Parents Gain a Say: Inside Delhi\u2019s School Education (Transparency in Fixation and Regulation of Fees) Act, 2025"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 14-8-2025, the <span style=\"font-weight: bold;\">Department of Law, Justice and Legislative Affairs<\/span> issued <span style=\"font-weight: bold;\">Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025<\/span> to bring about transparency in the matter of fixation, regulation and collection of fees by schools in the National Capital Territory of Delhi.<\/p>\n<p style=\"font-weight: bold;\">Key Points:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>Applicable to the whole National Capital Territory of Delhi.<\/p>\n<\/li>\n<li>\n<p>Schools cannot collect any fee in excess of the fee fixed or approved by this Act.<\/p>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">School Level Fee Regulation Committee:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Every School will have to constitute a <span style=\"font-weight: bold;\">Parent- Teachers Association<\/span> namely <span style=\"font-weight: bold;\">School Level Fee Regulation Committee<\/span> for each academic year before 15<span style=\"vertical-align: super;\">th<\/span> July<span style=\"font-weight: bold;\">.<\/span><\/p>\n<\/li>\n<li>\n<p>The <span style=\"font-weight: bold;\">committee will consist of<\/span>:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Chairperson<\/span>&#8211; Representative of Management of the school nominated by such Management;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Secretary<\/span>&#8211; Principal of the school;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Member<\/span>&#8211; Three teachers of school to be selected through draw of lots;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Member<\/span>&#8211; Five parents from Parent-Teachers Association to be selected through draw of lots;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Observer<\/span>&#8211; Nominee of Director of Education.<\/p>\n<\/li>\n<li>\n<p>Every school will display the names of the committee members on the notice board within 7 working days from the date of formation of the <span style=\"font-weight: bold;\">School Level Fee Regulation Committee.<\/span><\/p>\n<\/li>\n<li>\n<p>The School Level Fee Regulation Committee will have at least 1 member from Scheduled Castes, Scheduled Tribes or socially and educationally backwards classes of citizens and 2 women members.<\/p>\n<\/li>\n<li>\n<p>Parents will be allowed to enter into a draw of lots for election for not more than 2 consecutive years.<\/p>\n<\/li>\n<li>\n<p>A General Meeting will be held before 15<span style=\"vertical-align: super;\">th<\/span> of August of every year.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Regulation of fees in school:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Management can propose the fee if its recognition has not been suspended or withdrawn.<\/p>\n<\/li>\n<li>\n<p>The fee that will be charged for the academic year 2025-26, w.e.f. 1-5-2025, will be deemed to be the proposed fee.<\/p>\n<\/li>\n<li>\n<p> Once the <span style=\"font-weight: bold;\">School Level Fee Regulation Committee<\/span> is formed, the Management will submit the details of the proposed fee for the next block of 3 academic years to the committee and the committee will decide the amount of fee.<\/p>\n<\/li>\n<li>\n<p>The <span style=\"font-weight: bold;\">School Level Fee Regulation Committee<\/span> will have to approve the fee within 30 days from the date of receipt of the proposed fee.<\/p>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">The fee approved by the School Level Fee Regulation Committee will be binding on the school for 3 academic years.<\/p>\n<\/li>\n<li>\n<p>In case the <span style=\"font-weight: bold;\">School Level Fee Regulation Committee<\/span> fails to decide the fee by 15<span style=\"vertical-align: super;\">th<\/span> September, the Management can refer the matter to District Fee Appellate Committee.<\/p>\n<\/li>\n<li>\n<p>Parents can prefer an appeal against the decision of the <span style=\"font-weight: bold;\">School Level Fee Regulation Committee<\/span>, within 30 days, to the District Fee Appellate Committee.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">District Fee Appellate Committees:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>It will be constituted by the Director of Education and comprise the following:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Chairperson<\/span>&#8211; Deputy Director of Education of the concerned District;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Member Secretary<\/span>&#8211; Deputy Director of Education (Zone);<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Member<\/span>&#8211; Chartered Accountant;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Member-<\/span> Accounts functionary of the Region\/District;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Member<\/span>&#8211; 2 representatives of schools;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; <span style=\"font-weight: bold;\">Member<\/span>&#8211; 2 representatives of parents.<\/p>\n<\/li>\n<li>\n<p>The <span style=\"font-weight: bold;\">District Fee Appellate Committees<\/span> will regulate their own procedure and will have the powers of a Civil Court while trying a suit.<\/p>\n<\/li>\n<li>\n<p>Orders cannot be passed <span style=\"font-weight: bold;\">by the District Fee Appellate Committees<\/span> in the absence of the Chairperson.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Factors for determining fee:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>location of the school;<\/p>\n<\/li>\n<li>\n<p>infrastructure made available to the students for qualitative education, the facilities provided and as mentioned in the prospectus or web-site of the school;<\/p>\n<\/li>\n<li>\n<p>education standard of the school;<\/p>\n<\/li>\n<li>\n<p>expenditure on administration and maintenance;<\/p>\n<\/li>\n<li>\n<p>excess fund generated from any person including non-resident Indians, as a part of charity, contribution by the Government under any of its schemes;<\/p>\n<\/li>\n<li>\n<p>qualified teaching and non-teaching staff as per the norms and their salary components;<\/p>\n<\/li>\n<li>\n<p>reasonable amount for yearly salary increments;<\/p>\n<\/li>\n<li>\n<p>expenditure incurred on the students over total income of the school;<\/p>\n<\/li>\n<li>\n<p>reasonable revenue surplus for the purpose.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p style=\"font-weight: bold;\">Penalties:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>In case where a school is found to be levying a fee not determined in accordance with the provisions of this Act, the <span style=\"font-weight: bold;\">Director of Education<\/span> will direct the school to roll back such fees with immediate effect and to refund the excess fee to the student within a period of 20 working days or earlier.<\/p>\n<\/li>\n<li>\n<p>Schools will also be liable to pay:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; For first time violation- a penalty not less than Rs. 1 lakh which can extend up to Rs. 5 lakh.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; For second time or subsequent violation- a penalty not less than Rs. 2 lakh which can extend up to Rs. 10 lakh.<\/p>\n<\/li>\n<li>\n<p>In case of repeated violations, the Director of Education can:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; debar the person in charge and responsible for the conduct of the affairs of the school from holding any official post in either the management or the school;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; by order restrict the right of such Management to propose fee increase for subsequent years;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">&#10003; order the suspension of recognition of such school;<\/p>\n<p style=\"margin-left: 36pt;
