On 14-8-2025, the Department of Law, Justice and Legislative Affairs<\/span> issued Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025<\/span> to bring about transparency in the matter of fixation, regulation and collection of fees by schools in the National Capital Territory of Delhi.<\/p>\n

Key Points:<\/p>\n

    \n
  1. \n

    Applicable to the whole National Capital Territory of Delhi.<\/p>\n<\/li>\n

  2. \n

    Schools cannot collect any fee in excess of the fee fixed or approved by this Act.<\/p>\n<\/li>\n

  3. \n

    School Level Fee Regulation Committee:<\/p>\n

      \n
    • \n

      Every School will have to constitute a Parent- Teachers Association<\/span> namely School Level Fee Regulation Committee<\/span> for each academic year before 15th<\/span> July.<\/span><\/p>\n<\/li>\n

    • \n

      The committee will consist of<\/span>:<\/p>\n

      ✓ Chairperson<\/span>– Representative of Management of the school nominated by such Management;<\/p>\n

      ✓ Secretary<\/span>– Principal of the school;<\/p>\n

      ✓ Member<\/span>– Three teachers of school to be selected through draw of lots;<\/p>\n

      ✓ Member<\/span>– Five parents from Parent-Teachers Association to be selected through draw of lots;<\/p>\n

      ✓ Observer<\/span>– Nominee of Director of Education.<\/p>\n<\/li>\n

    • \n

      Every school will display the names of the committee members on the notice board within 7 working days from the date of formation of the School Level Fee Regulation Committee.<\/span><\/p>\n<\/li>\n

    • \n

      The School Level Fee Regulation Committee will have at least 1 member from Scheduled Castes, Scheduled Tribes or socially and educationally backwards classes of citizens and 2 women members.<\/p>\n<\/li>\n

    • \n

      Parents will be allowed to enter into a draw of lots for election for not more than 2 consecutive years.<\/p>\n<\/li>\n

    • \n

      A General Meeting will be held before 15th<\/span> of August of every year.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

    • \n

      Regulation of fees in school:<\/p>\n

        \n
      • \n

        Management can propose the fee if its recognition has not been suspended or withdrawn.<\/p>\n<\/li>\n

      • \n

        The fee that will be charged for the academic year 2025-26, w.e.f. 1-5-2025, will be deemed to be the proposed fee.<\/p>\n<\/li>\n

      • \n

        Once the School Level Fee Regulation Committee<\/span> is formed, the Management will submit the details of the proposed fee for the next block of 3 academic years to the committee and the committee will decide the amount of fee.<\/p>\n<\/li>\n

      • \n

        The School Level Fee Regulation Committee<\/span> will have to approve the fee within 30 days from the date of receipt of the proposed fee.<\/p>\n<\/li>\n

      • \n

        The fee approved by the School Level Fee Regulation Committee will be binding on the school for 3 academic years.<\/p>\n<\/li>\n

      • \n

        In case the School Level Fee Regulation Committee<\/span> fails to decide the fee by 15th<\/span> September, the Management can refer the matter to District Fee Appellate Committee.<\/p>\n<\/li>\n

      • \n

        Parents can prefer an appeal against the decision of the School Level Fee Regulation Committee<\/span>, within 30 days, to the District Fee Appellate Committee.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

      • \n

        District Fee Appellate Committees:<\/p>\n

          \n
        • \n

          It will be constituted by the Director of Education and comprise the following:<\/p>\n

          ✓ Chairperson<\/span>– Deputy Director of Education of the concerned District;<\/p>\n

          ✓ Member Secretary<\/span>– Deputy Director of Education (Zone);<\/p>\n

          ✓ Member<\/span>– Chartered Accountant;<\/p>\n

          ✓ Member-<\/span> Accounts functionary of the Region\/District;<\/p>\n

          ✓ Member<\/span>– 2 representatives of schools;<\/p>\n

          ✓ Member<\/span>– 2 representatives of parents.<\/p>\n<\/li>\n

        • \n

          The District Fee Appellate Committees<\/span> will regulate their own procedure and will have the powers of a Civil Court while trying a suit.<\/p>\n<\/li>\n

        • \n

          Orders cannot be passed by the District Fee Appellate Committees<\/span> in the absence of the Chairperson.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

        • \n

          Factors for determining fee:<\/p>\n

            \n
          • \n

            location of the school;<\/p>\n<\/li>\n

          • \n

            infrastructure made available to the students for qualitative education, the facilities provided and as mentioned in the prospectus or web-site of the school;<\/p>\n<\/li>\n

          • \n

            education standard of the school;<\/p>\n<\/li>\n

          • \n

            expenditure on administration and maintenance;<\/p>\n<\/li>\n

          • \n

            excess fund generated from any person including non-resident Indians, as a part of charity, contribution by the Government under any of its schemes;<\/p>\n<\/li>\n

          • \n

            qualified teaching and non-teaching staff as per the norms and their salary components;<\/p>\n<\/li>\n

          • \n

            reasonable amount for yearly salary increments;<\/p>\n<\/li>\n

          • \n

            expenditure incurred on the students over total income of the school;<\/p>\n<\/li>\n

          • \n

            reasonable revenue surplus for the purpose.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

          • \n

            Penalties:<\/p>\n

              \n
            • \n

              In case where a school is found to be levying a fee not determined in accordance with the provisions of this Act, the Director of Education<\/span> will direct the school to roll back such fees with immediate effect and to refund the excess fee to the student within a period of 20 working days or earlier.<\/p>\n<\/li>\n

            • \n

              Schools will also be liable to pay:<\/p>\n

              ✓ For first time violation- a penalty not less than Rs. 1 lakh which can extend up to Rs. 5 lakh.<\/p>\n

              ✓ For second time or subsequent violation- a penalty not less than Rs. 2 lakh which can extend up to Rs. 10 lakh.<\/p>\n<\/li>\n

            • \n

              In case of repeated violations, the Director of Education can:<\/p>\n

              ✓ debar the person in charge and responsible for the conduct of the affairs of the school from holding any official post in either the management or the school;<\/p>\n

              ✓ by order restrict the right of such Management to propose fee increase for subsequent years;<\/p>\n

              ✓ order the suspension of recognition of such school;<\/p>\n

              ✓ order the withdrawal of recognition of such school;<\/p>\n
