It reflects a comprehensive and forward-looking approach to regulating one of the fast-growing segments of the digital economy.<\/p>\n<h3>Key highlights of Online Gaming Act:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>This Act is a comprehensive structure of <span style=\"font-weight: bold;\">19 Sections<\/span> distributed across <span style=\"font-weight: bold;\">6 Chapters<\/span>, each addressing distinct regulatory, enforcement, and definitional aspects of online gaming in India.<\/p>\n<\/li>\n<li>\n<p>This Act establishes a <span style=\"font-weight: bold;\">national-level legal framework<\/span> to ensure uniformity in regulation and enforcement across states, addressing cross-border and inter-state inconsistencies, applicable to online gaming services offered:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Within India<\/p>\n<\/li>\n<li>\n<p>Operated from outside India but accessible to users within India<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Act provides clear definitions and interpretative guidance on key terminologies to ensure clarity in regulatory treatment of various gaming formats, including:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Online Game<\/span>: Any game played on electronic or digital devices via the internet or other communication technologies.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Online Money Game<\/span>: Games involving monetary stakes or deposits with the expectation of financial rewards.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Online Social Game<\/span>: Games played for entertainment or skill development without monetary stakes.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">E-sport<\/span>: Competitive online games recognized as legitimate sports.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Other Stakes<\/span>: Virtual or real items convertible to money, such as tokens, coins, or credits.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>&#8220;<span style=\"font-weight: bold;\">E-sport<\/span>&#8221; is defined as an online game played as part of <span style=\"font-weight: bold;\">multi-sports events<\/span>, involving <span style=\"font-weight: bold;\">organized competitive multiplayer formats<\/span> governed by <span style=\"font-weight: bold;\">predefined rules<\/span>. It is:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Recognised under the <span style=\"font-weight: bold;\">National Sports Governance Act, 2025<\/span><\/p>\n<\/li>\n<li>\n<p>Registered with the designated <span style=\"font-weight: bold;\">Authority or agency<\/span><\/p>\n<\/li>\n<li>\n<p>Determined solely by players&#8217; <span style=\"font-weight: bold;\">physical dexterity<\/span>, <span style=\"font-weight: bold;\">mental agility<\/span>, <span style=\"font-weight: bold;\">strategic thinking<\/span>, or similar skills<\/p>\n<\/li>\n<li>\n<p>Permitted to involve <span style=\"font-weight: bold;\">registration or participation fees<\/span> for administrative purposes<\/p>\n<\/li>\n<li>\n<p>Allowed to offer <span style=\"font-weight: bold;\">performance-based prize money<\/span>, but strictly <span style=\"font-weight: bold;\">prohibited from involving betting, wagering, or staking<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>This Act empowers the <span style=\"font-weight: bold;\">Central Government<\/span> to formally <span style=\"font-weight: bold;\">recognise and register e-sports<\/span> as a legitimate form of competitive sport in India, to It actively promote and develop the sector through institutional and policy support.<\/p>\n<\/li>\n<li>\n<p>To foster growth and innovation in the e-sports ecosystem, the Government will undertake:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Formulation of guidelines and standards<\/p>\n<\/li>\n<li>\n<p>Organisation of national and international e-sports events<\/p>\n<\/li>\n<li>\n<p>Establishment of training academies, research centres, and dedicated institutions<\/p>\n<\/li>\n<li>\n<p>Introduction of incentive schemes and public awareness campaigns<\/p>\n<\/li>\n<li>\n<p>Development of indigenous e-sport technology platforms<\/p>\n<\/li>\n<li>\n<p>Coordination with State Governments and recognised sporting federations to integrate e-sports into broader sporting policy initiatives<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>A central feature of the Act is to levy strict prohibition on <span style=\"font-weight: bold;\">online money gaming<\/span>. It bans:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Offering or facilitating online money games.<\/p>\n<\/li>\n<li>\n<p>Advertising or promoting such games through any media.<\/p>\n<\/li>\n<li>\n<p>Financial transactions related to online money gaming services.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Act mandates the creation of an <span style=\"font-weight: bold;\">Authority on Online Gaming<\/span>, which will include:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>A Chairperson<\/p>\n<\/li>\n<li>\n<p>Appointed Members<\/p>\n<\/li>\n<li>\n<p>Designation of an existing Authority or agency to perform regulatory functions<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Authority is empowered to:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Determine whether a game qualifies as an online money game<\/p>\n<\/li>\n<li>\n<p>Recognise and categorise online games<\/p>\n<\/li>\n<li>\n<p>Register games and gaming platforms under the prescribed norms<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Directions, Orders, Guidelines, or Codes of practice issued by this <span style=\"font-weight: bold;\">Authority<\/span> will be binding on entities involved in:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Offering<\/p>\n<\/li>\n<li>\n<p>Organising<\/p>\n<p>,<\/li>\n<li>\n<p>Facilitating online games<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Act prescribes stringent penalties for violations:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Up to <span style=\"font-weight: bold;\">&#8377;1 crore fine<\/span> or <span style=\"font-weight: bold;\">3 years imprisonment<\/span> for offering online money gaming services.<\/p>\n<\/li>\n<li>\n<p>Up to <span style=\"font-weight: bold;\">&#8377;50 lakh fine<\/span> or <span style=\"font-weight: bold;\">2 years imprisonment<\/span> for advertising such games.<\/p>\n<\/li>\n<li>\n<p>Enhanced penalties for repeat offenders, including mandatory minimum sentences and higher fines.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The offences under <span style=\"font-weight: bold;\">Sections 5 and 7<\/span> are classified as <span style=\"font-weight: bold;\">cognizable and non-bailable<\/span>, overriding provisions of the <span style=\"font-weight: bold;\">Bharatiya Nagarik Suraksha Sanhita, 2023<\/span>, granting law enforcement broader powers for immediate action.<\/p>\n<\/li>\n<li>\n<p>Notably, if an offence is committed by a company, <span style=\"font-weight: bold;\">every person responsible<\/span> for the conduct of its business will be held <span style=\"font-weight: bold;\">personally liable<\/span>, ensuring accountability at the highest levels of management.<\/p>\n<\/li>\n<li>\n<p>Whoever fails to the Directions\/Orders of the Online gaming Authority, following will be imposed:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Penalty of up to &#8377;10 lakh<\/p>\n<\/li>\n<li>\n<p>Suspension or cancellation of registration<\/p>\n<\/li>\n<li>\n<p>Prohibition from offering, facilitating, or promoting such games for a duration determined by the Central Government or the Authority<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Chapter VI grants the Central Government authority to regulate and restrict access to online money gaming platforms. It empowers designated officers to conduct searches, seizures, and arrests without a warrant. Legal protection is provided for actions taken in good faith under the Act. The chapter also allows the government to make rules and resolve implementation challenges, ensuring the Act&#8217;s smooth enforcement.<\/p>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\"><span
