{"id":355619,"date":"2025-08-05T09:00:07","date_gmt":"2025-08-05T03:30:07","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=355619"},"modified":"2025-08-06T15:49:42","modified_gmt":"2025-08-06T10:19:42","slug":"bom-hc-friend-not-relative-under-section-498a-ipc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2025\/08\/05\/bom-hc-friend-not-relative-under-section-498a-ipc\/","title":{"rendered":"Husband\u2019s friend not a \u2018relative\u2019 under Section 498-A IPC: Bombay High Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Bombay High Court:<\/span> In the present case, the wife had filed an FIR under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\" target=\"_blank\" rel=\"noopener\">498-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (\u2018IPC\u2019), and had included the name of her husband\u2019s friend, who had instigated her husband to commit cruelty against her. The Division Bench of Anil L. Pansare and <span style=\"font-weight: bold;\">M.M. Nerlikar*<\/span>, JJ., held that a friend could not be said to be a relative as he was neither a blood relative nor had any relation through marriage or adoption. Thus, the Court quashed the FIR, emphasizing that a \u201cfriend\u201d was not a relative under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\" target=\"_blank\" rel=\"noopener\">498-A<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">An FIR was filed by a wife against her husband, in-laws, and husband\u2019s friend, under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\" target=\"_blank\" rel=\"noopener\">498-A<\/a>, read with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561652\" target=\"_blank\" rel=\"noopener\">34<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>. The wife had alleged that the friend used to come to her house and instigate her husband, and it was to such a great extent that the husband demanded to be given a plot and a car, from the wife\u2019s parents. The friend also tried to convince the husband that if his demands were not fulfilled then he should not cohabit with her and should send her to her paternal home.<\/p>\n<p style=\"margin-bottom: 3%;\">Aggrieved by the FIR and further criminal proceedings, the applicants, therefore, approached the Court, seeking quashing of the FIR.<\/p>\n<h3>Analysis, Law and decision<\/h3>\n<p style=\"margin-bottom: 3%;\">The Court noted that the main issue was to determine <span style=\"font-style: italic;\">\u201cwhether a \u2018friend\u2019 could be said to be a \u2018relative\u2019 of husband within the scope of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\" target=\"_blank\" rel=\"noopener\">498-A<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>?\u201d<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court relied on <span style=\"font-style: italic;\">Dechamma I.M.<\/span> v. <span style=\"font-style: italic;\">State of Karnataka<\/span>, 2024 SCC OnLine SC 3853, wherein the Supreme Court had dealt with a similar issue and observed that the word \u201crelative\u201d brings within its purview a status, which must be conferred either by blood or marriage or adoption.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the Court held that a friend could not be said to be a relative as he was neither a blood relative nor he was having any relation through marriage or adoption, therefore, a friend of husband would not fall under the definition of \u201crelative\u201d of the husband as contemplated under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\" target=\"_blank\" rel=\"noopener\">498-A<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>. Accordingly, the Court allowed the application and quashed and set aside the case arising out of the said FIR against the husband\u2019s friend.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Narendra v.
