Delhi High Court:<\/span> In an application filed under Order XXXIX Rule 2A<\/a> of Civil Procedure Code, 1908<\/a> (‘CPC’) seeking direction against defendant 1, to restrain them from infringing the copyright of the plaintiff’s literary works. A Single Judge Bench of Manmeet Pritam Singh Arora J., held that defendant’s action of uploading and making available for viewing plaintiffs copyrighted articles on Sci-Net as well as Sci-Hub was in violation of the undertaking dated 24-12-2020 and therefore defendant was prima facie guilty of contempt. The Court alsodirected the Department of Telecommunications (‘DoT’) and Ministry of Electronics and IT (‘MeitY’) to issue a notification to block access to defendant 1’s website, pass blocking orders within 72 hours, and ensure that access to the website is effectively blocked within 24 hours thereafter.<\/p>\n

Defendant 1, a Russian national, was the creator and owner of the website Sci-Hub (www.sci-hub.ru and via mirror websites www.sci-hub.se and www.sci-hub.st) which stored, reproduced, issued copies, and made available for viewing and download, plaintiffs’ literary works including scientific articles, journals, and books and communicated it to the public. Defendant 1 had acknowledged her blatant disregard for copyright laws in the introduction to the Sci-Hub website which promoted itself as a pirate website. To restrain Defendant 1 from infringing the copyrights of the plaintiff’s literary works the present application was filed before the Court.<\/p>\n

The Court observed that the undertaking of the defendant, was recorded at the hearing dated 24-12-2020 and was accepted by the Court as it was unambiguous and unequivocal. The Court further observed that the defendant had in compliance with the undertaking and directions of the Court, disabled viewing of plaintiff’s existing articles from Sci-Hub and did not upload any new articles\/publications of the plaintiffs on the said website.<\/p>\n

The Court noted that the plaintiffs had placed on record defendants e-mail dated 15-8-2025, which was her response to the averments made by the plaintiff as regards to violation of the undertaking dated 24-12-2020 which confirmed the averments made in the application and also exhibited the defendants lack of regard for the legal process.<\/p>\n

The Court further observed that defendant 1 had admitted that plaintiffs’ articles could be viewed on Sci-Hub and on Sci-Net. The Court observed that defendant 1 had submitted that Sci-Hub and Sci-Net were distinct websites and therefore, her undertaking dated 24-12-2020 would be inapplicable to Sci-Net. Further, defendant 1 had in her e-mail dated 15-8-2025, admitted that plaintiffs’ articles [published after 2022] had been uploaded on Sci-Net, which was a sister website of Sci-Hub. The Court observed that the uploading of the plaintiff’s articles on Sci-Net and viewability of plaintiff’s earlier articles on Sci-Hub constituted a breach of the defendants undertaking and the orders of the Court continuing the interim direction.<\/p>\n

The Court observed that the plaintiff had demonstrated that enquiries for their copyrighted articles on the website of Sci-Hub directs the user to Sci-Net which established that Sci-Net was being used by defendant 1 to overreach her undertaking dated 24-12-2020. The Court further observed that defendant 1’s website Sci-Hub had been infringing copyrights by using unauthorized means to access and download literary works belonging to several copyright owners including the plaintiffs’, which had led to passing of blocking orders against Sci-Hub in 11 countries. The Court on observing the declaration and introduction on the homepage of Sci-Hub acknowledging piracy and relying on UTV Software Communication Ltd<\/span> v. 1337x.to<\/span>, 2019 SCC OnLine Del 8002<\/a>, was of the prima facie opinion that defendant’s website Sci-Hub and its sister website Sci-Net was a rogue website.<\/p>\n

The Court thus, observed that defendant’s action of uploading and making available for viewing plaintiffs copyrighted articles on Sci-Net as well as Sci-Hub was in violation of the undertaking dated 24-12-2020 and therefore defendant was prima facie guilty of contempt.<\/p>\n

The Court further observed that wilful disregard of the undertaking by the defendant, blocking access to ‘Sci-Hub’ (www.sci-hub.ru and its mirror websites www.sci-hub.se and www.sci-hub.st) and ‘Sci-Net’ (www.sci-net.xyz) through internet service providers (‘ISPs’) was a necessary and proportionate enforcement measure, failure of which may embolden further violations of the plaintiffs’ copyrights.<\/p>\n

The Court directed DoT (Defendant 12) and MeitY (Defendant 13) to issue a notification calling upon the various ISPs and telecom service providers, registered under it to block access to Defendant 1 website(s) and issue blocking orders within 72hours on issuance of which, ISP’s shall within 24 hours block the websites<\/p>\n

The matter will next be taken up on1-12-2025.<\/p>\n
