{"id":363732,"date":"2025-10-14T12:00:43","date_gmt":"2025-10-14T06:30:43","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=363732"},"modified":"2025-10-14T12:26:12","modified_gmt":"2025-10-14T06:56:12","slug":"employees-provident-funds-amendment-2025","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/10\/14\/employees-provident-funds-amendment-2025\/","title":{"rendered":"Clause-by-Clause Analysis of Employees&#8217; Provident Funds (Amendment) Scheme, 2025"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 10-2025, the Ministry of Labour and Employment notified <span style=\"font-weight: bold;\">Employees&#8217; Provident Funds (&#8216;EPF&#8217;) (Amendment) Scheme, 2025<\/span>, introducing a special compliance initiative titled the <span style=\"font-weight: bold;\">Employees&#8217; Enrolment Campaign, 2025<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">The scheme will come into effect on <span style=\"font-weight: bold;\">1-11-2025<\/span> and will remain operative till <span style=\"font-weight: bold;\">30-4-2026<\/span>.<\/p>\n<h3>Key Takeaways:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The campaign is designed to broaden the reach of social security under the <span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002796571\" target=\"_blank\">Employees&#8217; Provident Funds and Miscellaneous Provisions Act, 1952<\/a><\/span>.<\/p>\n<\/li>\n<li>\n<p>It provides a one-time compliance opportunity for employers to enroll employees who were previously not registered under the EPF Scheme.<\/p>\n<\/li>\n<li>\n<p>It applies to employees who:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Joined between 01-7- 2017 and 31-10- 2025.<\/p>\n<\/li>\n<li>\n<p>Are alive and employed on the date of declaration.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Employees who joined before 1-7-2017 are not eligible under this scheme.<\/p>\n<\/li>\n<li>\n<p>Employers who are not yet registered with Employees&#8217; Provident Fund Organisation (&#8216;EPFO&#8217;) can apply for coverage during the campaign period.<\/p>\n<\/li>\n<li>\n<p>Participating employers are required to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Create Face Authentication&#8212;verified Universal Account Numbers (&#8216;UANs&#8217;) for each eligible employee using the UMANG App, ensuring secure identity verification.<\/p>\n<\/li>\n<li>\n<p>Deposit contributions through the <span style=\"font-weight: bold;\">Electronic Challan-cum-Return<\/span> (&#8216;ECR&#8217;) system, which facilitates digital payment and record tracking.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>All eligible employees will declare online via the EPFO portal, and the declaration will be linked to the corresponding ECR.<\/p>\n<\/li>\n<li>\n<p>A <span style=\"font-weight: bold;\">flat damage fee of &#8377;100 is applicable per declaration.<\/span> Employers are allowed to submit only one consolidated declaration covering all eligible employees.<\/p>\n<\/li>\n<li>\n<p>Employers are required to pay their full share of EPF contributions. The employee&#8217;s share is waived if it was not previously deducted from wages.<\/p>\n<\/li>\n<li>\n<p>For contributions related to past periods, employers will also be required to pay interest under Section 7Q and administrative charges.<\/p>\n<\/li>\n<li>\n<p>If any inquiry under Section 7A or related provisions is pending, both employer and employee contributions will be paid in full.<\/p>\n<\/li>\n<li>\n<p>These provisions are intended to help employers rectify past non-compliance while ensuring employees receive EPF benefits.<\/p>\n<\/li>\n<li>\n<p>The declaration will be submitted online and linked to the ECR using a Temporary Return Reference Number.<\/p>\n<\/li>\n<li>\n<p>Employers will maintain regular EPF compliance from the date of declaration onward.<\/p>\n<\/li>\n<li>\n<p>Contributions for past employment periods will be deposited based on the declared date of joining of each employee.<\/p>\n<\/li>\n<li>\n<p>Inquiry officers are required to consider the declaration during proceedings. However, cases already concluded under Section 7A or related provisions are excluded from the campaign.<\/p>\n<\/li>\n<li>\n<p>EPFO will not initiate <span style=\"font-style: italic;\">suo motu<\/span> compliance action against employers for employees who have left the establishment before the declaration date, provided:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>All eligible employees have been declared<\/p>\n<\/li>\n<li>\n<p>No pending contributions remain<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Any declaration made through misrepresentation or concealment of facts will be considered invalid and subject to penal action under the EPF Act.<\/p>\n<\/li>\n<li>\n<p>The amendment is linked with the <span style=\"font-weight: bold;\">Pradhan Mantri-Viksit Bharat Rojgar Yojana<\/span> (&#8216;PMVBRY&#8217;), allowing employers who register or declare additional employees under this campaign to avail PMVBRY benefits.<\/p>\n<\/li>\n<li>\n<p>Under <span style=\"font-weight: bold;\">Part A<\/span>, benefits apply to new employees who join after the declaration or conclusion of any pending inquiry.<\/p>\n<\/li>\n<li>\n<p>Under <span style=\"font-weight: bold;\">Part B<\/span>, eligibility begins six months after the declaration or inquiry conclusion and continues until <span style=\"font-weight: bold;\">31-7-2027<\/span>. Metrics such as net additionality and length of service will be calculated from this start date.<\/p>\n<\/li>\n<li>\n<p>If PMVBRY benefits were already received before the declaration, they will be adjusted against future payments or recovered if no future payments are due.<\/p>\n<\/li>\n<li>\n<p>Employers can submit ECRs for the <span style=\"font-weight: bold;\">6-month period<\/span> along with applicable contributions to qualify for PMVBRY benefits.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Paragraph 30<\/span> of the EPF Scheme has been amended to waive the employee&#8217;s contribution for the campaign period, provided it was <span style=\"font-weight: bold;\">not deducted<\/span> from wages.<\/p>\n<\/li>\n<li>\n<p>A new <span style=\"font-weight: bold;\">Table-2<\/span> under <span style=\"font-weight: bold;\">Paragraph 32-A<\/span> introduces a <span style=\"font-weight: bold;\">flat damage fee of &#8377;100<\/span> for defaults occurring between <span style=\"font-weight: bold;\">1-7-2017 and 31-10-2025<\/span>.<\/p>\n<\/li>\n<li>\n<p>This &#8377;100 fee is considered <span style=\"font-weight: bold;\">full compliance<\/span> under the:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002856939\" target=\"_blank\">Employees&#8217;
