{"id":356251,"date":"2025-08-11T13:00:25","date_gmt":"2025-08-11T07:30:25","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=356251"},"modified":"2025-08-11T13:12:32","modified_gmt":"2025-08-11T07:42:32","slug":"carriage-of-goods-by-sea-act-2025-issued-by-government","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/08\/11\/carriage-of-goods-by-sea-act-2025-issued-by-government\/","title":{"rendered":"Carriage of Goods by Sea Act, 2025 repeals century old law to make India\u2019s shipping sector future- ready"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 8-8-2025, the <span style=\"font-weight: bold;\">Ministry of Law and Justice<\/span> issued the <span style=\"font-weight: bold;\">Carriage of Goods by Sea Act, 2025<\/span> to provide for the responsibilities, liabilities, rights and immunities attached to carriers with respect to the carriage of goods by sea and for matters relating to it.<\/p>\n<p style=\"margin-bottom: 3%;\">The <span style=\"font-weight: bold;\">Carriage of Goods by Sea Bill, 2025<\/span> was introduced in the Parliament on 9-8-2024 by the <span style=\"font-weight: bold;\">Minister of Ports, Shipping and Waterways, Sarbananda Sonowal<\/span>, passed by <span style=\"font-weight: bold;\">Lok Sabha<\/span> on 28-3-2025 and passed by <span style=\"font-weight: bold;\">Rajya Sabha<\/span> on 6-8-2025. It received President\u2019s assent on <span style=\"font-weight: bold;\">8-8-2025.<\/span><\/p>\n<h3>Key Points:<\/h3>\n<ol style=\"list-style-type: decimal;\">\n<li>This Act <span style=\"font-weight: bold;\">repeals<\/span> a century- old colonial-era law, the<a href=\"http:\/\/www.scconline.com\/DocumentLink\/6ut69Jdc\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\"> Carriage of Goods by Sea Act, 1925<\/span><\/a>, with updated legislation designed to promote ease of doing business and make India\u2019s shipping sector future- ready.<\/li>\n<li>The Act applies to and in connection with the carriage of goods by sea in ships carrying goods from any port in India to any other port, whether in or outside India.<\/li>\n<li>There can be no implied absolute undertaking in any contract to which applicable rules apply for carriage of goods by sea.<\/li>\n<li>The <span style=\"font-weight: bold;\">Schedule<\/span> of the Act lays down applicable rules relating to the <span style=\"font-weight: bold;\">Bills of Lading<\/span>.<\/li>\n<li>The <span style=\"font-weight: bold;\">Schedule outlines<\/span> a special provision in maritime law regarding the carrier\u2019s liability and responsibility for goods transported by sea under <span style=\"font-weight: bold;\">Article VI<\/span>:\n<ul style=\"list-style-type: disc;\">\n<li>\n<p style=\"font-weight: bold;\">Special conditions:<\/p>\n<p>\u2713 Carriers, shipmasters, agents, and shippers can make custom agreements about the carrier&#8217;s responsibilities and liabilities for specific goods;<\/p>\n<p>\u2713 This agreement can also define the carrier\u2019s rights and immunities;<\/li>\n<li>These agreements will be <span style=\"font-weight: bold;\">valid only if:<\/span>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">\u2666 Does not conflict with public policy;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">\u2666 Does not compromise the diligence expected by the carrier\u2019s employees;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">\u2666 No bill of lading has been issued;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">\u2666 Terms are recorded in a non-negotiable receipt.<\/p>\n<\/li>\n<li>Article VI does not apply to regular commercial shipments.<\/li>\n<li>\n<p style=\"font-weight: bold;\">Special cases covered under Article VI:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">\u2666 Unique charter agreements;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">\u2666 Special conditions of goods;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">\u2666 Unusual circumstances surrounding the shipment.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>Every bill of lading, or similar document of title, issued in India, which contains or is evidence of any contract to which the applicable rules apply, will contain an express statement that it is to have effect subject to the applicable rules laid down in the Schedule, as applied by this Act.<\/li>\n<li>The Act promotes the use of electronic bills of lading, aiming to reduce paperwork and improve efficiency in shipping operations.<\/li>\n<li>The Central Government will have the power to issue directions for carrying out the provisions of the Act.<\/li>\n<li>The Central Government will also have the power to amend the Schedule of this Act.<\/li>\n<li>This Act will not affect the provisions laid down in <a href=\"http:\/\/www.scconline.com\/DocumentLink\/2w0mrsKp\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"font-weight: bold;\">Merchant Shipping Act, 1958<\/span><\/a> under:\n<ul style=\"list-style-type: disc;\">\n<li>Section 331- <span style=\"font-weight: bold;\">Carriage of dangerous goods<\/span><\/li>\n<li>Part X-A- <span style=\"font-weight:
