{"id":364205,"date":"2025-10-17T11:00:37","date_gmt":"2025-10-17T05:30:37","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=364205"},"modified":"2025-10-17T11:32:39","modified_gmt":"2025-10-17T06:02:39","slug":"fssai-bans-use-of-ors-in-food-product-labelling","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/10\/17\/fssai-bans-use-of-ors-in-food-product-labelling\/","title":{"rendered":"FSSAI Cracks Down on Misleading &#8220;ORS&#8221; Branding in Food Industry"},"content":{"rendered":"<style>\n.animate-charcter{background-image: linear-gradient(-225deg, #231557 0%, #44107a 29%, #ff1361 67%, #fff800 100%); background-size: 200% auto; -webkit-background-clip: text; -webkit-text-fill-color: transparent; animation: textclip 0s linear infinite;}\n@keyframes textclip {to {background-position: 200% center;}}\n<\/style>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 15-10-2025, the <span style=\"font-weight: bold;\">Food Safety and Standards Authority of India (&#8216;FSSAI&#8217;)<\/span> issued an <span style=\"font-weight: bold;\">order<\/span> that decisively prohibits the use of the term <span style=\"font-weight: bold;\">Oral Rehydration Salts (&#8216;ORS&#8217;)<\/span> in the branding, labelling, or naming of food products.<\/p>\n<h3>The Deception:<\/h3>\n<p style=\"margin-bottom: 3%;\">On 14-10-2025, FSSAI withdrew its earlier notifications that had permitted food business operators to use the term &#8220;ORS&#8221; in product names, provided they included a disclaimer stating:<\/p>\n<p class=\"animate-charcter\" style=\"margin-left: 36pt; margin-bottom: 3%;\">&#8220;<span style=\"font-style: italic;\">The product is NOT an ORS formula as recommended by WHO<\/span>.&#8221;<\/p>\n<p>However, on 15-10-2025, after further review, FSSAI concluded that use of term &#8216;<span style=\"font-weight: bold;\">ORS<\/span>&#8217; in product names is <span style=\"font-weight: bold;\">misleading to consumers<\/span> whether used standalone term or combined with prefixes or suffixes, is:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Deceptive and ambiguous<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Erroneous in label declarations<\/p>\n<\/li>\n<\/ul>\n<h3>The Violations:<\/h3>\n<p>The inclusion of the term &#8220;ORS&#8221; is in contravention of multiple provisions under food safety laws:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002763212\" target=\"_blank\">Food Safety and Standards Act, 2006<\/a><\/span>:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001552094\" target=\"_blank\">23<\/a> &amp; <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001552095\" target=\"_blank\">24<\/a><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Labelling and Display Regulations, 2020<\/span>:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Sub-regulations <span style=\"font-weight: bold;\">4(3)<\/span> and <span style=\"font-weight: bold;\">5(1)<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Advertising &amp; Claims Regulations, 2018<\/span>:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Sub-regulations <span style=\"font-weight: bold;\">4(1)<\/span> and <span style=\"font-weight: bold;\">4(13)<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">Violations of food safety laws are subject to penalties under <span style=\"font-weight: bold;\">Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001552126\" target=\"_blank\">52<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001552127\" target=\"_blank\">53<\/a><\/span> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002763212\" target=\"_blank\">Food Safety and Standards Act, 2006<\/a>.<\/p>\n<h3>The Directions:<\/h3>\n<p>FSSAI has directed all food business operators to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Remove the term &#8220;ORS&#8221;<\/span> from product names, trademarks, and labels.<\/p>\n<\/li>\n<li>\n<p>Ensure <span style=\"font-weight: bold;\">strict compliance<\/span> with all labelling and advertising norms.<\/p>\n<\/li>\n<li>\n<p>Note that the <span style=\"font-weight: bold;\">Direction dated 8-4-2022<\/span> regarding misleading advertisements of ORS substitutes <span style=\"font-weight: bold;\">remains in effect<\/span>.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">FSSAI&#8217;s move reinforces its commitment to <span style=\"font-weight: bold;\">consumer protection<\/span> and <span style=\"font-weight: bold;\">truthful labelling<\/span>.
