings<\/span> and their transcripts;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Air traffic control recordings<\/span> and transcript;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Cockpit camera recordings<\/span> and transcripts;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Expert opinions<\/span> based on flight data or other analysis.<\/p>\n<\/li>\n<li>\n<p>These records can only be included in the <span style=\"font-weight: bold;\">final report<\/span> if they help explain what happened.
