These Rules impose a <span style=\"font-weight: bold;\">complete ban on the establishment of new law colleges<\/span>, <span style=\"font-weight: bold;\">Centers of Legal Education<\/span> (\u2018CLEs\u2019), for a continuous period of <span style=\"font-weight: bold;\">three years<\/span>.<\/p>\n<h3>Key Highlights of BCI\u2019s 3-Year Moratorium on Law Colleges-<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>The BCI formally approves the <span style=\"font-weight: bold; font-style: italic;\">Rules of Legal Education, 2025<\/span>, applicable to all CLEs.<\/li>\n<li>These Rules will be published shortly and remain in force for three years from the date of implementation.<\/li>\n<li>For the duration of the moratorium, any new CLE is not permitted to be established anywhere in India. Existing CLEs are prohibited from introducing:\n<ul style=\"list-style-type: disc;\">\n<li>New sections<\/li>\n<li>New courses<\/li>\n<li>Additional batches<\/li>\n<\/ul>\n<\/li>\n<li>The BCI clarifies that new proposals will not be approved, and pending applications submitted after implementation will not be considered.<\/li>\n<li>This move reflects a deep concern over the <span style=\"font-weight: bold;\">declining standards of legal education.<\/span><\/li>\n<li>The BCI cites the <span style=\"font-weight: bold;\">unchecked proliferation of substandard institutions<\/span>, <span style=\"font-weight: bold;\">routine issuance of No Objection Certificates (NOCs)<\/span> by State Governments, and <span style=\"font-weight: bold;\">affiliations granted without proper inspection<\/span> as key reasons for this intervention.<\/li>\n<li>With nearly <span style=\"font-weight: bold;\">2000 CLEs already operational<\/span>, the Council believes that India\u2019s institutional capacity is sufficient and that the focus will now shift to <span style=\"font-weight: bold;\">quality enhancement, systemic strengthening, and consolidation<\/span>.<\/li>\n<li>The BCI aims to curb <span style=\"font-weight: bold;\">commercialization<\/span>, address <span style=\"font-weight: bold;\">faculty shortages<\/span>, and eliminate <span style=\"font-weight: bold;\">academic malpractice<\/span> that has plagued the sector.<\/li>\n<li>The moratorium draws its authority from Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543876\" target=\"_blank\" rel=\"noopener\">7<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543876\" target=\"_blank\" rel=\"noopener\">7(1)(h)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543876\" target=\"_blank\" rel=\"noopener\">7(1)(i)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543816\" target=\"_blank\" rel=\"noopener\">24(1)(c)(iii)<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543852\" target=\"_blank\" rel=\"noopener\">49(1)(af), (ag), and (d)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\" rel=\"noopener\">Advocates Act, 1961<\/a>.<\/li>\n<li>This policy follows a sustained course of action undertaken by the Council, including a 2019 resolution imposing a temporary moratorium, judicial proceedings culminating in the judgment of December 4, 2020 by the Punjab and Haryana High Court, and a detailed press statement issued on June 16, 2021 urging rigorous diligence by State Governments and universities.<\/li>\n<li>The present Regulation answers the Court\u2019s guidance by enacting the measures through formal rules and reinforces the Council\u2019s long-standing commitment to quality.<\/li>\n<li>Before any new law college can be officially approved, it will be required to go through a strict 3 stage process designed to ensure quality and necessity:\n<ul style=\"list-style-type: disc;\">\n<li><span style=\"font-weight: bold;\">Government NOC-<\/span> The State Government or Ministry will be required to confirm there&#8217;s a genuine need for a new law college in the area.<\/li>\n<li><span style=\"font-weight: bold;\">University Affiliation-<\/span> The affiliating university will ensure if the college meets all basic standards, like infrastructure, faculty, and funding, stated under the Rules of Legal Education, 2008.<\/li>\n<li><span style=\"font-weight: bold;\">BCI Inspection-<\/span> Finally, the BCI will inspect the college, afterwards approval will be granted only if everything meets national legal education standards.<\/li>\n<\/ul>\n<\/li>\n<li>The Rules provide <span style=\"font-weight: bold;\">limited exceptions<\/span> for proposals that serve <span style=\"font-weight: bold;\">socially and educationally backward classes<\/span>, <span style=\"font-weight: bold;\">Scheduled Castes (SCs)<\/span>, <span style=\"font-weight: bold;\">Scheduled Tribes (STs)<\/span>, <span style=\"font-weight: bold;\">Economically Weaker Sections (EWS)<\/span>, and <span style=\"font-weight: bold;\">persons with disabilities<\/span>.<\/li>\n<li>The proposals from statutory universities or those recommended by authorities will be given consideration only if they meet stringent eligibility criteria and receive prior written approval from the BCI.<\/li>\n<li>During the moratorium, existing CLEs will undergo <span style=\"font-weight: bold;\">intensified inspections and compliance audits<\/span>.<\/li>\n<li>The Law colleges that fail to maintain expected standards can face <span style=\"font-weight: bold;\">closure<\/span>, <span style=\"font-weight: bold;\">derecognition<\/span>, or <span style=\"font-weight: bold;\">withdrawal of BCI approval<\/span>.<\/li>\n<li>All the degrees issued in violation of the Rules will be deemed invalid, and graduates from such law colleges will be <span style=\"font-weight: bold;\"><span style=\"font-weight: normal;\">barred from getting enrolled as an advocate<\/span> <\/span><span style=\"font-weight: bold;\">under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543816\" target=\"_blank\" rel=\"noopener\">24<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806286\" target=\"_blank\" rel=\"noopener\">Advocates Act, 1961<\/a>.<\/span><\/li>\n<li>With these regulation law students, the BCI promises a <span style=\"font-weight: bold;\">more credible and rigorous legal education system<\/span>, where institutions are held accountable and degrees carry genuine professional value.<\/li>\n<li>In the long run, this significant step will elevate the <span style=\"font-weight: bold;\">prestige of the legal profession<\/span>, improve <span style=\"font-weight: bold;\">career prospects<\/span>, and reinforce <span style=\"font-weight: bold;\">public trust in the justice system<\/span>.<\/li>\n<li>The BCI will review the impact of the moratorium annually and will therefore make necessary extension, modification, or omission, based on evolving circumstances.<\/li>\n<li>The BCI expects full cooperation from all stakeholders in upholding the objectives of the Regulation.<\/li>\n<li>Through this notice BCI issues a warning to non-compliant institutions and authorities. It states that failure to adhere to the Rules can result in:\n<ul style=\"list-style-type: disc;\">\n<li>Disciplinary proceedings<\/li>\n<li>Civil liability<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Criminal prosecution<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p style=\"margin-bottom: 3%;\">The <span style=\"font-weight: bold;\">Bar Council of India<\/span> is the statutory body responsible for regulating legal education and the legal profession and this landmark move is aimed at reshaping the landscape of legal education in India.
