Modeled on the office of the American Vice-President, India&#8217;s Vice-President is both a constitutional necessity and a safeguard against disruptions in the functioning of the Republic.<\/p>\n<p style=\"margin-bottom: 3%;\">This article examines the election of the Vice-President in detail, with a focus on constitutional provisions, statutory framework, procedure, and judicial scrutiny.<\/p>\n<h2 style=\"margin-bottom: 2%; text-align: center;\">Constitutional Framework<a id=\"fnref1\" href=\"#fn1\" title=\"1. Laxmikant 7th Edition\"><sup>2<\/sup><\/a><\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p><span style=\"font-weight: bold;\">Inclusion of nominated members<\/span> of both Houses (excluded in presidential elections).<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Exclusion of State Legislatures<\/span>,<span style=\"\"> which are integral in presidential elections.<\/span><\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\">Dr. B.R. Ambedkar<a id=\"fnref3\" href=\"#fn3\" title=\"3. ibid\"><sup>3<\/sup><\/a>, during the Constituent Assembly Debates, explained this distinction: since the Vice-President&#8217;s primary role is limited to presiding over the Rajya Sabha, it was unnecessary to involve state legislatures in his election.<\/p>\n<p style=\"margin-bottom: 3%;\">In Constituent Assembly Debates, Volume VII, p. 1001, Dr. B.R. Ambedkar observed <span style=\"font-style: italic;\">&#8220;The President is the head of the State, and his power extends both to the administration by the Centre as well as to the states. Consequently, it is necessary that in this election, not only should members of Parliament play their part, but the members of the state legislatures should have a voice. But, when we come to the Vice-President, his normal functions are to preside over the council of states. It is only on a rare occasion, and that too for a temporary period, that he may be called upon to assume the duties of the president. That being so, it does not seem necessary that the members of the state legislatures should also be invited to take part in the election of the Vice-President&#8221;<\/span>.<\/p>\n<h2 style=\"margin-bottom: 2%; text-align: center;\">Method of Election<a id=\"fnref4\" href=\"#fn4\" title=\"4. Election to the office of Vice President of India\"><sup>4<\/sup><\/a><\/h2>\n<p style=\"margin-bottom: 3%;\">The election is conducted under the <span style=\"font-weight: bold;\">system of proportional representation by means of the single transferable vote (STV)<\/span>, and the <span style=\"font-weight: bold;\">voting is by secret ballot<\/span>.<\/p>\n<h3>Key features:<\/h3>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Each Member of Parliament casts a single ballot but can rank candidates in order of preference.<\/p>\n<\/li>\n<li>\n<p>Counting follows the quota system, ensuring the winning candidate secures a majority through first or subsequent preferences.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">The <span style=\"font-weight: bold;\">Election Commission of India<\/span> supervises the entire process, under the <span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002942207\">Presidential and Vice-Presidential Elections Act, 1952<\/a><\/span> (amended in 1997).<\/p>\n<\/li>\n<\/ul>\n<h2 style=\"margin-bottom: 2%; text-align: center;\">Nomination mechanics and scrutiny: the strict checklist<a id=\"fnref5\" href=\"#fn5\" title=\"5. ibid\"><sup>5<\/sup><\/a><\/h2>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Subscribers:<\/span> At least <span style=\"font-weight: bold;\">20 proposers<\/span> and <span style=\"font-weight: bold;\">20 seconders<\/span>, all electors.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Deposit:<\/span> &#8377;<span style=\"font-weight: bold;\">15,000<\/span> (cash with RO or receipt of deposit in RBI\/Government Treasury).<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Papers:<\/span> Up to <span style=\"font-weight: bold;\">four<\/span> nomination papers may be filed; only <span style=\"font-weight: bold;\">one deposit<\/span> needed.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Electoral roll proof:<\/span> Certified copy of the candidate&#8217;s entry in the current <span style=\"font-weight: bold;\">Parliamentary electoral roll<\/span> must be furnished.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Who may present?<\/span> Candidate, or any proposer\/ seconder, between <span style=\"font-weight: bold;\">11 a.m. and 3 p.m.<\/span> on appointed days.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">One-candidate rule for subscribers:<\/span> An elector can subscribe (as proposer\/ seconder) <span style=\"font-weight: bold;\">only one<\/span> candidate; if multiple, only the <span style=\"font-weight: bold;\">first delivered<\/span> nomination counts.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Rejection grounds (illustrative, not exhaustive):<\/span> ineligibility on scrutiny day; proposer\/ seconder not an elector; inadequate subscribers; forged\/non-genuine signatures; presentation beyond prescribed time\/ place\/ person; security deposit not made as prescribed. A curable, <span style=\"font-weight: bold;\">non-substantial<\/span> defect does not vitiate the nomination; a valid alternate set can save the candidature.<\/p>\n<h2 style=\"margin-bottom: 2%; text-align: center;\">Polling, preferences and ballot validity &#8211; what electors must do (and avoid)<a id=\"fnref6\" href=\"#fn6\" title=\"6. ibid\"><sup>6<\/sup><\/a><\/h2>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Marking preferences:<\/span> Electors may indicate as many preferences as there are candidates (1, 2, 3, &#8230;). Only <span style=\"font-weight: bold;\">first preference<\/span> is <span style=\"font-weight: bold;\">mandatory<\/span>. Preferences may be marked in <span style=\"font-weight: bold;\">international form of Indian numerals, roman numerals, or any recognised Indian language numerals<\/span>. <span style=\"font-weight: bold;\">Do not<\/span> write &#8220;one\/two\/three&#8221; in words; that <span style=\"font-weight: bold;\">invalidates<\/span> the ballot.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Invalidation (core rules):<\/span> A ballot is invalid if <span style=\"font-weight: bold;\">&#8220;1&#8221; is not marked<\/span>, or marked for <span style=\"font-weight: bold;\">more than one<\/span> candidate, or if <span style=\"font-weight: bold;\">&#8220;1&#8221; and another figure<\/span> are both marked for the same candidate, or if <span style=\"font-weight: bold;\">any identifying mark<\/span> is made. Postal ballots can be rejected if the signature\/attestation is not duly attested by the specified authority.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">No whip \/ secrecy:<\/span> No Anti-Defection Law consequences; members may vote according to conscience; voting is by <span style=\"font-weight: bold;\">secret ballot<\/span>.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Assistance \/ postal \/ proxy:<\/span><\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">No proxy<\/span> voting.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">No companion<\/span> is permitted even for disabled\/illiterate electors; the <span style=\"font-weight: bold;\">Presiding Officer<\/span> records the vote on request.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Postal ballot<\/span> is permitted <span style=\"font-weight: bold;\">only<\/span> for voters under <span style=\"font-weight: bold;\">preventive detention<\/span>; the Government notifies particulars to ECI, which dispatches the postal ballot.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2 style=\"margin-bottom: 2%; text-align: center;\">Counting methodology and quota<a id=\"fnref7\" href=\"#fn7\" title=\"7. ibid\"><sup>7<\/sup><\/a><\/h2>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">First count &amp; quota:<\/span> After segregating invalid ballots, first-preference votes are tallied for each candidate. The <span style=\"font-weight: bold;\">quota<\/span> is: <span style=\"font-weight: bold;\">(Total valid votes &divide; 2) + 1<\/span> (fraction ignored). A candidate meeting\/ exceeding the quota on first count is <span style=\"font-weight: bold;\">declared elected<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Transfers &amp; exhaustion:<\/span> If no one reaches quota, the lowest candidate is eliminated and his ballots are transferred per next available preference. Ballots without a next valid preference become <span style=\"font-weight: bold;\">exhausted<\/span>. The cycle continues until someone reaches quota or only <span style=\"font-weight: bold;\">one<\/span> candidate remains (who is then declared elected even without reaching the quota). With <span style=\"font-weight: bold;\">two candidates<\/span>, first count suffices &#8212; whoever gets more valid votes wins. Counting is normally completed <span style=\"font-weight: bold;\">on polling day<\/span> in Parliament House.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Deposit forfeiture:<\/span> If a losing candidate&#8217;s valid votes do <span style=\"font-weight: bold;\">not exceed one-sixth<\/span> of the number of votes necessary to secure return, the security <span style=\"font-weight: bold;\">deposit is forfeited<\/span>; otherwise it is returned.<\/p>\n<h2 style=\"margin-bottom: 2%; text-align: center;\">Timelines and continuity safeguards<a id=\"fnref8\" href=\"#fn8\" title=\"8. Ibid.\"><sup>8<\/sup><\/a><\/h2>\n<p style=\"margin-bottom: 3%;\">Under <span style=\"font-weight: bold;\">Section 4<\/span> of the <span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002942207\">Presidential and Vice-Presidential Elections Act, 1952<\/a><\/span>, ECI may issue the election notification <span style=\"font-weight: bold;\">on or after the 60th day<\/span> before the term&#8217;s expiry; the schedule must ensure the <span style=\"font-weight: bold;\">Vice-President-elect assumes office the day after<\/span> the outgoing incumbent&#8217;s term ends. Article <span style=\"font-weight: bold;\">68<\/span> complements this by preventing vacancies.<\/p>\n<h2 style=\"margin-bottom: 2%; text-align: center;\">Qualifications for Election<a id=\"fnref9\" href=\"#fn9\" title=\"9. Constitution of India\"><sup>9<\/sup><\/a><\/h2>\n<p>To be eligible, a candidate must:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Be a citizen of India.<\/p>\n<\/li>\n<li>\n<p>Have completed <span style=\"font-weight: bold;\">35 years of age<\/span>.<\/p>\n<\/li>\n<li>\n<p>Be qualified for election as a member of the <span style=\"font-weight: bold;\">Rajya Sabha<\/span>.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Not hold any <span style=\"font-weight: bold;\">office of profit<\/span> under Union, State, or local authorities.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">Exceptions: The President, Vice-President, Governors, and Union\/State Ministers are not considered to hold offices of profit for this purpose.<\/p>\n<h2 style=\"margin-bottom: 2%; text-align: center;\">Oath, term, removal and acting President<a id=\"fnref10\" href=\"#fn10\" title=\"10. MP Jain, Indian Constitutional Law\"><sup>10<\/sup><\/a><\/h2>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Oath:<\/span> Before the <span style=\"font-weight: bold;\">President<\/span>, or a person appointed by the President.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Term:<\/span> <span style=\"font-weight: bold;\">Five years<\/span>, with a <span style=\"font-weight: bold;\">hold-over<\/span> until successor enters office.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Removal:<\/span> By <span style=\"font-weight: bold;\">Rajya Sabha<\/span> resolution passed by <span style=\"font-weight: bold;\">absolute majority<\/span> of its total membership, <span style=\"font-weight: bold;\">agreed to<\/span> by <span style=\"font-weight: bold;\">Lok Sabha<\/span> by <span style=\"font-weight: bold;\">simple majority<\/span>; <span style=\"font-weight: bold;\">14 days&#8217; notice<\/span> is a constitutional condition precedent.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Acting President:<\/span> On vacancy\/absence of the President, the VP acts as President for up to <span style=\"font-weight: bold;\">six months<\/span> till a new President assumes office, during which period he has <span style=\"font-weight: bold;\">all powers and immunities<\/span> of the President and is <span style=\"font-weight: bold;\">entitled to the President&#8217;s emoluments<\/span>. An election petition may be filed by a <span style=\"font-weight: bold;\">candidate<\/span> or <span style=\"font-weight: bold;\">ten or more electors jointly<\/span>, <span style=\"font-weight: bold;\">within 30 days<\/span> from publication of the result under Section 12 of the 1952 Act.
