Supreme Court:<\/span> In a writ petition filed by a practicing advocate known for taking up causes concerning the rights of persons with disabilities, the petitioner sought directions to the Bar Council of India and the Bar Council of Uttar Pradesh to reserve certain positions in the Bar Council and Bar Associations for advocates with disabilities.<\/p>\n

The three-Judge Bench comprising of Surya Kant, Ujjal Bhuyan, and Joymalya Bagchi, JJ., disposed of the writ petition with a direction to the Bar Council of India to consider the petitioner’s cause in light of the relevant legislative policies, statutory provisions, and constitutional principles of equality. The Court also left it open to all stakeholders to take appropriate decisions on the matter.<\/p>\n

The Court noted that it is not in dispute that the election for the Bar Council of Uttar Pradesh had already been notified, although the nomination process had not yet commenced.<\/p>\n

The Court observed that it was not feasible at that stage to issue a positive mandamus directing the reservation sought by the petitioner, as the matter of reservation was essentially a policy issue.<\/p>\n

The petitioner was given liberty to approach the appropriate forum at a later stage if required. All pending applications were disposed of accordingly.<\/p>\n
