Rajasthan High Court:<\/span> In a bail application filed under Section 483<\/a> of the Bharatiya Nagarik Suraksha Sanhita 2023<\/a> (‘BNSS’) by a 19-year-old, accused of being involved in a cybercrime, a Single Judge Bench of Sameer Jain, J., considered his age and allowed him to be released on bail. However, it restrained him from using any social media application, apps like telegram and WhatsApp during the continuation of the present matter and trial.<\/p>\n

The accused was arrested under Sections 318(4)<\/a>, 319(2)<\/a>, 336(3)<\/a>, 338<\/a> and 340(2)<\/a> of the Bharatiya Nyaya Sanhita, 2023<\/a> (‘BNS’) and Section 66-D<\/a> of the Information Technology Act, 2000<\/a> (‘IT Act’) and Section 13 of the Rajasthan Public Gambling Ordinance Act, 1949.<\/p>\n

The amicus curiae and the respondent stated that different bank accounts were used malafidely and there were prima facie allegations for accused’s involvement in commission of cybercrime.<\/p>\n

Considering that the accused was in custody since July 2025, the Court specified that it was inclined to allow the present bail application and enlarge the accused on bail subject to following conditions:<\/p>\n

  1. \n

    He would render all the details of the bank accounts which were operated under his name to the Investigating Authorities, so that an appropriate investigation could be carried out.<\/p>\n<\/li>\n

  2. \n

    During the currency of trial, he would only operate and use one account, for his regular personal lawful purposes.<\/p>\n<\/li>\n

  3. \n

    He would only use the SIM card that was linked and registered with the AADHAR authorities and in any possibility would not make an attempt to commit or indulge in any unlawful activity, while using the mobile phone.<\/p>\n<\/li>\n

  4. \n

    He would render all appropriate cooperation to the police authorities and mark attendance before the police authorities concerned on 5th of successive month, upon release.<\/p>\n<\/li>\n<\/ol>\n

    The Court directed that during the continuation of the present matter and trial, the accused would be restrained from use of any social media application, apps like telegram and WhatsApp.<\/p>\n

    Thus, the Court allowed the application and ordered the accused’s release on bail provided he furnished a personal bond of Rs 50,000 with two sureties of Rs 25,000 each to the satisfaction of the Trial Judge.<\/p>\n
